J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy Beard, Commissioner of Precinct 3; Milton Turner, Commissioner of Precinct 4; Frank Boriskie, County Clerk. On motion by Commissioner Wilcox, seconded by Commissioner Beard the Court voted unanimously to approve the Resolution. A copy of such Resolution is attached. =i The Court next considered a Resolution in support of cele- brating the Texas Sesquicentennial during 1986 and the appoint- ment of a Sesquicentennial Coordinating Committee. Tom Wallace pl l I On motion by Commissioner Beard, seconded by Commissioner Turner, the Court voted unanimously to approve the Minutes of the Commissioner Court meetings held: November 14, 1983, Nov- ember 15, 1983, November 28, 1983, December 2, 1983, December i~ 12, 1983 and December 13, 1983 without change. {1 The Court proceeded to appoint a Safety Coordinator and Safety Committee to implement safety programs for the purpose of reducing workers compensation accidents. On motion by Com- missioner Cooley, seconded by Commissioner Beard, the Court ' voted unanimously to appoint the following persons: i Walter Wilcox - Safety Coordinator Jerry Cotrone - County Shop Ernie Wentrcek - Juvenile Probation Fred Maddox - Adult Probation . . The Court next considered a request from the Arts Council of Brazos Valley for a commitment of $1700 for two programs: Artrain, an event which will celebrate the last 100 years of art work; NEA, Test Program, a projected three year commitment to support local arts councils expanded programs. These funds to be included in the Arts Councils Budget for 1984-1985. Noble Production Company proposed to install a 2 inch gas line within the right-of-way of Broach Road in Precinct 2. On motion by Com- missioner Wilcox, seconded by Commissioner Beard the Court voted unanimously to approve the application and authorized the installation. 2. Ferguson Crossing Pipeline Company proposed to install a 3 inch gas line within the right-of- way of Scott Lane in Precinct 4. On motion by Commissioner Turner, seconded by Commissioner Beard the Court voted unanimously to approve the application and authorized the installation. Copies of both notices are attached to these minutes. The Court proceeded to consider the following bids: 1. Services and supplies required for all elections financed by the County during 1984. ' (a) Texas Voting Systems, Inc. - 24,900.00 (Quantities bid are based on estimated re- quirements for two known elections. In the event other elections are called, the quoted unit price shall apply and are firm until January 1, 1985.) On motion by the County Judge, seconded by Commissioner Beard, the Court voted unanimously to accept the bid of Texas Voting Systems, Inc. ' 2, Oil and gas lease on 9.2 acre tract in Precinct 1. (Railroad right-of-way) No bids were received. 3. Sign configuration for Brazos County Livestock Pavillion. . a (a) Stabler Sign Company - $1,778.00 r. Under Other Business, the County Judge announced the office of Constable, Precinct 4 vacant due to the death of Richard Fronter- house and that filing for election to that office had been re- opened, according to law. 7T, P. . I I t I , i I I 1 I o ' The County Judge announced the meeting closed at 10:30 A.M. to discuss Personnel for the Constable's Office. The meeting was opened to the public at 10:45 P.M., at which time the County Judge announced that it whs the consensus of the Court that no appointment would be made to the Office of Constable, Precinct 4, and that anyone wishing the position of Constable should file with the Party Chairman of either party for election to the office. It was also announced that the Deputy Constables would be contacted to determine their relocation. Commissioner Beard requested that the replacement of two brid- ges on Elmo Weedon Road was done on an emergency basis, so that the road could be re-opened to the public at an early date. On motion by Commissioner Cooley, seconded by Commissioner Turner the Court voted unanimously to declare the construction done on an emergency basis and authorized the payment of the satement of Diamond Energy. There being no further business, the meeting was recessed un- til Friday, March 2, 1984, at 10:00 A.M. in the County Judges Office. March 2, 1984 - 10:00 A.M. The Court reconvened on Friday, March 2, 1984, at 10:00 A.M. in the County Judges Office with all members of the Court present. On motion by Commissioner Cooley, seconded by Commissioner Beard the Court voted unanimously to declare the purchases were made on an emergency basis and au- thorized the payment of the invoice in the amount of $14,884.45. 77- _ rf • . • . - . .n.-/ • t - ~A~~AGE •35 I i The Court next discussed the reassignment of the Deputy Constables of,'Precinct- 4. Winfred Pittman advised the Court that 9 of the 14 Reserve Deputy Constables requested to be assigned to Constable of Precinct 7 on a temporary basis. Mr. Pittman requested that the monthly car allowance of $450.00 be divided equally between the three Deputy Constables presently drawing a monthly car allowance. After discussion, Commissioner Beard moved to authorize the appointment of- the Reserve Deputy Constables to the Constable of Precinct 7 temporarily and to divide the monthly $450.00 car allowance equally between the 3 Deputies until such time as the opening of Constable, Precinct I' 4 is filled. The motion was seconded by Commissioner Cooley, i and carried unanimously. On motion by Commissioner Beard, seconded by Commissioner Wilcox the Court voted unanimously to. authorize the Constable of Precinct 7 to sign Purchase Orders and Payment Authorizations to be paid from the budget of Constable, Precinct 4. CORPORATION FOR PURPOSES OF SFCTION 103(k) OF THE INTERNPL REVENUE CODE OF 1954, AS AMENDED WHEREAS, the Commissioners Court of Brazos County, Texas (the "County"), has heretofore approved the creation and organization of the Brazos County Housing Finance Corporation (the "Corpora tior") pursuant to the Texas Housing Finance Corporations Act, Article 12691-7, Vernon's Texas Civil Statutes, as amended; and WHEREAS, by resolution adopted can January 24, 1984, the Board of Directors of the Corporation has declared its intent to issue its Multi-Family Housing Revenue Bonds, Series 1984 (Walden-or-Broadmoor Development), in an aggregate principal amount not to exceed $15,000,000 (the "Bonds"), to obtain funds to provide financing to TGS Joint Venture a Texas joint venture (the "Owner"), for the acquisition and construction of a multi-family rental residential development intended substantially for occupancy by elderly persons of low and moderate income and to be located on the northeast side of 29th and Broadmoor in Bryan, Te::as (the "Development") ; and WHEREAS, on February 14, 1984, the Board of Directors of the Corporation or its designee held a public hearing with respect to the proposed issuance'of the Bonds following publication of notice with respect thereto (a copy of which is attached hereto as Exhibit "A"), all under and in accordance with the provisions of Section 103(k) of the Internal Revenue Code of 1954, as amended (the "Code"), and applicable regulations thereunder; and WHEREAS, the Commissioners Court of the County, which is the elected legislative body of the County and the "applicable elected representative" of the County within the meaning of Section 103(k) of the Code and applicable regulations thereunder, has determined to approve the issuance of the Bonds for the purpose of satisfying the requirements of Section 103(k) of the Code; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF BRAZOS COUNTY, TEXAS THAT: Section 1. The Commissioner of the Precinct in which the right-of-way lies must be notified prior to the beginning of construction in order that the'Commissioner might be on hand to designate the actual location of the installation. 2.
