REGULAR MEETING
APRIL 12, 1982
A regular meeting of the Commissioners' Court of Brazos
County, Texas, was held in the Commissioners' Courtroom in
the Courthouse in Bryan, Brazos County, Texas, beginning at
10:00 A.M. on Monday, April 12, 1982 with the following
members of the Court present:
R. J. Holmgreen, County Judge, presiding:
Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;

i On motion by Commissioner Beard, seconded by Commissioner

Stasny the Court voted unanimously to approve the minutes of the
f
meetings held January 11, 1982, January 25, 1982, February 8, 1982,
February 122, 1982 and March 8, 1982 as presented and without change.
i
The next matter to come before the Court was the appointment
of a member to the Board of Trustees of the Mental Health Mental
Retardation to fill the vacancy created by the resignation of
W. R. Vance. On motion by Commissioner Stasny, seconded by the
County Judge the Court voted unanimously to appoint Candis Leslie
to the Board of the Mental Health Mental Retardation for a 2 year
term, beginning May 1, 1982 and ending April 31, 1984.
The County Judge next laid before the Court a letter from
the Texas Justice Court Training Center certifying that the Jus-
tice of the Peace Precinct 4, Place 2, Precinct 7, Place 2 and
Precinct 3 had completed a twenty hour course in the responsibil-
ties of the office of Justice of the Peace as required by Statute
and ordered same entered into the minutes of the Court.
The Court next considered the adoption of Resolutions and
submission of applications to the Criminal Justice Division for
Grant Funds as follows:
1. The District Attorney's Office requesting funding
for the establishment of a Rape Crisis Center for
Brazos County.
2. The District Attorney's Office requesting funding
for the fifth and final year of the grant for the
Assistant District Attorney.
3. The Sheriff requesting funding for indentification
equipment for the Sheriff's Department. This grant
to be a one time grant with 75% Criminal Justice
funds, 25% local matching funds.
4. Ernie Wentrcek, Chief Juvenile Probation Officer,
requested funds for second year funding of the
Community Resources Officer's grant in the amount
of $28,700; $23,180 to be Criminal Justice Funds
and $5,520 to be local funds.
5. Ernie Wentrcek, Chief Juvenile Probation Officer,
requested funds for third year funding for the
purchase of Juvenile Services Grant in the amount
of $10,000, all of which would be Criminal Justice
Funds.
After having all of the Grant Applications explained Comm-
issioner Cooley moved to adopt Resolutions for the above mentioned
Grants and to authorize the County Judge to submit the applications
on behalf of Brazos County. The motion was seconded by Commissioner
Beard and carried unanimously. A copy of all Resolutions are attach-
ed hereto.

Wilcox the Court voted unanimously to approve Budget Amendment
Number 11 for Building and Yards Department.
Next to be considered were the following Notice's of Proposed
Installation In County-Right-Of Way:
1. Ferguson Crossing Pipeline proposed to install an
8 inch (8") Natural Gas Pipeline across Carrabba
Road and Old Reliance Road in Precinct 3. On
motion by Commissioner Beard, seconded by Comm-
Stasny the Court voted unanimously to approve both
applications as submitted and to authorize the in-
stallation. A copy of each proposal is attached
hereto.

2. The City of College Station proposed to install a
Sanitary Sewer Line in the right-of-way of Foxfire
Drive in Precinct 1, On motion by Commissioner
Cooley, seconded by Commissioner Beard the Court
voted unanimously to approve the application and
to authorize the installation. A copy of such
proposal is attached hereto.

Cooley the Court voted unanimously to authorize the advertisement
for the lease/purchase or purchase up to three mowers for various
Road and Bridge Precincts and for Precinct 2 to purchase a pick-up
truck.

The County Judge announced the meeting to be closed Executive
Session at 10:35 to discuss real estate.
The meeting was opened at 11:00 a.m. when the County Judge`
announced the Executive Session completed and the meeting was ad-
journed.

RESOLUTION
WHEREAS, the Governor's Office of General Counsel and Criminal
Justice has indicated, through the Brazos Valley Development Council,
the avai'ability of grant funds to assist units of local government
strengthen law enforcement in their respective communities; and
WHEREAS, amoung the areas eligible for assistance is law enforcement
communications equipment provided the unit of local government pays
25 percent of the cost; and
WHEREAS, Brazos County has a need for identification equipment and
in order to improve operations and security for the Sheriff's
Department;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF BRAZOS
COUNTY, TEXAS, MEETING IN REGULAR SESSION THAT:
1. The County Judge be authorized to make application on behalf of
Brazos County to the Governor's Office of General Counsel
and Criminal Justice for grant funds to assist in the purchase
of identification equipment.
2. Brazos County agrees to pay 25 percent of the cost of the
identification equipment.
3. Should a grant be tendered in response to said application the
County Judge be authorized to receive same on behalf of Brazos
County.

of services for Juvenile Probation Departments; and
WHEREAS, Brazos County has a need for funding for the continued
purchasing of juvenile services in order to locate contract
placements for some "hard-to-place" children;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONER'S COURT OF
BRAZOS COUNTY, TEXAS, MEETING IN REGULAR SESSION THAT:
1. The County Judge be authorized to make application on
behalf of Brazos County to the Governor's Office of
General Counsel and Criminal Justice for grant funds
to assist in the purchase of juvenile services.
2. Should a grant be tendered in response to said applica-
tion the County Judge be authorized to receive same on
behalf of Brazos County.

RESOLUTION
WHEREAS, the Governor's Office of General Counsel and Criminal
Justice has indicated, through the Brazos Valley Development
Council, the availability of grant funds to assist units of
local government strengthen law enforcement in their respective

the continued functioning of a personnel position within juve-
nile probation services provided the unit of local government
pays twenty per cent (20%) for second year funding; and
WHEREAS, Brazos County has a need for a personnel position in-
tended to function as a Community Resources Officer for the
Juvenile Probation Department in order to improve the volunteer
program and contract placement services;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONER'S COURT OF
BRAZOS COUNTY, TEXAS, MEETING IN REGULAR SESSION THAT:
1. The County Judge be authorized to make application
on behalf of Brazos County to the Governor's Office
of General Counsel and Criminal Justice for grant
funds to assist in the continued functioning of the
position entitled - "Community Resources Officer".
2. Brazos County agrees to pay 20 per cent of the second
year funding.
3. Should a grant be tendered in response to said appli-
cation the County Judge be authorized to receive same
on behalf of Brazos County.

A RESOLUTION AUTHORIZING
APPLICATION FOR GRANT TO SUF.ORT
BRAZOS COUNTY RAPE CRISIS CENTER
WHEREAS, the Criminal Justice Division, Office of the Governor,
has indicted, that metropolitan areas of population over 50,000 should
have a rape crisis center and has thereby supported such; and
WHEREAS, among the several programs included in The 1981 Criminal
Justice Plan for Texas is one which continues to provide for personal
augmentations to the implementation of rape crisis centers; and
WHEREAS, due to the low rate of reported rapes and there presently
being no assistance offered to rape victims in Brazos County;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF
BRAZOS COUNTY, TEXAS, at its meeting on the 12th day of April, 1982,
that:
1. The County Judge is authorized to make application on behalf
of Brazos County to the Criminal Justice Division for grant
funds to provide for the augmentation for the establishment of
a Rape Crisis Center in Brazos County.
2. That the County Judge is authorized to accept on behalf of
Brazos County such grant funds as may be tendered by the
Criminal Justice Division.
3. This Resolution becomes effective upon adoption and its
recording in the Minutes of the Commissioners Court is ordered.

A RESOLUTION AUTHORIZING
APPLICATION FOR GRANT TO SUPPORT
AUGMENTATION TO DISTRICT ATTORNEY'S STAFF
WHEREAS, the Criminal Justice Division, Office of the
Governor, has assisted Brazos County in its effort to cope with
crime by supporting the augmentation of the District Attorney's
office with an assistant prosecutor and secretary; and `
WHEREAS, among the several programs included in The 1981
Criminal Justice Plan for Texas is one which continues to provide
for personal augmentation to prosecutor's btaffs in Texas; and
WHEREAS, the Speedy Trial Act, enacted by the 65th Legislature
and which became effective on July 1, 1978, and the establishment
of a second district court in Brazos County has resulted in an
increased workload for the District Attorney necessitating the
continued personnel augmentation of his staff;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF
BRAZOS COUNTY, TEXAS, at its meeting on the 12th day of April,
1982, that:
1. The County Judge is authorized to make application
on behalf of Brazos County to the Criminal Justice
Division for grant funds to provide for the con-
tinued augmentation for the District Attorney's
Office.
2. That the County Judge is authorized to accept on
behalf of Brazos County such grant funds as may be
tendered by the Criminal Justice Division.

I understand and agree that:
f 1. The Commissioner of the Precinct in which the right-of-way lies must be notified
prior to the beginning of construction in order that the Commissioner might be on
hand to designate the actual location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to their original
condition to the satisfaction of the Commissioner in which the roadway or right-of-way
lies.
3. That Brazos County reserves the right to require Applicant to relocate or lower any
such line at no cost to Brazos County, should same become necessary due to widening
or lowering, or other alteration of the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage that might occur to
any existing utility lines in the right-of-way.

of Old Reliance Road in Brazos County, Texas as follows:
The location or description of the proposed installation is more fully
shown by three (3) copies of the drawings attached to this notice.
I understand and agree that:
1. The Commissioner of the Precinct in which the right-of-way lies
must be notified prior to the beginning of construction in order
that the Commissioner might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired
to their original condition to the satisfaction of the Commissioner
in which the roadway or right-of-way lies.
3. That BRAZOS COUNTY reserves the right to require Applicant to re-
locate or lower any such line at no cost to BRAZOS COUNTY, should
same become necessary due to widening or lowering, or other alter-
ation of the roadway or right-of-way.

4. That BRAZOS COUNTY is in no way responsible for any damage that
might occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the county right-
of-way in accordance with governing laws.

6. That the line or lines will be constructed no less than forty-eight
inches (48") lower than the lowest part of the drainage or bar ditch
and the drainage is to be considered at least two feet (21) below
the center of the roadway.
7. That all roads be bored to forty feet (40') on either side of the
right-of-way or case! for such distance.
8. That all sites will be barracaded during the construction period.
