On motion by Commissioner Cooley, seconded by Commissioner
Beard, the Court voted unanimously to approve the Minutes of the
Commissioners Court Meetings held September 12, 1983, September
t
26, 1983, October 10, 1983 and October 24, 1983
Ms Frances Niemeyer, representing Chem Jet, Inc and Roy
Gonzales was present to discuss the damaged bridge located on
Saxon Road northeast of the intersection of Saxon Road and FM
2036 in Precinct 3 Ms Niemeyer offered, as a settlement for
damages, the sum of $34,575 00 On motion by Commissioner Beard, `
seconded by Commissioner Cooley the Court voted unanimously to
accept the funds and to authorize the County Judge to sign a full f
release of damages

the Court voted unanimously to approve the budget amendments
The Court proceeded to canvass the election returns of the
Constitutional Amendment Election and Local Option Election held

On motion by Commissioner Wilcox, seconded by Commissioner Beard
the Court voted unanimously to accept the electronically tabulated
returns as true and correct and ordered the results certified to
the Secretary of State and recorded in the Official Records of the
County Clerk's office

Next to be considered were the following applications for
authorization to install pipelineslin county rights-of-way as
follows
1 Ferguson Crossing Pipeline Company proposed to install
a 3 inch gas line in the right-of-way of Broach Road
in Precinct 2 On motion by Commissioner Wilcox, sec-
onded by Commissioner Beard the Court voted unanimously
to approve the application and authorized the installa-
tion A copy of such permit is attached
On motion by Commissioner Beard, seconded by Commissioner

Cooley,lthe Court voted unanimously to close Democrat Road and
Long Trussel Road in Precinct 3 to through truck traffic

The Court proceeded to consider the following Plats:
1. Preliminary Plat of North Town Estates in Precinct 4
and the Bryan extra territorial jurisdiction. After
discussion regarding the single road in the subdivision
being a private road, Commissioner Turner moved to
approve the Preliminary Plat with the understanding
that the final plat include the statement that there
would be no public maintenance of the road within the
mobil home park. The motion was seconded by Commissio-
ner Beard and carried unanimously.
2. Preliminary Plat of Persimmon Hill in Precinct 3. On
motion by Commissioner Beard, seconded by Commissioner
Wilcox the Court voted unanimously to approve the plat
subject to the road being a 45% turn without the curve
and that the north road be extended to top the abutting
property.
On motion by Commissioner Cooley, seconded by Commissioner
Turner, the Court voted unanimously to approve the Change of
Status of the following employees:

NOTICE OF PROPOSED INSTALLATION IN COUNTY RIGHT-OF-WAY
To the Commissioners° Court of BRAZOS County, Texas
Brazos County Courthouse
Bryan, Texas 77801
Formal notice is hereby given that IERGUSON CROSSING PIPE LINE%Plicant,
proposes to place a 3" Gas Line within the right-of-way
of Broach Road in Brazos County, Texas as follows
The location or description of the proposed installation is more fully
shown by three (3) copies of the drawings attached to this notice
I understand and agree that
1 The Commissioner of the Precinct in which the right-of-way lies
must be notified prior to the beginning of construction in order
that the Commissioner might be on hand to designate the actual
location of the installation
2 That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the Commissioner
in which the roadway or right-of-way lies
3 That BRAZOS COUNTY reserves the right to require Applicant to re-
locate or lower any such line at no cost to BRAZOS COUNTY, should
same become necessary due to widening or lowerinq, or other alter-
ation of the roadway or right-of-way
4 That BRAZOS COUNTY is in no way responsible for any damage that
might occur to any existing utility lines in the right-of-way

S That the line will be constructed and maintained on the county right-
of-way in accordance with governing laws
6 That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (2') below
the center of the roadway
7 That all roads be bored to forty feet (40') on either side of the
right-of-way or cased for such distance
8 That all sites will be barracaded during the construction period I
Construction of this line will begin on or after the __day of ortaher
