Z` COMMISSIONERS' COURT I i i I I` i SPECIAL MEETING MAY 26, 1981 A special meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in ' the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M. on Tuesday, May 26, 1981, with the following members of the Court present: R. J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Billy E. Beard, Commissioner of Precinct 3; W. A. Stasny, Commissioner of Precinct 4; Frank Boriskie, County Clerk. „r The following citizens and officials were in attendance: Richard Fronterhouse Constable, Precinct 4 Joe Mauch, Jr. Ferguson Crossing Pipeline Co. Jerry Maze KAMU Peter Collins KAMU Jann Snell The Eagle Mary Nichols Auditor Arnold Dittfurth Assistant Auditor Van Kinerd Assistant Auditor Pat Edmondson WTAW Bobby H. Badger Sperry-Univac Jeff Rouse KAGC i The Court first considered fire calls for the month of April, 1981, from the City of College Station in the amount of $203.49. On motion by Commissioner Wilcox, seconded by Commissioner Beard, the Court unanimously voted to pay the City of College Station in the amount of $203.49. On motion by Commissioner Beard, seconded by Commissioner Stasny, the Court unanimously authorized the Commissioner of Precinct 2 to purchase the used tractor trailer truck from 5 International Harvestor in the amount of $9,500.00. The Court next considered the purchase and payment of culverts for Precinct 1 and Precinct 3. On motion by Commis- sioner Wilcox, seconded by Commissioner Stasny, the Court voted 4 ii VOL-C.PAOI • COMMISSIONERS' COURT MEETING - MAY 26, 1981 CONTINUED unanimously to allow Precinct 1 and Precinct 3 to purchase and pay for the culverts needed. On motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court unanimously voted to authorize the Auditor to sell the L-8000 computer and accessories. On motion by Commissioner Stasny, seconded by Commissioner Wilcox, the Court unanimously approved authorization for Ferguson Crossing Pipeline Company to install a pipeline within the right-of-way of Britten Road in Precinct 4. A copy of the application is attached to and made a part of these minutes. On motion by Commissioner Stasny, seconded by Commissioner Cooley, the Court unanimously approved authorization for Calvin Schehin to install a 3/4" water line in the right-of- way of Welcome Lane in Precinct 4. A copy of the application is attached to and made a part of these minutes. On motion by Commissioner Beard, seconded by Commissioner Stasny, the Court unanimously approved authorization for Producers Gas Company to install a natural gas pipeline in the right-of-way of Elmo Weeden Road in Precinct 3. A copy of the application is attached to and made a part of these minutes. The Court next considered budget amendments to the 1981 Budget to provide funds for the Constables to attend conferences and for radio equipment. On motion by Commissioner Beard, seconded by Commissioner Cooley, the Court unanimously voted to amend the 1981 Budget in the amount of $750.00 for conferences and $82.00 for radio equipment. A copy of such amendments is attached to and made a part of these minutes. Nixon Sheriff's office Sandra Sandoval Tax office ' The Court proceeded to consider the following Claims submitted by the County Auditor for payment: General Fund Claims 1620 through 1722 Precinct 1 Claims 111 through 114 Precinct 2 Claims 112 through 118 Precinct 3 Claims 102 through 111 Precinct 4 Claims 79 through 85 County Shop Claims 101 through 108 On motion by Commissioner Cooley, seconded by Commissioner Wilcox, the Court unanimously voted to pay the claims as submitted. The Court next considered payment of the statement from Moody's Investment Services, Inc. for rating services in the amount of $2,000.00. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court unani- mously voted to pay the statement in the amount of $2,000.00. On motion by Commissioner Wilcox, seconded by Commissioner Beard, the Court unanimously voted to authorize Precinct 1 to advertise for bids for the purchase of crushed rock. The Court then recessed until 1:00 P.M. 1:00 P.M. The Court reconvened at 1:30 P.M. and Commissioner Beard moved to authorize Precinct 1 and Precinct 3 to advertise for bids for the purchase of road oil. Motion was seconded by Commissioner Stasny and carried unanimously. , The Court then recessed until Thursday, May 28, 1981 at 10:00 A.M. , jj©a_LpAc;F ! It was the consensus of the Court that the Consultant negotiate with Sperry-Univac to determine if they can come closer to what the over all needs are and return to the Court. , I j~ Commissioner Cooley requests authorization to purchase a truck on an emergency basis on the open market. Commissioner ' Beard moved that due to the time involved in following the r bid process and this being the busiest time of year for the Commissioners that the Court declare an emergency and allow ~ S ' Commissioner Cooley to purchase a truck on the open market. Motion was seconded by Commissioner Cooley and carried unani- mously. There being no further business to come before the Court, x the meeting was adjourned. ~a t~ 1 NOTICE OF PROPOSED INSTALLATION IN COUNTY RIGHT-OF-WAY To the Commissioners' Court of Brazos County, Texas Brazos County Courthouse Bryan, Texas Formal notice is hereby given that FERGUSON CROSSING PIPE LINE COMPANY , Applicant, proposes to place a pipeline and road crossing within the right-of- way of Precinct 4 - Britten Road in Brazos County, Texas as follows: THE location or description or the proposed installation is more fully shown by 3 copies of the drawings attached to this notice: I understand and agree that: 1. The Commissioner of the Precinct in which the right-of-way lies must be notified prior to the beginning of construction in order that the Commissioner might be on hand to designate the actual location of the installation. 2. That all damage to the roadway and right-of-way will be repaired to their original condition to the satisfaction of the Commissioner in which the roadway or right-of-way lies. 3. That Brazos County reserves the right to require FERGUSON CROSSING PIPE LINE COMPANY , Applicant, to relocate or lower any such line at no cost to Brazos County, should same become necessary due to widening or lowering, or other alteration of the roadway or right- of-way. 4. That Brazos County will in no way be responsible for any damage that might occur to any existing utility lines in the right-of-way. 5. That the line will be constructed and maintained on the county right- of-way in accordance with governing laws. 6. That the line or lines will be constructed no less than forty-eight inches (48") lower than the lowest part of the drainage or bar ditch and the drainage is to be considered at least two feet (2') below the center of the roadway. 7.
