la The next matter to come before the Court was a request to
hire an additional Clerk for the Justice of the Peace, Precinct
I
4, Place 2, to handle truancy paperwork and records. After con-
ill r siderable discussion Commissioner Wilcox moved to take no action
on the request at this time, but to consider the request for the
1985 budget. The motion was seconded by Commissioner Beard, with

Next to be considered were requests to install pipeline with-

in County rights-of-way as follows ,
1. Producers Gas Company proposed to install a 4% inch gas
line within the right-of-way of Dowling Road in Precinct
2. Ferguson Crossing Pipeline Company proposed to install
ra natural gas line within the right-of-way of Varisco
( L Lane in Precinct 4, and Cash Road in Precinct 4

3. The City of College Station proposed to install a 16 inch
water line across North Graham Road at Wellborn Road in
Precinct 1

II On motion by Commissioner Cooley, seconded by Commissioner Wilcox, i
the Court voted unanimously to approve the three foregoing requests
and authorized the installations. A copy of the requests are attach-,
ed.

The Court next considered the Preliminary Plat of Fawn Lake
Estates in Precinct 2. After review of the plat, Commissioner
Wilcox moved to approve the plat subject to the following condi-
tions.
1/ 100 foot right-of-way on Fawn Lake Drive (subject to 16
foot utility easement in the 100 foot right-of-way if
+F required by REA)
2. Drainage easement for cul-d-sac between lots 11 and 12.
The motion was seconded by Commissioner Beard with Commissioners
Wilcox, Beard and the County Judge voting "Aye". Commissioner

The County Judge laid before the Court a cooperative agreement
between the cities of Bryan and College Station and the County of
Brazos for the reorganization of the County Health Unit as required
by Article 4436b, Texas Civil Statutes On motion by the County

41. The Commissioner of the Precinct in which the right-of-way lies m% •r

the Commissioner might be on hand to designate the actual location ,
of the installation.
2. That all damage to the roadways and rights-of-way will be repairer
to their original condition to the satisfaction of the Commission( i
in which the roadway or right-of-way lies.
3. That BRAZOS COUNTY reserves the right to require Applicant to re-
locate or lower any such line at no cost to BRAZOS COUNTY, should ,
same become necessary due to widening or lowering, or other alter.

must be notified prior to the beginning of construction in order
that the Commissioner might be on hand to designate the actual
location of the installation. _
T! 2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the Commissioner
in which the roadway or right-of-way lies.

I 3. That BRAZOS COUNTY reserves the right to require Applicant to relo-
cate or lower any such line at no cost to BRAZOS COUNTY, should
same become necessary due to widening or lowering, or other alter-
ation of the roadway or right-of-way. ,I
4. That BRAZOS COUNTY is in no 4ay responsible for any damage that
• might occur to any existing utility lines in the right-of-way.

of-way in accordance with governing laws.

inches (48") lower than the lowest part of the drainage or bar ditch

1 • In accord with the requirements as set out in Article 4436b, Texas Civil
,P Statutes, herein called "the Act", the Brazos County Health Unit is being
reorganized. It shall be a Public Health District as established under
. Article N of the Act.
It shall be named the Brazos County Public Health District. It shall evneist
E! ► of all the area located inside the Texas County of Brazos. Membership in the
Brazos County Public Health District shall consist of the Brazos County
Cbmsnissioners Court and the City Councils of the incorporated municipalities
of Bryan and College Station which are located within Brazos County.

(1) BCPHD means Brazos County Public Health District
• (2)• BOARD means the.Texas Board of Health .

I+ (6) HEALTH Avi'HOtti'1Y mans the physician who is to administer state and
local laws relating to public health
I, . (7) MEMM means a municipality, a county, or other governmental entity •
° which is a participant in a Public Health District
(8) pxYSICIAM means a person licensed to practice medicine by the Texas
State Board of Medical Examiners

(9) PUBLIC HEALTH BOARD means an administrative board of a Public Health
District

(10) PUBLIC HEALTH DISTRICT means a department of health established under
Article N Of the Act %
` (11) RmRESEPTTATIVE means a person appointed to serve on a Public Health
Board of a Public Health District
(12) REGION means a geographic area of the State of Texas as determined by
the Texas Department of Health
• , This cooperative agreement shall set out the terms of the operation of the

I, 4.03(a) of the Act.

(2) Cooperative agreement may be modified at the request of a member subject

to the approval of governing bodies of the members (who may consult with

and receive recommendations from the public health board).
(3) Procedures and criteria for the admission, withdrawal, and ekpulsion og
members shall be developed by the public health board and approved by
the members' governing bodies. At such time 'as all factors and

conditions have been investigated, including but not limited to all
provisions of this Act, the matter will be referred to the public health

board for recommendation to the members for action.

(4) Procedure for the dissolution of the organization shall be initiated and
°
through the director at which time he shall consult with all members and
the public health board. The director shall use every means to
\
coordinate an orderly dissolution of the organization.

At such time as all details have been resolved, the director shall
report to the public health board which shall make recommendation to the
governing bodies of the members who shall take final action on the
project.
All actions shall be exercised in accord with existing local, state, and
federal law, rules and regulations as they pertain to the termination o€'
" personnel, property and the responsibility to provide for services.
(S) Procedure for the selection and ranoval of the directors
(A) The director of the existing Brazos County Health Unit shall be the
director of the Brazos County Public Health District. Appointment
of a director when the position becomes vacant shall be made by the
governing bodies of the members subject to this Act and the approval

of the Texas Board of Health.

' duties as specified in Article III, Section 3.01 of the Act, and

bodies for lack of satisfactory discharge of duties, alcoholism,
i • drug, abuse, conviction of a felony, misappropriation of funds or
property, embezzlement, physical or mental impairment (disability)
6 which permanently prevents satisfactory discharge of duties. • y
~II 'Phis cooperative agreement shall provide for the creation of an advisory
public health board, in accord with Article N, Section 4.03(b) of this Act.

the three member entities. Each city council will select a member of
. its respective council or the city manager as its representative. The
county commissioners' court will select one of its commissioners or the

of the representatives will be appointed for a one year term on initial
I appointment to insure staggered terms. Each representative M be
It reappointed for four consecutive terms. Names of all members will be

will be filled by the member body from which the vacancy occurred.
~y (4) Each representative must have resided in the Brazos County Public Health
• District for a period of three years prior to his/her appointment.
(5) Representatives shall serve without compensation.
(6) Failure to attend four consecutive public health board meetings without a

~f (7) The director shall serve as an ex-officio non-voting member of the
public health board. The public health board shall advise members and
' the director on matters of public health including the budget. The
director will administer the program and shall report to the Texas Board
of Health and the public health board as the situation warrants.
