HomeMy WebLinkAbout1982-02-22-1000AM-RegularY'J COMMISSIONERS' COURT REGULAR MEETING FEBRUARY ',22 , 1982 A regular meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Monday, February 22, 1982, with the following members of the Court present: R. J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox,. Commissioner of Precinct 2; Billy Beard, Commissioner of Precinct 3; W. A. Stasny, Commissioner.of Precinct 4; Frank Boriskie, County Clerk The following citizens and officials were in attendance; Jim Thompson KBTX-TV Betty Miller Candidate for Commissioner Pct.4 Kathi Beasley KBTX-TV Howard E. Elkins County Treasurer Jann Snell Eagle Buddy Winn Tax Assessor Collector Tammy Pardi KAGC Barbi Tomlin WTAW The first matter to come before the Court was the radio tower for the Volunteer Fire Departments. The County Judge advised the Court that location on the City of Bryan tower was unsatisfactory due to constant interferance with the NOAA Radio Station, College Station Police Department and the ABM Physical Plant. Tom Payne and 0. L. Pate representing the Volunteer Fire Department requested the Courts assistance in moving the tower to another location.. After discussion Commissioner Beard moved to fund the relocation of the tower at a cost not to exceed $6,000 with monies to be paid vot:~~Crl~g, t I J. . i s , 4.; I out of the Fire Protection Budget. The motion was seconded by i Commissioner Cooley and carried unanimously. The Court next considered Budget amendments to the Road and i Bridge Precinct Budgets. These amendments representing unspent funds of the Precinct 1981 budgets. After discussion and on mo- t i tion by Commissioner Stasny, seconded by Commissioner Beard the Court voted unanimously to approve the following budget amendments: Precinct 1 increase of $12,223.00 Precinct 2 increase of 3,272.00 Precinct 3 increase of 23,296.00 Precinct 4 increase of 28,306.00 A copy of such amendment is attached to and made a part of these minutes. } It was the consensus of the Court that the Court meet in ' special session at 1:30 P.M. on Friday, February 26, 1982 for the purpose of considering a Resolution establishing the total miles of road maintained by Brazos County and any other emergency matt- ers to come before the Court. i l Mr. Arthur Yeager Chairman of the County Building Program of the County Agriculture Extension Service invited the Court to a public meeting on the Fire Ant Program and requested the adoption i of a Resolution supporting the fire ant program in Brazos County. On motion by Commissioner Beard, seconded by Commissioner Wilcox I the Court voted unanimously to adopt the Resolution, a copy of which is attached to and made a part of these minutes. I The Court having previously received and opened bids for a 25-ton lowbed semi-trailer for Precinct 3 proceeded to the award 1 of the bid. On recommendation and motion by Commissioner Beard, seconded by Commissioner Stasny, the Court voted unanimously to accept the low bid of Twin City International Inc. in the amount i. of $10,267 for a Nuttall model 225E. The County Judge laid before the Court an order creating a i V0 PAGE _2 4LI- i I ' a ,I r 1. jC ,e _V f Joint City/City/County/County Airport Zoning Board to be known as the EASTERWOOD FIELD JOINT AIRPORT ZONING BOARD. Such Board to consist of nine members, two (2) each to be appointed by the Cities of Bryan and College Station, Counties of Brazos and t Burleson. The ninth member to serve as Chairman. After discuss- ion and on motion by Commissioner Stasny, seconded by Commissioner Cooley the Court voted unanimously to adopt the Order creating the EASTERWOOD FIELD JOINT AIRPORT ZONING BOARD and to appoint T Harry E. Raisor and Bill J. Cooley as the members for Brazos County. The Court next considered the following Plats: 1. Preliminary Plat of BRUSHY PARK in Precinct 4. After discussion and on motion by Commissioner Cooley, seconded by Commissioner Stasny the Court voted to approve the Plat. 2. Road Dedication Plat in Precinct 1 was discussed, however Commissioner Cooley requested that no official action be taken. Next-to be considered were Request to Utilize County Rights- Of- Way as follows: 1. Ferguson Crossing submitted their request to utilize the following rights-of-way and their draft in the amount of $2,269.75 representing $500 per crossing for 3 crossings and $25.00 per rod for paralleling the roadway: (a) Boatcallie Road in Pct.2 - $1,269.75 (b) Marino Road in Pct. 2 - 500.00 (c) Dilly Shaw Tap Road in Pct.2--500.00 (d) Tonkaway Lake Rd.in Pct.3 - 500.00 to be submitted. 2. Producers Gas Company submitted their request to utilize the following rights-of-way. F (a) Greens Praire Trail in Precinct 1 (b) Greens Prairie Road in Precinct 1 (c) Royder Road in Precinct 1 (d) I & GN Road in Precinct 1 (e) Straub Road in Precinct 1 On.motion by Commissioner Beard, seconded by Commissioner Cooley the Court voted unanimously to approve all requests and to aut- horize the installation. Harris Treasurer's Office Sam Allen Brazos Center Lonnie Mims Precinct 4 Donna Jean Bishop Tax Office The Court next considered the following claims submitted by the County Treasurer for payment: General Fund Claims 467 through 591 Law Library Claims 4 through 6 Revenue Sharing Claims 6 through 10 Shop Claims 34 through 44 Precinct 1 Claims 27 through 41 Precinct 2 Claims 32 through 42 Precinct 3 Claims 37 through 49 excepting 45 Precinct 4 Claims 22 through 30 On motion by Commissioner Stasny, seconded by Commissioner Cooley the Court voted unanimously to pay the claims as submitted. The Court retired to closed executive session at 10:45 A.M. for the purpose of discussing legal matters. The Court returned to open session at 11:20 A.M. with Commissioner Cooley making a motion to authorize the County's legal council to represent the defendents involved in the suit filed in Federal District Court in Galveston styled James Charles Manuel vs. W. D. Burley et al. The motion was seconded by Commissioner Beard and carried unanimously. There being no further business the Court adjourned. WHEREAS, Brazos County acknowledges that the imported fire yq ant has become an increasing problem in Brazos County to both 1 rural and urban residents causing damage to farm machinery and painful stings to individuals. NOW THEREFORE, BE IT RESOLVED by the Brazos County Commissioners' Court of Brazos County, Texas that the Court gives their support to a fire ant control program based on the ability of county landowners to raise suitable matching funds for a control pro- gram. ADOPTED THIS THE 22nd day of February, 1932. ATTEST: R. / Ho mgreen, County u ge ' Fran Boris ie County Clerk e , A SUGGESTED ORDER TO SE,PASSED BY THE COMMISSIONER'S COURT IN CREATING A JOINT CITY;CIT71., COUNTY/COUNTY AIRPQRT ZONING BOARD: i 1 O R D E R On this the 22nd. day of February , 19_82 , came on to be considered by the Corn- missioners' Court o` Brazos County, Texas at a regular term of such Court, the matter' of the creation,of a joint airport zoning board to exercise the power authorized such boards j-, the provisions of Chapter 391 of the Acts of the Regular Session of the 50th Legislature, , 147, to adopt, administer, and enforce airport zoning regulations applicable to airport hazard areas in this county and it appearing to the Court that on the th day of 19 the City Council of the City of College Station Texas did enact itF url`nana ccreatinn such d joint airport zoning boa,,.., to 6e k-own as the j Easterwood Field Joint Airport Zoning Board, and on the th day of 19 the City Council of the City i of Bryan -mid enact its ordinance creating such a joint airport zoning board, to be known as the Easterwood Field Joint Airport Zoning Board, and these ordinances were expressly made subject, for their effective- ness, to a like provision being made by the respective Commissioners' Courts of Brazos County, Texas, and Burleson County, Texas, and it further ' appearing to the Court that the creation of such a joint airport zoning board is in the public interest of this county: IT IS ACCORDINGLY ORDERED, AND there is hereby created the Easterwood Field ! Joint Airport Zoning Board which Board shall+ have the powers and exercise the duties set forth in Section 2 and 3 of Chapter 391 of the Acts of the Regular Session of the 50th Legislature, 1947. IT IS FURTHER ORDERED, that the Easterwood Field Joint Airport Zoning Board shall be composes of nine (9} mem- bers, two k2, to be appojnted by the City Council of the City of College Station Texas, '4wo (2) to be appointed by the City Counci of the City of Bryan , Texas, two (2) to be appointed by the Commissioners' Court of Burleson County, Texas, and two (2) to be appointed by this Commissioners' Court. The ninth member shall ;,be elected by a majority of the members so appointed and said ninth member shall serve as Chairman of the Said Easterwood Field .;;Joint Airport Zoning Board.
