The Court next considered a request from the District Attorney to hire an Investigator for that office On motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court unanimously voted to hire an Investigator and to amend the 1981 Budget accordingly The Court next heard requests from the following officials and department heads for salary increases for 1981 1. Bobby Yeager, Sheriff, requested the salaries for Jailer IV be increased to $12,000, Jailer II to $13,000, Jailer II to $14,000, Jailer I to $15,000 and to hire a Jail Administrator at a salary of $16,920 2. Bill Elkins, County Treasurer, requested the salary of the 1st Assistant be increased to $20,800, the salary of the two 2nd Assistants be increased to $12,500 each, and the Bookkeeper be increased to $4 50 per hour 3. Gerald L. Winn, Tax Assessor-Collector, requested the salary of the Head Bookkeeper be increased to $15,000, and consider increasing the car allowance of the Appraisers in his office. After hearing the requests it was the consensus of the Court to delay action on these requests and the setting of salaries pending further discussion in executive session. The Court next considered a request from the owners of Valley Ridge to vacate the Plat of VALLEY RIDGE, PHASE II in Precinct 1 as recorded in Volume 410, Page 609, Deed Recrods, After discussion and on motion by Commissioner Cooley, seconded by Commissioner Beard, the Court voted unanimously to grant the request and to vacate plat On motion by Commissioner Cooley, seconded by Commissioner Stasny, the Court unanimously voted to set the rate of out-of- county travel at $ 21 per mile dOd,,.~ -PAGE _'71 I Y t I I 1 . I A .'Am- 1 • '1 COMMISSIONERS' COURT MEETING - JANUARY 12, 1981 CONTINUED • VQLkPAGE_ 7/ Commissioner Cooley stated that he felt the County's policy for reimbursement for out-of-county trips should be studied to see if a better method could be utilized, suggest- ing the per dieum method be looked into. It was the consen- sus of the Court that Commissioners Cooley and Wilcox inves- tigate the matter further. The Court having received from the District Clerk the names of all persons serving on the Grand Jury during the past twelve months proceeded to draw names for the Salary Grievance Committee for 1981 as follows- 1. Martha Burns 4. Richard Robser, Alternate 2, Gary Keese 5. Peggy Owens, Alternate 3. Dorothy Hernandez On motion by Commissioner Wilcox, seconded by Commis-' sioner Cooley, the Court unanimously voted to set the follow- ing Holidays for 1981-82: 1. Memorial Day - May 25, 1981 2. Labor Day - September 7, 1981 3. Thanksgiving - November 26 & 27, 1981 4. Christmas - December 24 & 25, 1981 5. New Years Day - January 1, 1982 The Court proceeded to the approval of bonds for those Officials elected in the 1980 November election as follows: 1. Winfred E. Pittman, Constable Pct. 7 - $5,000.00 2. Billy E. Beard, Commissioner Pct. 3 - $3,000.00 3. Richard Fronterhouse, Constable Pct. 4 - $1,000.00 4. B. H. Dewey, Jr., Justice of Peace Pct. 4, P1. 1 - $5,000.00 5. Sam Fachorn, Constable Pct. 5 - $1,000.00 6. Jeffrey K. Brown, County Attorney - $2,500.00 7. James A. Amis, Jr., County Court At Law Judge - $5,000.00 8. Bill J Cooley, Commissioner of Pct. 1 - $3,000.00 9• Raymond H Day, Constable Pct. 1 - $1,000.00 On motion by Commissioner Cooley, seconded by Commissioner li Wilcox, the Court voted to approve the above listed bonds subject to some corrections being made, The Court next considered the reappointment of Jack Canglose as the Civil Defense Coordinator for Brazos County. On motion by Commissioner Stasny, seconded by Commissioner Beard, the j Court unanimously voted to reappoint Jake Canglose. 1 r , If W ;14 ~ I Y ; f } t r, u N r • + ~ i i r } COMMISSIONERS' COURT MEETING - JANUARY 12, 1981 CONTINUED On motion by Commissioner Stasny, seconded by Commissioner Wilcox, the Court voted unanimously to advertise for the bids for the County Depository for the 1981-82 biennium by the publication of the following notice NOTICE TO BIDDERS FOR COUNTY DEPOSITORY Notice is hereby given that the Brazos County Commissioners' Court will receive bids up to ten o'clock A M on Monday, February 9, 1981, for a depository for the biennium of 1981-82 for official County funds, including those of the common school districts All funds must be protected by bonds and pledges of cash or securities, as well as by provisions of the Federal Deposit Insurance Corp. All bids must be to the Commissioners' less than one-half of the year 1980, which bidder does not enter cash or securities accompanied by certified check payable Court of Brazos County, Texas, for not one percent of the County revenue for shall be forfeited if the successful into the necessary bonds and pledges of Bids will be publicly opened and considered at the time specified, and Brazos County reserves the right to reject any or all bids Dated at Bryan, Texas, this the 12th day of January, 1981. R J HOLMGREEN, COUNTY JUDGE On motion by Commissioner Stasny, seconded by Commissioner Beard, the Court unanimously voted to advertise for bids for the purchase of voting machines Commissioner Beard requested authorization to advertise for bids for the construction of 2,000 feet of fence along FM 158. Commissioner Beard made the motion to advertise for bids and that funding be from a source other than the Precinct 3 Budget. The motion died for lack of a second. After dis- cussion and on motion by Commissioner Wilcox, seconded by Com- missioner Beard, the Court unanimously voted to advertise for bids for the construction of 2,000 feet of fence on FM 158 with monies to be paid out of the General Road and Bridge account. On motion by Commissioner Beard, seconded by Commissioner Wilcox, the Court unanimously voted to pay for materials used i COMMISSIONERS' COURT MEETING - JANUARY 12, 1981 CONTINUED by R. L. Delia Carroll to reconstruct 1168 feet of fence on FM 158 in the amount of $344,54 with monies to be paid out of the General Road and Bridge Fund. The Court next considered advertising for bids for the purchase of radio equipment for the Constables. On motion by Commissioner Stasny, seconded by Commissioner Beard, the Court unanimously voted to advertise for bids for four (4) mobile units and two (2) hand held units for the Constables. On motion by Commissioner Stasny, seconded by Commissioner Wilcox, the Court unanimously voted to advertise for bids for materials to install the axle load scales on the county's property located on Tabor Road. The Court next considered requests from Constables for authorization to appoint deputy constables and reserve deputy constables as follows; 1 Richard Fronterhouse, Constable of Precinct 4 requested authorization to appoint five (5) deputy constables and ten (10) reserve deputy constables and submitted the name of a Roland M. Searcy, Jr. - deputy constable 2, Sam Fachorn, Constable of Precinct 5 requested author- ization to appoint fourteen (14) reserve deputy con- stables and stated that the names would be submitted at a later time 3. Winfred E. Pittman, Constable of Precinct 7 requested authorization to appoint four (4) deputy constables and sixteen (16) reserve deputy constables and sub- mitted the names of; a. Walter F. Stenn$or deputy constable b. Ray Horn - deputy constable c. Billie Gaston - deputy constable d Bill Thornal - deputy constable e. Johnny B Hoelscher - reserve deputy constable `After discussion, Commissioner Cooley moved to adopt a resolu- tion to allow the appointment of deputy constables and reserve deputy constables, and that such appointment be made only after the submission of the names of those persons desiring to be appointed to the Commissioners' Court for approval and to be entered into the minutes of the meeting. The motion was seconded by Commissioner Stasny and carried unanimously. A copy of such resolutions are attached to and made a part of these minutes. The Court next considered a Lease Agreement between Roy Elliott and Brazos County for parking space for vehicles owned by Brazos County, Precinct 2 On motion by Commissioner Wilcox, seconded by Commissioner Beard, the Court unanimously voted to enter into the agreement, a copy of which is attached to and made a part of these minutes. Next to be considered was an Amendment to Business Lease between Lawrence, Thornton, Payne & Watson and Brazos County, such Amendment being to a Lease previously executed between Lawrence, Thornton, Payne & Watson and J M Daniel and wife, Lola M Daniel for space in the Western Auto Building. Action on the amendment was delayed pending further discussion in executive session. The Court then considered payment of 1981 membership fees to the National Association of Counties. Commissioner Stasny moved that Brazos County cease its membership. Motion died for lack of a second. Commissioner Wilcox moved to pay the 1981 membership fees. Motion was seconded by Commissioner Cooley, with Commissioners' Wilcox, Cooley, Beard and the County Judge voting "Aye" and Commissioner Stasny voting "No", whereupon the motion carried. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court unanimously approved Requests For Change In Status Of Employees as follows- Brenda Darlene Clark Adult Probation office Robert E. Barker Brazos County Shop The Court proceeded to consider the following Claims submitted by the County Auditor for payment General Fund Claims 1 through 152 Multi-Use Facility Claims 1 through 8 Law Library Claims 1 Revenue Sharing Claims 1 Crime Control Claims 1 through 2 County Shop Claims 1 through 17 Precinct 1 Claims 1 through 19 Precinct 2 Claims 1 through 23 Precinct 3 Claims 1 through 13 Precinct 4 Claims 1 through 5 On motion by Commissioner Stasny, seconded by Commissioner Cooley, the Court unanimously voted to pay the Claims as submitted. The County Judge laid before the Court an executed waiver that would allow the payment of claims out of the Road and Bridge Fund without his signature on Purchase Orders and requested the Court's approval, On motion by Commissioner Cooley, seconded by Commissioner Stasny, the Court unanimously voted to grant the request and ordered the waiver entered into the record of the Court. On motion by Commissioner Cooley, seconded by Commissioner Wilcox, the Court unanimously voted to authorize Precinct employees to work more than 40 hours a week at the request of the Commissioners and authorized the County Treasurer to pay regular time pay for all hours over 40 hours per week. The Court then recessed to reconvene at 2.00 P.M. 2.00 P.M. The meeting was opened at 4.40 P.M. The Court, having previously discussed an Amendment to Business Lease between Lawrence, Thornton, Payne & Watson and Brazos County for space in the Western Auto Building proceeded to consider the matter. On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court unanimously voted to approve the Amendment to the original Lease between Lawrence, Thornton, Payne & Watson and J M. Daniel and wife, Lola M Daniel (Such lease and amendment are on file in the County Judge's office ) The Court next considered salaries for county employees for 1981. Commissioner Cooley moved to increase the salaries for the following employees by 15 percent above 1980 budgeted amounts a) All Jailers, b) County Engineer, c) Chief Juv- enile Probation Officer, d) County Shop Foreman. He further moved to increase the salaries of all other employees by 12 percent above the 1980 budgeted amount and to amend the 1981 Budget accordingly. Motion was seconded by Commissioner Beard Commissioner Wilcox asked to amend Commissioner Cooley's motion to include the following increases. a) Administrative Assistant to $16,500, b) Director of Brazos Center to $16,500, c) Receptionist to $11,865, d) Chief Deputy of District Clerk's office to $11,685, e) 2 Assistant Treasurers to $12,500 each Commissioner Cooley denied the amendment to his motion with Commissioners Cooley, Stasny and Beard voting "Aye" and Com- missioner Wilcox voting "No", whereupon the County Judge announced the original motion carried Such amendments to the 1981 Budget are on file in the County Clerk's office and attached to the Original 1981 Budget, On motion by Commissioner Stasny, seconded by Commissioner Cooley, the Court unanimously voted to amend the County Audi- tor's 1981 Budget to $104,230, such amendment is on file in the County Clerk's office and attached to the Original 1981 Budget. Such amendment to the 1981 Budget is on file in the County Clerk's office and attached to the Original Bud- r get On motion by Commissioner Cooley, seconded by Commissioner Stasny, the Court unanimously voted to increase the amount budgeted for the Central Appraisal District for 1981 to $84,075.32 and authorized the payment of $21,018 79. Siich amendment to the 1981 Budget is on file in the County Clerk's office and attached to the Original Budget. On motion by Commissioner Cooley, seconded by Commissioner Stasny, the Court unanimously voted to increase Precinct 4 1981 Budget by $5,866 and Precinct 1 1981 Budget by $7,223. Such amendment to the 1981 Budget is on file in the County Clerk's office and attached to the Original Budget. "r`P►tL~ a. , . ~ ~.w-,.y... y r~.i"17.Srsj ....v.~-.-~ ` ~ 1 1 71( W T-'-=r-7 'T~ "1 'i / 1' I / a t't i tl , S t~ 1 , ~1~ ~It r, ~ + r r r ~ , J 1 r C ' I - ~~.......s• _l.+.-. r,RR~.• ~ ti1...~.6.. _ _.+a..a. , r _ . .ten, ..1.+.: a a ~ ~ RESOLUTION PERTAINING TO CONSTABLE APPOINTING DEPUTY CONSTABLES WHO SHALL SERVE AS PEACE OFFICERS DURING THE ACTUAL DISCHARGE OF OFFICIAL DUTIES A motion was presented by Commissioner Cooley , duly seconded by Commissioner Sr_asny which motion was voted on as follows 5 "Aye" 0 "Nay" It is hereby resolved by the Court that the Constable of Precinct 4 Brazos County, Texas, may appoint deputy constables wFio sNiall serve as peace officers during the actual discharge of official duties The minimum training standard and minimum physical, mental, educational, and moral standards for all deputy constables shall be the standards established for deputy law enforcement officers as provided by the Commis- sion on Law Enforcement Officer Standards and Education The Constable will certify to the Commissioners' Court that the appointee has achieved minimum standards The Constable may appoint, subject to confirmation by the Commissioners' Court, not more than 5 deputy constables No person appointed to the position or-deputy constable may carry a weapon or otherwise act as a peace officer until confirmed by the Commis- sioners' Court After confirmation he may carry a weapon only when discharging official duties as a duly contituted peace officer He serves at the discretion of the Constable and may be called into service at any time the Constable considers it necessary to have additional officers to preserve the peace and enforce the law Before he enters upon the duties of his office, he must take and subscribe to the official oath, which shall be endorsed on his appointment The appointment, the oath, and the certificate of the officer administering the oath shall be recorded and deposited in the office of the County Clerk of Brazos County, Texas Deputy constables will wear an emblem or a badge at all times while on active duty The emblem or badge will bear the words "Deputy Constable" The County of Brazos and the Constable shall not incur any liability by reason of appointment of any deputy constable, sustaining any personal injury while serving in such capacity, however, Commissioners' Court may provide hospital and medi- cal assistance to a deputy constable who sustains injury in the course of performing official duties as a peace officer in the same manner as provided for a full time deputy constable In no case shall any person serve as a deputy constable after January 1, 1973, unless he has fulfilled the minimum physical, mental, educational, moral and training standards established by the Texas Commission of Law Enforcement Officer Standards and Education Deputy constables, while on active duty shall be vested with the same rights, privileges, obligations and duties of any other peace officer of the State of Texas i A .POZMGREEN,/COUNTY JUDGE ATTEST De_ce4j FRANK BORISKI , COUNTY CLERK VOLMPAC, ezc~Lq, k i t r r r 1 voiMPME RESOLUTION PERTAINING TO CONSTABLE APPOINTING RESERVE DEPUTY CONSTABLES WHO SHALL SERVE AS PEACE OPFICERS DURING THE ACTUAL DISCHARGE or OFFICIAL DUTIES. A motion was presented by Commissioner Cooley , duly seconded by Commissioner Stasny which motion was voted on as follows. 5 "Aye" 0 "Nay" It is hereby resolved by the Court that the Constable of Precinct 4 , Brazos County, Texas, may appoint reserve deputy constables w o s Fall serve as peace officers during the actual discharge of off- icial duties.
