On motion by 1 iq Commissioner Beard, seconded by Commissioner Turner the Court voted 41 r unanimously to approve the statement. I 'Q The Court, having previously authorized legal council to file i suit against Scurlock Oil Company, Inc. for damages to a bridge ; f. on Dilly Shaw Tap Road in Precinct 2, proceeded to consider a ~ c settlement offered by Scurlock in the amount of $25,000.00. After discussion and on motion by Commissioner Beard, seconded by Com- missioner Turner the Court voted unanimously to accept the settle- ment and to authorize the County Judge to execute a Release for Damages. A copy of the Release is attached. The Court recognized Bill Farmer, representing the Elks Lodge, who invited the Court and all citizens to a ceremony at the Elks i f Lodge on Flag Day, June 14th., when American flags would be pre- sented to each of the Bra os County Volunteer Fire Departments. After review of the Plat and on motion by Commissioner Wilcox, seconded by Commissioner Beard the Court voted ' unanimously to approve the plat as submitted. i Gl y • 2. Preliminary Plat of Vista Oaks, Phase 11 in Precinct 3 f and the extra territorial jurisdiction of the City of Bryan. After discussion Commissioner Beard moved to approve the plat subject to the following condidtions: t + (a) Grant a variance to allow a 50 foot road 1 leading into the subdivision at the corner of lot 1, with a 25 foot set back line. Preliminary Plat of Valley View, Phase I in Precinct 3 and the extra territorial jurisdiction of the City of Bryan. After much discussion the matter was tabled pending submission of additional information. 4. Final Plat of Brookwood Subdivision in Precinct 3. After review of the plat, and on motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court voted unani- mously to approve the plat. The Court next considered the request of Ferguson Crossing Pipeline Company to install a gas line in the following rights-of- way: 1. An 8 inch gas line in Hopes Creek Road in Precinct 1. 2. A 4 inch gas line across Burt Road in Precinct 4. On motion by Commissioner Turner, seconded by Commissioner Cooley, the Court voted unanimously to approve the requests and authorize the installation of the pipelines. A copy of the requests are attached. The Court proceeded to consider the following bids and to authorize the payment thereof: 1. Ten (10) 5 drawer lateral files for the County Clerk's Office. E.O.S. - $7,225.00 Maniord Office Supply - $8,350.00 News Office Supply - $6,350.00 On motion by Commissioner Cooley, seconded by Commissioner Turner the Court voted unanimously to accept the low bid of News Office Supply in the amount of $6,350.00, and authorize the payment out of the Capital Projects Funds. 2. Roller Shelves for the District Clerk's Office. Walraven Brothers - 12,920.90 Stafford Lowden - 3,038.10 E.O.S. - 3,433.00 Maniord Office Supply - 3,333.00 News Office Supply - $3,405.00 On motion by Commissioner Cooley, seconded by Commissioner Turner the Court voted to accept the low bid of Walraven Brothers in the amount of $2,920.90, and to authorize the payment thereof out of a the Capital Projects Fund. 4 ` II . Bryan Auto Salvage $1,426.00 Russell's Dectective Service - $ 400.00 Henry's Used Cars - $1,300.00 On motion by Commissioner Beard, seconded by Commissioner Turner I the Court voted unanimously to accept the high bid of Bryan Auto ? ;'.Salvage in the amount of $1,426.00. The Court next considered a request from Winfred Pittman, Constable of Precinct 7, for funds fox rental of office space. After discussion Commissioner Cooley moved to deny the request. County Judge, Brazos County, Texas, being duly authorized to act on behalf of such county, by official action of the Commissioner's Court of Brazos County, Texas as shown by a certified copy of such action which is attached hereto as Exhibit A, do hereby release, requit and forever discharge Ashland Oil, Inc., its subsidiaries, affiliates and related companies, including but not limited to Scurlock Oil Company, their agents, servants, em- ploees, officers and directors, including but not limited to Billy Daniels, their heirs, succesbors and assigns from any and all liability and responsibility regarding the collapse of a bridge on Dilly Shaw Tap Road southwest of the intersection with FM 2776, on August 9, 1983 in Brazos County, Texas, which col- lapse in the subject of a civil action filed in the 272nd Judicial District Court, Brazos County, Texas, being Case No. 25,084. % t I Further, it is understood that this is a compromise of a disputed claim and that any payments made by Ashland Oil, Inc. or Scurlock Oil Company is in no way an admission of any liability or resppnsibility Finally. I declare that the terms of this settlement have been fully explained to me and to the members of the Commission& er's Court who fully understand the terms and voluntarily accept it for the purpose of making a full and final compromise of this claim as attested to by the copy of the official action of the Court attached hereto as aforementioned.
