SPECIAL MEETING
JANUARY 24 1983
A special meeting of the Commissioners Court of Brazos
County Texas was held in the Lecture Rehearsal Room of the
Brazos Center 3232 Briarcrest Drive Bryan Brazos County
Texas beginning at 10 00 A M on Monday January 24 1983
with the following members of the Court present

The first matter to come before the Court was the considera-
tion of Lease Agreements between Brazos County and Brazos Valley
Art League Brazos Valley Museum of Natural Science and the Arts
Council of Brazos Valley providing for utilization of space at
the Brazos Center On motion by Commissioner Cooley seconded by
Commissioner Beard the Court voted unanimously to authorize the
County Judge to enter into contract with each of the organizations
A copy of each Lease Agreement is attached hereto and made a part
of these minutes
On motion by Commissioner Cooley seconded by Commissioner
Beard the Court voted unanimously to appoint Commissioner Wilcox
as alternate member to the Board of Directors of Brazos Beautiful
Inc

On motion by Commissioner Wilcox, seconded by Commissioner
Beard the Court voted unanimously to authorize the County Judge
to enter into contract with the Retired Senior Volunteer Program
for Volunteer Services A copy of such contract is attached
The County Judge next laid before the Court a letter from
the Texas Justice Court Training Center acknowledging that Judge
Tom Lyons, Justice of Peace, Precinct 1 had successfully com-
pleted the required course in the duties of the office of Justice
of the Peace
The Court next considered a variance from the Salary Struc-
ture for the part-time employees, classified as Laborers at the
Brazos Center and Pavillion After much discussion and on motion
by Commissioner Cooley, seconded by Commissioner Beard the Court
voted unanimously to grant the variance and to authorize the Dir-
ector of the Brazos Center to have discretionary control over the

Salary Budget of the laboring force subject to approval by the
Commissioners Court through means of the Change of Status All
II permanent employees would remain classified as outlined in the

salary structure
The Court further considered the salaries of the employees
of the County Agent°s Office, Veterans Administrator and the Civil
Defense Office, who did not receive the 8 5% increase over their
1982 salaries On motion by Commissioner Beard, seconded by Com-
missioner Cooley the Court voted unanimously to allow the 8 5% in-
crease as budgeted
1 The Court next considered a request from the Bryan Industrial
Foundation for authorization to lay a railroad spur across the
i right-of-way of Mumford Road in Precinct 4 After discussion and
on motion by Commissioner Beard, seconded by Commissioner Turner
the Court voted unanimously to authorize the County Judge to mail
a letter of intent`to allow the spur'

The Court next discussed an Amendment to the Audit Agreement
with Martin, Slovacek and Thompson with no action being taken
The Court next considered a Resolution and Order for a con-
tract for the collection of Deliquent Taxes for Brazos County
Such contract to be between Brazos County and Gates Steen After
discussion and on motion by Commissioner Beard, seconded by Com-
missioner Wilcox the Court voted unanimously to adopt such Resolu-
tion A copy of which is attached hereto
The Court next considered bids for re-roofing the BLD Build-
ing on 24th Street Bids previously received and opened were as
follows
1 All American Enterprises, Inc 17,900
2 Coating Specialist - 15,695
(using an alternate material)
On recommendation by Jack Cumpton, Architect and motion by Com-
missioner Cooley, seconded by Commissioner Beard the Court voted
unanimously to award the Contract to All American Enterprises,Inc
it being the only bid that met specifications

The Court next discussed amendments to the subdivision re-
gulations, with no action to be taken until after a Public Hearing
to be held on February 14th at 9 00 A M at the Brazos Center
The Court next considered 2 requests from Ferguson Crossing
Pipeline Company as follows
1 Mumford Road in Precinct 4
2 crossings
2 Kurten Cemetery Road in Precinct 2
On motion by Commissioner Wilcox seconded by Commissioner Turner
the Court voted unanimously to approve the 2 crossings on Mumford
Road No action was taken on the right-of-way crossing on Kurten
Cemetery Road A copy of the crossing on Mumford Road is attached

The Court next discussed the following traffic restrictions
be placed on certain County Roads
1 Deer Run Road between FM 158 and Jones Road the
` traffic be limited to 30 miles per hour
2 Marino Road between Highway 21 East and Dilly
s Shaw Tap Road the traffic be limited to 45 miles
per hour
3 Dilly Shaw Tap Road, Marino Road and Mancuso
Road limited to NO through truck traffic for ve-
hicles in excess of 30,000 pounds gross vehicle
weight
On motion by Commissioner Beard, seconded by Commisssioner Wilcox
s the Court voted unanimously to approve the traffic limits as out-
lined
The Court next considered the resignation of W A Stasny from
the Board of Directors of the Brazos County Housing Finance Corpora-
tion On motion by Commissioner Beard seconded by Commissioner
Wilcox the Court voted unanimously to accept the resignation and to
appoint Milton Turner to fill the vacancy created by the resignation
On motion by Commissioner Beard, seconded by Commissioner Wilcox
the Court voted unanimously to authorize the County Judge to negoti-
ate for leasing space in the Lester Building

in the Commissioners Courtroom of the Courthouse, T ? z~

The Court reconvened at 1 30 P M in the Commissioners Court-
room of the Courthouse with all members present and retired into
closed executive session to discuss personnel
The meeting continued in open session at 2 30 P M
The Court next considered for payment the following claims
as submitted by the County Treasurer for payment
Road and Bridge Shop - Claims 20 through 23
Road and Bridge Precinct 1 - Claims 16 through 19
Road and Bridge Precinct 2 - Claims 21 through 34
Road and Bridge Precinct 3 - Claims 24 through 38
Road and Bridge Precinct 4 - Claims 11 through 16
On motion by Commissioner Wilcox, seconded by Commissioner Beard
the Court voted unanimously to approve the claims as submitted
Commissioner Cooley advised the Court of his desire to resign
from the Board of Directors of the Brazos Valley Development Council
The County Judge moved to accept the resignation and to appoint
Milton Turner to fill the vacancy The motion was duly seconded and
carried unanimously
Commissioner Cooley inquired about the possibility of the crea-
tion of an additional District Court in Brazos County and a Resolu-
tion from the Court in support of it No action was taken

RESOLUTION AND ORDER - v
On this the 24th day of January , 19 83 at a 10 00 A M
meeting of the Commissioners' Court of Brazos County, Texas, there
came on for consideration the making of a contract for the collection of
delinquent taxes, and motion was made by Billy Beard County
f
Commissioner of Precinct No 3 seconded by Walter Wilcox County
Commissioner of Precinct No -2 , that subject to approval by the State
Property Tax Board and Attorney General of Texas said Commissioners' Court in
behalf said County do make and enter into a contract with Gates Stem
a licensed attorney, for the latter to collect delihquent taxes in said County
for is % of the amount of taxes, penalty and interest collected, said
contract to end on the 31st day of December 6 19 84 , with six
months thereafter to complete pending suits, and to be on forms currently pro-
mulgated and recommended by the State Property Tax Board
Said motion being put to vote, it carried by a vote of 4 to 0 t

This agreement, made this the~day of
' 1983 by and between BRAZOS COUNTY, TEXAS, hereinaf er calls Lessor,
and ARTS COUNCIL OF BRAZOS VALLEY, hereinafter called Lessee is as
follows
Lessor, the Owner of the Brazos Center, a multi-use building
and the adjacent grounds has agreed and does hereby agree, to lease
and demise unto Lessee, a portion of the Brazos Center, hereinafter
> described upon the following terms and conditions

1 Lessee shall be entitled to the space to it by the Director
of the Center for a term of one year beginning January 1,
s 1983 and ending December 31, 1983, (A) The exclusively

used space allocated to Lessee is described in Attachment
"A" (B) Space as available which may be used includes

for
1 Monthly board meetings
2 One general meeting in a calendar year
3 The Annual Youth Art Show which requires one

week of use all concourse display cases, and
one week of use of East Concourse

2 (A)In consideration therefor, Lessee agrees to pay Lessor,

on the first day of each month during the term hereof, in
advance the sum of $75 00, representing the agreed monthly
r rental for the use of such space and other facilities as
herein set forth (B) In addition Lessee agrees to pay
to Lessor $5 00 per student per 6 week session for classes

held in the Brazos Center All other space, not herein
mentioned shall be rented to Lessee on first come first
,tH serve basis and at the regular rental rate (C) Lessee

Center copier This sum may be altered by agreement of

the Center Director and the Arts Council Director

LEASE AGREEMENT
This agreement, made this the ~V41yI. day of
1083, by and between BRAZOS COUNTY, TEXAS, hereinafter lled Les r,
itid BRAZOS VALLEY MUSEUM OF NATURAL SCIENCE, hereinafter called Lessee,
X, , as follows
Lessor the Owner of the Brazos Center, a multi-use building and
the adjacent grounds has agreed and does hereby agree, to lease and
devise unto Lessee a portion of the Brazos Center, hereinafter described
tipon the following terms and conditions
1,
Lessee shall be entitled to the space allocated to it by the
Director of the Center for a term beginning January 1, 1983
and ending, on December 31 1983 The space allocated is de-
scribed in Attachment "A" hereto, which has been signed by the
Director of Lessee and the Judge of the Brazos County Com-
missioner's Court Lessor agrees to provide space designated
in Attachment "A" for Lessee's use during the term of this
agreement

In consideration therefor, Lessee agrees to pay to Lessor,
on the first day of each month beginning quarterly periods
(January, April July October) $250 in advance for the three
month period to follow

Lessor shall furnish all utilities, including gas, water and
electricity
4
Lessee will pay the regular User fees for space used by it,
other than space allocated to it under this agreement
5
Lessor does not Provide and will not provide furnishings,
custodial care or maintenance of the space allocated to Lessee
under this agreement
6
Lessee will be responsible for having an individual and/or an
automatic answering device to answer the telephone during the
announced business or visiting hours
7
In addition to the quarterly rental, Lessee agrees to pay the
lessor the following
A a single copy price of 5 cents each for all copies,
made on the Brazos Center copier
B two dollars ($2) per camper per week for day camp sessions
8
Lessee agrees that it will be open on Saturdays and Sundays
at hours agreed to by the Center Director and Lessee, and if
specifically requested, will serve as the Center authority on
those days
9
Lessee shall take good care of the space allocated to it,reason-
able wear and tear only excepted, and shall surrender the premises
at the termination of this agreement if Lessee fails to meet ;
obligations delineated in this contract

Lessee agrees to have a minimum of four different exhibits
annually displayed in the case allocated for Lessee's ex-

Lessee is granted perri%sion to s^ 1 merchandise on the pre-
miser provided that merchandise is secondarv to the prin-

cipa_ objective of Lessee's occipancv of the premises

Lessee may, after clearing dates with the Center scheduler

use space entitled Classroom AB for temporary purposes
In addition other space for educational purnoseq only for
up tcrthree times annually at no additional charge providing,
they are not funds-raising events Use of such space is on
a first-received request basis All other space used other
than that herein defined will require fees normallt charged,

ZOS VALLEY ART LEAGUE hereinafter called Lessee is as follows

ssor the Owner of the Brazos Center, a multi-use building and
the adj
acent grounds has agreed and does hereby agree, to lease and
demise
unto Lessee a portion of the Brazos Center, hereinafter des-
cribed,
upon the following terms and conditions

Lessee shall be entitled to the space allocated to it by
the Director of the Center for a term beginning January 1,
1983 and ending December 31, 1983 The space allocated
to Lessee is described in Attachment "A" hereto, which has
been signed by the Director of Lessee and the Director of

the Center

E A In consideration therefor, Lessee agrees to pay the
Lessee, on the first day of each calendar month during the
term hereof, in advance, the sum of $50 00 representing
the agreed monthly rental for the use of such space as here-
in set forth
B In addition Lessee has permission to use concourse space,
it
as scheduled with (and convenient to more extensive uses of)
the Brazos Center for two art shows per year namely the an-
nually held Juried Art Show and the annually held Youth Art
Show Other space used in conjunction with either show sh4ql;
require satisfactory payment for that additional space

Lessor shall furnish all utilities, including gas, water, and
electricity

Lessee will pay the regular User fees for space used by it,
other than space allocated to it under this agreement

Lessor does not provide and will not provide furnishings,
custodial care, or maintenance of the space allocated to
Lessee under this agreement
6
Lessee shall take good care of the space allocated to it,
reasonable wear and tear only excepted, and shall surrendver
the premises at the termination of this agreement
7
Lessee agrees that no improvements to or alterations to the
space shall be made without the consent of Lessor in writing
8
Risk or loss of all property owned by Lessee shall remain with
Lessee, it being understood that Lessor will maintain no in-
surance on such property Any insurance desired by Lessee on
Lessee's property shall be purchased by Lessee at its expense

9 Lessor shall not be liable to Lessee or the Lessee s S

employees for any damage to person or property caused
by the negligent act of Lessor, its agents, servants, or
employees or due to the act of any other tenant in the
building, or due to any defect or want of repair in any
part of the building of which the allocated space forms
a part
10 Lessee agrees to hold Lessor harmless from any and all
claims damages, expenses including attorney's fees,
growing out of or arising from any negligent act on the
part of Lessee, its agents servants or employees
11 No sign shall be placed at on or about the premises by
Lessee except with the approval of the Center Director°in
writing

Formal notice is hereby given that FER (USON CROSSING PIPE LINE Applicant,
proposes to place a 4" Natural GAR PtPplino within the right-of-way
of Mumford Road in Brazos County, Texas as follows
The location or description of the proposed installation is more fully

1 The Commissioner of the Precinct in which the right-of-way lies
must be notified prior to the beginning of construction in order
that the Commissioner might be on hand to designate the actual '
location of the installation
2 That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the Commissioner
