SEPTEMBER 26, 1983
A special meeting of the Commissioners' Court of Brazos
County, Texas, was held in the Lecture Rehearsal Room of the
Brazos Center, 3232 Briarcrest Drive, Bryan, Brazos County,
Texas, beginning at 10 00 A M on Monday, September 26, 1983,
with the following members of the Court present

All members being present, the Court proceeded to set the
tax rate for the year 1983, to be applied to the collection of
taxes due on October 1, 1983 After discussion, Commissioner
Beard moved that the ad-valorum tax rate for all property on
the tax rolls of Brazos County, Texas, be set at $ 31 per 100
valuation Motion was seconded by Commissioner Wilcox All
members voted Aye, whereupon the County Judge announced the
motion had carried and the tax rate is hereby adopted for the
year 1983 and hereby levied against all property in Brazos County,
Texas

The next matter to come before the Court was the considera-
tion of amendments to the 1983 budget as follows:
1. Revenue Sharing
2. Court Coordinator
3. County Court at Law
4. Health Department
5. Various County offices to accomodate over expendi-
ture of various line items.
On motion by Commissioner Beard, seconded by Commissioner Cooley
the Court voted unanimously to approve the budget amendments as
submitted. A copy of such amendments are attached.
The Court next considered the appointment of Christopher C.
Mathewson as Engineering Geologist for the proposed expansion of
the Millican Landfill. The cost for testing services of the site
would be approximately $4,000. After discussion Commissioner
Cooley moved that Dr. Mathewson be appointed Engineering Geologist
for the project. The motion was seconded by Commissioner Beard
and carried unanimously.
The Court next considered a request from Ferguson Crossing
Pipeline Company for authorization to install a 4 inch gas line
in the right-of-way of Dilly Shaw Tap Road in Precinct 2. On
motion by Commissioner Wilcox, seconded by Commissioner Beard
the Court voted unanimously to approve the request and authorize
the installation. A copy of such request is attached.
The County Judge recognized Sandy Tucker, Vice President of
the League of Women Voters who presented the Court with a petition
concerning the Optional County Road Law and to request that the
issue be put on the ballot for the November 8th. Election. Such
petitions contain 2,314 names, 1,554 of which have been verified
by the Tax Assessor Collector. Ms. Tucker advised that there were
573 names which had not been verified at this date.
The Court next considered the request of Tommy Lyons, Justice
of Peace of Precinct 1 for a salary increase for 1983. Commissioner
Beard moved that the salary request be refused.for 1983. The motion

On motion by Commissioner Wilcox, seconded by Commissioner
Turner the Court voted unanimously to pay the County Membership
Dues to the National Association of Counties in the amount of
$1,147 00
The Court next considered a request by Commissioner Cooley,
that the State Lateral Road funds be divided equally among the
Precincts to be used for improving the County roads After dis-
cussion Commissioner Cooley moved to divide the funds and to
allocate $25,000 to each Precinct The motion died for lack of
a second

On motion by Commissioner Turner seconded by Commissioner Cooley
the Court voted unanimously to approve the Claims as submitted.
The County Judge presented a request from the Tax Collector
for authorization to secure terminals to connect the County Tax
Office with the Central Appraisal Office for a total cost of
$19,000, this cost to be shared with the City of Bryan and the
Bryan Independent School District. After discussion Commissioner
Beard moved to approve the request and to approve an amendment to
the Revenue Sharing Budget in the amount of $6,500, representing
the County's portion of the cost. The motion was seconded by
Commissioner Wilcox and carried unanimously.
On motion by Commissioner Wilcox, seconded by Commissioner
Beard, the Court voted unanimously to approve Change Order Number
6 for modifications and additions to the Brazos County Courthouse
in the total amount of $21,511. Such change order was for the re-
placement of electric controls servicing air conditioning and heat-
ing units, replacement of existing busing and circuit breakers in
Panels 9, 10, 11 and 12, furnish and install one envelope locker
depository on first floor of jail. A copy of such change order is
attached.
The Court next discussed voting entitlement for the Appraisal
Districts Directors election. The County Judge advised the Court
that the County has a total of 1,000 votes or 20% of the total
votes. On motion by Commissioner Beard, seconded by Commissioner
Turner, the Court voted unanimously to continue the practice of
allocating the County's vote to all candidates.
Commissioner Cooley requested that $100,000 be allocated to
the Road and Bridge fund and divided equally among the Precincts.
Such fund to be taken from the Revenue Sharing Fund or Oil and Gas
Revenue. No action was taken on the request.
There being no further business the Court recessed until Wed-
nesday at 2:00 P. M., at which time to consider the petition pre-
sented by the League of Women Voters.

The Commissioners Court reconvened at 2 00 P M on Wed-
nesday, September 28, 1983 at the Brazos Center,at 3232 Briarcrest
Drive, to consider the petition presented by the League of Women
Voters, requesting the Commissioners place the matter of the
Optional County Road Law of 1947 on the November 8th ballot
The County Clerk presented the Court with a certification of

verification of 2022 qualified names on petitions for calling an
election for or against the Optional County Road Law of 1947
The County Judge acknowledged receipt of the petitions and
varification of names and announced that the Proposition would

be placed on the Ballot for the November 8, 1983 Election, with
the wording as follows

NOTICE OF PROPOSED INSTALLATION IN COUNTY RIGHT-OF-WAY
To the Commissioners' Court of BRAZOS County, Texas
Brazos County Courthouse
Bryan, Texas 77801
Formal notice is hereby given that FERGUSON CROSSING PIPE LINE COMPANY ,
Applicant, proposes to place a 4" Gas Line within the right-
of-way of Dilly Shaw Tay Road in Brazos County, Texas as follows
The location or description of the proposed installation is more fully shown
by three (3) copies of the drawings attached to this notice
I understand and agree that

1 The Commissioner of the Precinct in which the right-of-way lies
must be notified prior to the beginning of construction in order
that the Commissioner might be on hand to designate the actual
location of the installation
2 That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the Commissioner
in which the roadway or right-of-way lies
3 That BRAZOS COUNTY reserves the right to require Applicant to relo-
cate or lower any such line at no cost to BRAZOS COUNTY, should
same become necessary due to widening or lowering, or other alter- I
ation of the roadway or right-of-way
4 That BRAZOS COUNTY is in no way responsible for any damage that `
might occur to any existing utility lines in the right-of-way
5 That the line will be constructed and maintained on the county right-
of-way in accordance with governing laws
6 That the line or lines will be constructed no less that forty-eight 1
inches (48") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (21) below
the center of the roadway
7 That all roads be bored to forty feet (401) on either side of the
right-of-way or cased for such distance k
8 That all sites will be barracaded during the construction period
Construction of this line will begin on or after the 27th day of September
1983

Road Right-of-Way known as the Dilly Shaw Tap Road and said pipeline
Right-of-Way being in that portion of said County Road Right-of-Way
that crosses the East corner of the Green Coleman Survey A-10, Brazos
County, Texas, and said pipeline Right-of-Way being more fully described
as entering County Right-of-Way at a point being N 44°07' E 2,226 feet
from the intersection of the Southwest line of the J F Martin Survey
A-34 and the Southeast margin of said County Road, THENCE N 1°50' E 12
feet to an angle point, THENCE N 34°05' E 21 feet to an angle point,
THENCE N 17 25' E 159 feet to an angle point, THENCE N 8°40' E 147 feet
to an angle point, THENCE N 12°10' E 200 feet to an angle point, THENCE
N 57°10' E 53 feet to an angle point, THENCE N 8°45' E 482 to an angle
point, THENCE N 49°30' E 12 feet to a point exiting County Right-of-Way
and said point being N 8°45' E 9 feet from the West corner of a 130 3
acre tract as conveyed to Floyd D Lynch from W P Holleman in Deed
Volume 380, Page 775 of Deed Records, Brazos County, Texas.
