The first matter to come before the Court was consideration
of a budget for the Sesquicentennial Committee The County's
portion of the budget would be $11 436 00 The cities of Bryan
and College Station would also contribute this amount On motion
by Commissioner Beard seconded by Commissioner Wilcox the Court
voted unanimously to approve the budget and to amend the Revenue
Sharing Budget for the necessary funds
The next matter to come before the Court was the appointment
of Louis Garcia Jr as Constable of Justice Precinct 4 to fill
the vacancy created by the death of Richard Fronterhouse After
discussion the County Judge moved to appoint Mr Garcia to the
office of Constable Precinct 4 The motion was seconded by
Commissioner Wilcox and carried unanimously
The Court next considered a request from Richard Smith re-
garding a track of land he owns on Hopes Creek Road in Precinct 1
He advised the Court that he had placed his fence approximately
ten feet inside his property line and asked that the County con-
firm that they would not assert any claim on the 10 foot strip of
land along the roadway On motion by Commissioner Turner seconded
by Commissioner Beard the Court voted unanimously to authorize
the County Judge to sign the proper documents that would satisfy
the request A copy of the signed document is attached herewwith
The Court next considered a request from H E Redmond for a
tax refund in the amount of $1 056 66 for taxes paid on lots 1 and
2 in Redmond Terrace This property was on the tax roll at twice
the actual square foot The request was approved by the Tax Assess-
or On motion by Commissioner Beard, seconded by Commissioner
Turner the Court voted unanimously to approve the request and
authorized the refund
The Court next considered the following amendments to the
1984 Budget
Revenue Sharing 1000 miscellaneous purchase
Justice of Peace, Precinct 3 200 transferred to Justice
of Peace Precinct 2
Justice of Peace, Precinct 2 $200 transferred from Justices
of Peace, Precinct 3 1

On motion by Commissioner Cooley, seconded by Commissioner Beard,
the Court voted unanimously to approve the amendments as submitted
A copy of the amendments are attached herewith

The Court next considered the emergency purchase of a tractor
for Road and Bridge Precinct 2 in the amount of $11 999 00 On
motion by Commissioner Wilcox seconded by Commissioner Beard the
Court voted unanimously to grant the request and to authorize the
S purchase of the tractor and for the payment thereof
S - r Next to be considered were requests to utilize county rights-
of-way by the following companies and purposes
1 Producers Gas Company proposed to install a 6 inch
gas pipeline across the right-of-way of Dowling
Road in Precinct 1 On motion by Commissioner Cooley
4( seconded by Commissioner Beard the Court voted unani-
mously to approve the request and authorized the in-
stallation of the pipeline
2 McDaniel Petroleum Company proposed to install a gas
pipeline across the right-of-way of Valley Drive in
Precinct 4 On motion by Commissioner Turner seconded
by Commissioner Beard the Court voted unanimously to
approve the request and authorized the installation

c The Court proceeded to consider the following plats
~f 1 Preliminary Plat of Grapevine Subdivision in Precinct 4
After discussion it was the consensus of the Court that
action on the plat be delayed pending further information
2 Preliminary Plat of Harvey Acres in Precinct 3 After
discussion Commissioner Beard moved to approve the Plat
subject to an additional 10 foot to the right-of-way
across the front of the subdivision addition to a
utility easement along Bird Pond Road The motion was
seconded by Commissioner Turner and carried unanimously
The Court next considered a replat of a portion of Reserve
Tract 3 in Quail Run Phase I in Precinct 1 After review of
the Plat and on motion by Commissioner Cooley seconded by Com-
missioner Beard the Court voted unanimously to approve the Plat
as submitted

Dear Judge Holmgreent
On October 26, 1983, 1 purchased 135 acres of land
5 in the James Hope Survey, A-240 on Hope's Creek
Road south of College station I decided to rebuild
the fence along the road There were many large,
mature trees in the old fence liner so, rather than
clear the fence line and lose the trees, I decided
to move the fence about 10 feet inside my property
line
My attorney advises me that by having a strip of
land adjacent to the roadway and outside my fence
a problem could develop in which the county could
acquire said strip by adverse possession
Therefore to prevent this problem from developing,
I respectfully request that you confirm on behalf
of the county that the county will not assert any
claim on said strip of land of course this action
on your part would not preclude the acquisition of
any of my property through any legal means other
than adverse possession

To The Commissioners. Court of Brazos County& Texas

Bryan, Texas 77801
Formal notice is hereby given that Producer's 5a; ~omnony , Applican
proposes to place a " Natural Gas Pjp~jine within the right-of-way
of Dowling Road In Brazos County, Texas as follows:
Road crossing only

_ Installation parlleling the roadway a distance of 1,300 feet.
The location or description of the proposed installation is more full
shown by five (5) copies of the drawings attached to this notice
I understand and agree that:
1 The Commissioner of the Precinct in which the right-of-way lies M
be notified prior to the beginning of construction in order that
the Commissioner might be on hand to designate the actual locatio
of the installation
2 That all damage to the roadways and rights-of-way will be repaire
to their original condition to the satisfaction of the Commission
in which the roadway or right-of-way lies
3 That BRAZOS COUNTY reserves the right to require Applicant to re-
locate or lower any such line at no cost to BRAZOS COUNTY, should
same become necessary due to widening or lowering, or other alter
ation of the roadway or right-of-way

4 That BRAZOS COUNTY is in no way responsible for any damage that ft
occur to any existing utility lines in the right-of-way
5 That the line will be constructed and maintained on the county ra
of-way in accordance with governing laws
6- That the line or lines will be constructed no less than forty-ei4
inches (48") lower than the lowest part of the drainage or bar di
and the drainage is to be considered at least two feet (21) belov
the center of the roadway
7 That all roads be bored to forty feet (40') on either side og tha
centerline of the right-of-way or cased for such distance
8 That all sites will be barracaded during construction period
9 That the normal charge established by the Commissioners' Court is
$500 per crossing and/or $25 per rod when paralleling the roadwa%
