REGULAR MEETING
OCTOBER 12, 1981
A regular meeting of the Commissioners' Court of Brazos
County, Texas, was held in the Commissioners' Courtroom in
the Courthouse in Bryan,rBrazos County, Texas, beginning at
10:00 A.M. on Monday, October 12, 1981, with the following
members of the Court present:
R. J. Holmgreen, County Judge, presiding:
Bill J. Cooley, Commissioner of Precinct 1;
Billy E. Beard, Commissioner of Precinct 3;
W. A. Stasny, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.

The Court next considered payment of two statements from
the City of College Station for fire calls for the months of
' August and September, 1981. On motion made by Commissioner
Cooley, seconded by Commissioner Stasny, the Court unanimously
voted to pay the statements totaling $689.62.
The Court next considered the application from Gulf Oil
Company to place a gas pipe line within the right-of-way of
Old Reliance Road, two miles west of FM 2038 in Precinct 3.
On motion made by Commissioner Beard, seconded by Commissioner
Stasny, the Court unanimously voted to approve the application.
A copy of the application is attached hereto and made a part of
these minutes.
The Court next considered the Application for Soil Conservation
Work from Mr. Lee Gardner in Precinct 2. The applicant asked that
drainage work be done to direct water off of property located
north of Hadspeth Rd., 2 miles east of FM 2776. On motion made
by Commissioner Stasny, seconded by Commissioner Beard, the Court
unanimously voted to approve the application.
The Court next considered the oil and gas leases submitted
as follows:
1. North Central Oil Corporation
a. Brazos Center - (50 acres) $300.00 per acre bonus,
3 year lease, 1/4 royalty, delay rentals to be
$25.00 per acre per year.
b. Boonville Cemetery - (11.29 acres) $300.00 per acre
bonus, 3 year lease, 1/4 royalty, delay rentals to
be $25.00 per acre per year.
2. Lyons Petroleum
a. Brazos Center - $350.00 per acre bonus, 24% royalty,
$10.00 per acre delay rental, $17,500 total bonus,
$500.00 annual rental, 3 year term.
b. Boonville Cemetery - $350.00 per acre bonus, 247.
royalty, $10.00 per acre delay rental, $3,951.50
total bonus, $112.90 annual rental, 3 year term.

It was the consensus of the Court that the bids be analyzed by

lease, 20% royalty, $10.00 per acre-delay rental,

2 year lease, 20% royalty, $10.00 per acre delay
rental, either "drilling" or "non-drilling."

Gas Co. to place a 6" O.D. natural gas pipeline within the County
right-of-way of Bird Pond Road in Precinct 3. On motion made by
Commissioner Cooley, seconded by Commissioner Beard, the Court
unanimously voted to approve the application. A copy of the
application is attached hereto and made a part of these minutes.
The Court next considered the application from R. B. Butler,
Inc. for Gulf Oil Exploration and Production Co. to place a 2"
gas pipeline within the County right-of-way of Old Reliance Road
approximately 1.4 miles west of FM Hwy. 2038 in Precinct 3. On
motion made by Commissioner Beard, seconded by Commissioner Stasny,
the Court unanimously voted to approve the application. A copy of
the application is attached hereto and made a part of these minutes.
The Court next considered the application from R. B. Butler,
Inc. for Gulf Oil Exploration and Production Co. to place a 6"
gas pipeline in the County right-of-way of Forsthoff Road
approximately 0.5 mile east of FM Hwy. 2038 in Precinct 3. On
motion made by Commissioner Beard, seconded by Commissioner Stasny,
the Court unanimously voted to approve the application. A copy of
the application is attached hereto and made a part of these minutes.
On motion made by Commissioner Stasny, seconded by Commissioner
Cooley, the Court unanimously approved Requests for Change in
Status of Employees as follows:

copies of the drawings attached to this notice.
I understand and agree that:
1. The Commissioner of the Precinct in which the right-of-way lies must be notified
prior to the beginning of construction in order that the Commissioner might be on
hand to designate the actual location of the installation.
2. That all damage to the roadways and rights-of-wav will be repaired to their original
condition to the satisfaction of the Commissioner in which the roadway or right-of-way
lies.
3. That Brazos County reserves the right to require Applicant to relocate or lower any
• such line at no cost to Brazos County, should same becom[• necessary due to widening
or lowering. or other alteration of the roadway or ri)•,M -of-way.
4. That Brazos County will in no way be responsibl[' for .arv damage that might occur to
any existing utility lines in the right-of-way'
5. That the line will be constructed and maintained on th, .ounty~right-of-way in accor-
dance with governing laws. •
6. That the line or lines will be constructed no less than forty-eight inches (48")
lower than the lowest part of the drainage or bar ditch and the drainage is to be
considered at least two feet (2') below the center of the roadway.

or cased for such distance.
8. That all sites will be barracaded [luring the construction period.
Construction of this line will begin on or after the 12 day of October 19 81

I understand and agree teat:
1. The Gcmaissioner of the Precinct in which the right-of-way lies must be notified
prior to the beginning of construction in order that the Commissioner might be on
' hand to designate the actual location of the installation.
2. That all damage to the roadways and rights-of-way will be repaired to their original
condition to the satisfaction of the Commissioner in which the roadway or right-o:-way
lies.
3. That Brazos County reserves the right to require Arplicant to relocate or lower any
• such line at no cost to Brazos County, should same become necessary due to widening
or lowering. or other alteration of the roadway cr right-of-way.
4. That Brazos County will in no way be responsible for any e.=age that m:fltt occur tc
any existing utility lines in the right-of-way.

dance with governing laws.
