Annual contract for type D Hot Mix and RC-2 Cutback Asphalt Oil for the Road & Bridge Dept 1 Unit Price Type D Hot Mix 2 Unit Price RC-2 Cutback Oil $ 1 43 per gal Young Brothers,Inc Hwy 21 West $25 75 net ton $ 1 25 per gal $ 72 per gal $30 00 hour 1 day R T Montgomery,Inc Loop 2818/Sandy Pt Rd $26 00 net ton Commissioner Wilcox moved to award the primary contract to Young Brothers, Inc with the secondary supplier being R T Montgomery, Inc The motion was seconded by Commissioner Beard and carried unanimously The Court proceeded to consider the following request to utilize County right-of-way 1 Producers Gas Company proposed to install a 4k inch steel gas pipeline within the right-of-way of Dowling Road in Precinct 1 On motion by Commissioner Cooley, seconded by Commissioner Beard the Court voted unani- mously to approve the application and authorized the installation of the pipeline A copy of the applica- tion is attached The Court next considered two statements from Utley James of Texas for modifications and additions to the Brazos County Court- house $81,796 42 and $177,962 00 On motion by Commissioner Turner, seconded by Commissioner Wilcox the Court voted unanimously to approve the payment of both state- ments The next matter to be considered was a change order to bid number 146 for the replacement of a bridge on Silver Hill Road in Precinct 4 This change to increase the amount of the contract by $2,500 00 On motion by Commissioner Turner, seconded by Com- missioner Wilcox, the Court voted unanimously to approve the change order and authorized the payment r r~ V V~PAC ~a_9L_ I J y ` The next matter to come before the Court were amendments E to the 1984 Budget as follows Justice of Peace, Pct 1, Place 1 - The location or description of the proposed installation is more fully shown by five copies of the drawings attached to this notice I understand and agree that 1. The Commissioner of the Precinct in which the right-of-way lies m% be notified prior to the beginning of construction in order that the Commissioner might be on hand to designate the actual locatior of the installation 2 That all damage to the roadways and rights-of-way will be repairec to their original condition to the satisfaction of the Commission( in which the roadway or right-of-way lies 3 That BRAZOS COUNTY reserves the right to require Applicant to re- locate or lower any such line at no cost to BRAZOS COUNTY, should same become necessary due to widening or lowering, or other alter ation of the roadway or right-of-way. 4. COORDINATOR, AND PROVIDING TUE DUTIES AND RESPONSIBILITIES OF THOSE OFFICES, IDENTIFYING AN OPERATIONAL ORGANIZATION, GRANTING NECESSARY POWERS TO COPE WITH ALL PHASES OF EMER- GENCY MANAGEMENT WHICH AGREEMENTS FOR EMERGENCY MANAGEMENT BETWEEN THIS AND OTHER COUNTIES OR CITIES FOR RELATED PURPOSES PROHIBITING UNAUTHORIZED WARNING AND ALL-CLEAR SIGNALS AND MAKING VIOLATIONS A MISDEMEANOR PUNISHABLE BY FINE NOT TO EXCEED $1,000 00 WHEREAS, the Commissioners Court of the County of Brazos finds that the identification of potential hazards and the prevention or mitigation of their effects must be an on-going concern of the County if the lives and property of the populace are to be protected, and WHEREAS, the Commissioners Court hereby declares that the pre- paration of a plan, and the means for its implementation, for the protection of lives and property in the County of Brazos from natural or man-caused disasters or threat thereof is immediately essential, and WHEREAS, the Commissioners Court further finds that in times of disasters which may imperil the safety of the inhabitants of the County, or their property, it becomes necessary to effectuate and place into operation the preconceived plans and preparations with a minimum of delay, and WHEREAS, the Commissioners Court finds, therefore, that the pre- paration, adoption, and implementation of such plans are now imperative, BE IT ORDERED, ADJUDGED AND DECREED BY THE COMMISSIONERS COURT OF BRAZOS COUNTY, TEXAS Section 1 There exists the office of Emergency Management Director o the County of Brazos, which shall be held by the County Judge in accordance with state law (a) An Emergency Management Coordinator may be appointed by and serve at the pleasure of the Director 71~ t .yE 2 ! r Sty~~ t r 11~ , A!(b) The Director shall be responsible for conducting a program of comprehensive emergency management within the County and for carrying out the duties and responsibilities set forth in Section 4 of this order He may delegate authority for execution of these duties to the Coordinator, but ultimate responsibility for such exe- cution shall remain with the Director Section 2 The powers and duties of the Director shall in- clude an on-going survey of actual or potential major hazards which threaten life and property within the County and an on-going program of identifying and requiring or recommending the implementation of measures which would tend to prevent the occurrence or reduce the impact of such hazards if a disaster dial occur As a part of his re- sponsibility in hazard mitigation, the Director shall supervise the development of an emergency management plan for Brazos County, and shall recommend that plan for adoption by the Commissioners Court along with any and all mutual aid plans and agreements which are deemed essential for implementation of such emergency management plan The powers of the Director shall include the authority to declare a state of disaster, but such action may be subject to confirmation by the Commissioners Court at its next meeting The duties of the Director shall also include the causing of a survey of the avail- ability of existing personnel, equipment, supplies and services which could be used during a disaster, as provided for herein as well as a continuing study of the need for amendments and improvements in the emergency management plan Section 3 The County Judge is hereby authorized to join with the mayors o t the cities in Brazos County in the formation of an Interjurisdictional Emergency Management Council to cooperate in the preparation of a joint emergency management plan and in the appoint- ment of a joint Emergency Management Coordinator. as well as all powers necessary to participate in a county-wide program of emergency management insofar as said program may affect Brazos County Section 4 The duties and responsibilities of the Emergency Management Di ector shall include the following (a) The direction and control of the actual disaster operations of the Brazos County Emergency Management organization as well as the training of Emergency Management personnel (b) The determination of all questions of authority and re- sponsibility that may arise within the Emergency Management organization of the County (c) The maintenance of necessary liaison with other county, municipal, district, state, regional, federal, or other Emergency Management organizations (d) The marshaling, after declaration of a disaster as pro- vided for above, of all necessary personnel, equipment or supplies management plan (e) The issuance of all necessary proclamations as to the existance of a disaster and the immediate operational effectiveness of the Brazos County emergency management plan (f) The issuance of reasonable rules, regulations or di- rectives which are necessary for the protection of life and property in Brazos County Such rules and regulations shall be filed in the office of the County Clerk, and shall receive widespread publicity unless publicity would be of aid and comfort to the enemy (g) The supervision of the drafting and execution of mutual aid agreements, in cooperation with the representatives of the state and of other local political subdivisions of the state, and the draft- ing and execution, if deemed desirable, of an agreement with the cities located in Brazos County for the county-wide coordination of Emergency Management efforts (h) The supervision of and final authorization for the pro- curement of all necessary supplies and equipment, including acceptance of private contributions which may be offered for the purpose of im- proving Emergency Management within the County (i) The authorizing of agreements, after approval by the County Attorney, for use of private property for public shelter and other purposes Section 5 The operational emergency management organi- zation of Brazos County shall consist of the officers and employees of the County so designated by the Director in the emergency manage- ment plan, as well as organized volunteer groups The functions and duties of this organization shall be distributed among such officers and employees in accordance with the terms of the emergency manage- ment plan Such plan shall set forth the form of the organization, establish and designate divisions and functions, assign tasks, duties and powers, and designate officers and employees to carry out the provisions of this order Insofar as possible, the form of organi- zation, titles, and terminology shall conform to the recommendations of the State Division of Emergency Management of the State of Texas and of the Federal Government Section 6 Any unauthorized person who shall operate a siren or of eTi rcfevice so as to simulate a warning signal, or the termination of a warning, shall be deemed guilty of a violation of this order and shall be subject to the penalties imposed by this order ~I I n 1 i 1 r] Section 7 At all times when the orders, rules, and ,regulations ma a and promulgated pursuant to this order shall be in effect, they shall supersede and override all existing orders, srules, and regulations insofar as the latter may be inconsistent therewith Section 8 This order shall not be construed so as to conflict wl.t any tate or Federal statute or with any military or naval order, rule, or regulation , Section 9 This order is an exercise by the County of its governmenta=unetions for the protection of the public peace, health, and safety and neither Brazos County, the agents and repre- sentatives of said County, or any individual, receiver, firm, partnership, corporation, association, or trustee, or any of the agents thereof, in good faith carrying out, complying with or attempting to comply with, any order, rule or regulation promul- gated pursuant to the provisions of this order shall be liable for any damage sustained to persons as the result of said ac- tivity Any person owning or controlling real estate or other premises who voluntarily and without compensation grants to the County of Brazos a license of privilege, or otherwise permits the County to inspect, designate and use the whole or any part or parts of such real estate or premises for the purpose of sheltering persons during an actual, impending or practice enemy attack shall, together with his successors in interest, if any, not be civilly liable for the death of, or injury to, any person on or about such real estate or premises under such license, privilege or other permission or for loss of, or damage to, the property of such person Section 10 No person shall have the public fun 2s o the County in carrying out any activity authorized by this order without prio• Commissioners Court, nor shall any person have the County by contract, agreement or otherwise specific approval of the Commissioners Court right to expend any Emergency Management r approval by the any right to bind without prior and Section 11 It shall be unlawful for any person willfully to obstruct, hinder , or delay any member of the Emergency Management organization in the enforcement of any rule or regulation issued pursuant to this order, or to do any act forbidden by any rule or ! regulation issued pursuant to the authority contained in this order It shall likewise be unlawful for any person to wear, carry or dis- play any emblem, insignia or any other means of identification as a member of the Emergency Management organization of the County of Brazos, unless authority to do so has been
