On motion by Commissioner Cooley seconded by Commissioner Beard the Court voted unanimously to approve the Claims as submitted. The Court next considered a Notice of Proposed Installation in Coimty Right-Of-Way as follows 1. Prodeco Exploration Company, Inc proposed to install a three inch gas line within the right-of-way of Kurten Cemetery Road in Precinct 2. On motion by Commissioner Wilcox, seconded by Commissioner Beard, the Court voted unanimously to approve the application and authorized the installation of the gas line. A copy of the notice is attached The County Judge laid before the Court a letter from the Texas Justice Court Training Center advising the Court that Judge Tom Lyons, J. P. of Precinct 1 had successfully completed a twenty four hour course in the duties of the office of Justice of the Peace. The County Judge advised the Court that Mary Stone had re- signed from the Child Protective Service Board, and that the term of Mary Jernigan had expired. On motion by the County Judge, seconded by Commissioner Beard, the Court voted unanimously to appoint Connie Weedon to fill the vacancy created by the resig- nation of Mary Stone and to reappoint Mary Jernigan for another term. S The Court proceeded to consider the Preliminary Plat of Brookwood Subdivision in Precinct 3. After discussion and on motion by Commissioner Beard, seconded by Commissioner Wilcox the Court voted unanimously to approve the Preliminary Plat sub- ject to the addition of a statement regarding Construction of habital structures below the observed high water level. i On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to approve amendments to the 1934 Road and Bridge Precinct Budgets to reflect the unexpended balances of the 1983 precinct budgets. A copy of the amendment is attached. I understand and agree that: 1. The Commissioner of the Precinct in which the right-of-way lies must be notified prior to the beginning of construction in order that the Commissioner might be on hand to designate the actual location of the installation 2 That all damage to the roadways and rights-of-way will be repaired to their original condition to the satisfaction of the Commissioner in which the roadway or right-of-way lies 3 That BRAZOS COUNTY reserves the right to require Applicant to re- locate or lower any such line at no cost to BRAZOS COUNTY, should same become necessary due to widening or lowering, or other alter- ation of the roadway or right-of-way 4 That BRAZOS COUNTY is in no way responsible for any damage that might occur to any existing utility lines in the right-of-way 5 That the line will be constructed and maintained on the county right- of-way in accordance with governing laws 6. That the line or lines will be constructed no less than forty-eight inches (48") lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway 7.
