SPECIAL MEETING
DECEMBER 13, 1984
A special meeting of the Commissioners' Court of Brazos

County, Texas, was held in the Lecture Rehearsal Room of the
Brazos Center, 3232 Briarcrest Drive, Bryan, Brazos County,
Texas, beginning at 1:30 P.M. on Tuesday, December 13, 1983,

with the following members of the Court present.

R. J. Holmgreen, County Judge, presiding
Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2,
Milton Turner, Commissioner of Precinct 4;
Frank Boriskie,,Ceunty Clerk.
The first matter to come before the Court was consideration
ofl;bids received foria telephone system for Brazos County from
th+e following bidders:

AT&T
GTE
Corporate Voice & Data
LCT Communications
Centel Business Systems
Rolm
W. L. Stein, the County"s Communications Consultant recommend-
ed LCT Communications as the lowest bidder for a 400 station system
or GTE, the next lowest bidder for a larger system. After discussion
Commissioner Wilcox moved to negotiate the contract with LCT Com-
munications, in the amount of $224,161.00 and to pay for the system
from Bond funds. The motion was seconded by Commissioner Cooley
and carried unanimously.

Next to be considered were bids for a used 1/2 ton or 3/4 ton
pick-up truck for Precinct 1 as follows.

John Whitley Motors - 1980 Ford $4,000.00
Car Town - 1979 GMC, 1 ton 4,350.00
Ace Auto - 1978 Ford, 3/4 ton- 2,750.00
Car Town - 1978 Ford 5,450.00
Cherokee Auto Sales - 1981 Chevrolet 4,200.00
On recommendation and motion by Commissioner Cooley, seconded by
Commissioner Turner the Court voted unanimously to accept the
bid of Cherokee Auto Sales in the amount of $4,200.00 for a 1981

The Court reconvened at 1 30 P MI on Wednesday, December 14,
1983 with the following members of the Court present
R J Holmgreen, County Judge, presiding
Bill J Cooley, Commissioner of Precinct 1,
Walter Wilcox, Commissioner of Precinct 2,
Milton Turner, Commissioner of Precinct 4

Lonnie Williams with the Department of Highways and Public
Transportation was present and advised the Court that the Highway
Department had been authorized to proceed with the State Highway
6 South Project He advised the Court that the Highway Depart-
ment would begin acquiring the right-of-way for tracts 11 through
33 The total projected cost for the purchase of this right-of-
way is` $3,860,887, with the County's 10% share being $386,000,
and would not include moving of utilities After discussion Com-
missioner Cooley moved to amend the contract previously executed
in February to include parcels 11 through 32 for an amount of
$386,000 with monies to be paid with funds from Revenue Sharing
Funds, Oil and Gas Revenues and Right-Of-Way and Equipment Funds
The motion was seconded by Commissioner Turner and carried unani-
mously A copy of such contract is attached

This supplemental contractual agreement by and between the State of Texas. acting by and
through the State Department of Highways and Public Transportation, hereinafter called the
State, and Brazos County. Texas, acting by and through its duly
authorized official under Commissioners' Cturt Order dated the day of .
19 , hereinafter called the County, shall be effective on the date of approval and exe-
cution by and on behalf of the State
WHEREAS, the State and County entered into contractual agreements and supplemental
contractual agreements for procurement of right of way on the following projects on the
dates indicated

and, which are made a part of this instrument by reference, and. I ( '
WHEREAS, the County has requested that they be relieved of the obligation to acquire thel
necessary right of way and desires the State to assume the acquisition responsib lily, and, j

1 (WHEREAS, it is mutually desired by the County and the State to modify said origi al
contracts and any supplemental contracts implementing the terms and provisions of the
original contracts.

i NOW, THEREFORE, in consideration of the foregoing premises and the mutual oenefits to be
derived therefrom, the above described contracts are modified hereby to the extent of the
manner, mode aid method of the County's obligation to acquire the necessary right of way
and receive 902 reimbursement of the cost thereof in that the State hereby assumes the
obligation to acquire the necessary right of way and the County shall accomplish itslobli-
gation by contributing lOZ of the cost of the right of way as hereinafter described

The State is to acquire all right of way except that the County shall continue with its
present obligations to acquire the following described right of way:
Parcels: Between approximately Station No. 830 and Station No. 1474¢77
near Junction of SN 6 and Loop 508 at Navasota
The above limits include Parcels 34 - 160.
The county retains all utilities between station 683+09 to 1474+77

The County shall contribute to the State an amount equal to ten percent (102) of the coot
of the right of way to be acquired by the State and shall transmit to the State with the
return of this agreement, executed by the County, a warrant or check payable to the Sense
Department of Highways and Public Transportation in the amount of Three Hundred
Eighty Six Thousand and no/100
Dollars $~389,000.00 , which represents 10% of the estimated cost of the Qight of
way; however, if it is found that this amount is insufficient to pay the County°o obli0a-
Lion, then,the County, upon request of the State,-will forthwith supplement thin amount La
such amount as requested by the State. Upon completion of the project and in the event
the amount;as paid is more than 102 of the cost of the right'of way, then any enceso
amount will be returned to*the County. Cost of the right of way acquired by the 3c8tG
shall mean the total value of compensation'to owners for their property interesto wither
by negotiation qr eminent domain.
