J. Holmgreen, County Judge, presiding- Bill J Cooley, Commissioner of Precinct 1, Walter Wilcox, Commissioner of Precinct 2, Billy E Beard, Commissioner of Precinct 3, W A Stasny, Commissioner of Precinct 4, Frank Boriskie, County Clerk. The following citizens and officials were in attendance Randy Clements Mary Nichols E A Wentrcek, Jr Phyllis G Presley Jim Thompson Mary McCoy Jack Cumpton Lydia Johnson Bill Davie Billy Hullett Claude Stewart KAGC Auditor Juvenile Probation WTAW KBTX -TV GMC Properties, Inc Architect KAMU KAMU NACo Brazos Valley Development Council The Court having heard a presentation by a representative of NACo first considered a Resolution Establishing a Deferred Compensation Plan for Brazos County On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court unanimously voted to adopt the attached Resolution subject to receipt of confirmation on the Agent for NACo who will be handling the program The Court next considered the following recommendations from the Auditor for road and bridge materials for 1981 1 K D Timmons, Inc be awarded the bid for gasoline beginning January 1981 through March 1981 2 Producers Co -op be awarded the bid for diesel fuel beginning January 1981 through March 1981 The Court asked the Auditor if the Court could purchase pro- ducts from a company if a member of the Court was also a Board t �• _ t 4« l A A 1 • tom.- __ ...- r.__�...,. _ - a_•_L_..___,__.]I...YJ i COMMISSIONERS' COURT MEETING - DECEMBER 22, 1980 CONTINUED / t' 1 member of that company. Commissioner Cooley stated that the Co -op would not deliver fuel to longs to another concern. Comm: the recommendations on gasoline of Precinct 1. Motion died for consensus of the Court that all dispensing equipment that be- Lssioner Cooley moved to accept and diesel with the exception lack of a second. It was the bids be investigated further. The Court considered the following bids for the sale of a Bush Hog mower for Precinct 4 1 Frank Palermo - $45 00 2 Jerry Cotrone - $50 00 Commissioner Cooley moved to award the bid to the highest bidder. Motion was seconded by Commissioner Stasny and carried unanimously. The Court next considered the following application for soil conservation work Louis T Corgey, Rt 1, Wheelock, Box 574, requested 4 to 6 hours motor grader work 2k miles east of Edge off Bundick Road in Precinct 2 On motion by Commissioner Wilcox, seconded by Commissioner Stasny, the Court unanimously voted to approve the application and authorize the Commissioner to do the necessary work. The Court then considered the FINAL PLAT of HOPES CREEK MEADOW in Precinct 1 On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court approved the plat as presented The Court next considered a Social Services Contract between Brazos County and the Texas Department of Human Re- sources. The project is directed at status offender youth. The Contract will be for a one year period effective February 1, 1981 through January 31, 1982 in the total amount of $19,125 40, 70 percent to be funded by the Department of Human Resources and 30 percent inkind service from Brazos County On motion by Commissioner Cooley, seconded by Commissioner Beard, the Court unanimously voted to authorize V 0 l..4 PAGES r� r T COMMISSIONERS' COURT MEETING - DECEMBER 22, 1980 CONTINUED ,1 / V®L..QPAG E.(a Z� the County Judge to enter into such contract on behalf of Brazos County The Court next heard a presentation by Jack Cumpton, 1 Architect, on final plans for the Annex and Tax office. Commissioner Cooley moved to accept these final plans and budgets and to put the plans out for bids at the appropriate time. Motion was seconded by Commissioner Stasny and carried unanimously On motion by Commissioner Cooley, seconded by Commissioner Stasny, the Court unanimously approved the payment of Jack Cumpton's statement for modifications and additions to the Annex and Tax office plans in the amount of $24,320.00. On motion by Commissioner Wilcox, seconded by Commissioner Stasny, the Court unanimously approved Requests For Change In Status Of Employees as follows Gloria Ann Taylor Joan Shannon Karen Davenport Karen Davenport Charles Ray Blondeau Zane J. Gauthier Sandi Hodges Peggy Williams Health department County Attorney's office County Attorney's office Justice of the Peace Pct 7 _ Sheriff's office Sheriff's office Tax office Tax office The Court proceeded to consider the following Claims sub- mitted by the County Auditor for payment General Fund Claims 3990 through 4115, omit 4026 Texas Youth Council Claims 15 through 16 Crime Control Claims 38 through 41 Revenue Sharing Claims 35 through 37 Multi -Use Facility Claims 22 through 24 Law Library Claims 42 Adult Probation Claims 47 through 48 County Shop Claims 236 through 242 Precinct 1 Claims 272 through 288 Precinct 2 Claims 325 through 329 Precinct 3 Claims 320 through 329 Precinct 4 Claims 229 through 235 On motion by Commissioner Stasny, seconded by Commissioner Beard, the Court unanimously voted to pay the Claims as sub- matted. There being no further business to come before the Court, the meeting was adjourned 41 ,i {1 l IL i C1 y t RESOLUTION ESTABLISHING A DEFERRED COMPENSATION PLAN FOR BRAZOS COUNTY Y /f WHEREAS, the County has considered the establishment of a Deferred Compensation Plan to be made available to all eli- gible County employees, elected officials, and independent contractors pursuant to Section 457 of the Internal Revenue Code permitting such Plans, and WHEREAS, certain tax benefits could accrue to employees, elected officials, and independent contractors participating in said Deferred Compensation Plans, and WHEREAS, such benefits will act as incentives to County employ- ees to voluntarily set aside and invest portions of their current income to meet their future financial requirements and supplement their County retirement and Social Security (if applicable), and WHEREAS, the National Association of Counties has established a Master Deferred Compensation Program for its member Counties, permitting its member Counties and their employees to enjoy the advantages of this Program, WHEREAS, by adoption of the NACo Program, all regulatory, operational, administrative and fiduciary responsibilities are hereby assumed by NACo in behalf of County, and WHEREAS, NACo, as Plan Administrator, agrees to hold harmless and indemnify the County, its appointed and elected officers and participating employees from any loss resulting from NACo or its Agent's failure to perform its duties and services pur- suant to the NACo Program, NOW, THEREFORE THE COMMISSIONERS' COURT DOES HEREBY RESOLVE AS FOLLOWS The Commissioners' Court, meeting in special session, this 22nd day of December, 1980, hereby adopts the National Association of Counties Deferred Compensation Program and hereby establishes the County of Brazos Deferred Compensation Plan for the volun- tary participation of all eligible County employees, elected officials and independent contractors The County Judge is hereby authorized to execute for the County, individual participation agreements with each said employee requesting same, and to act as the "Administrator" of the Plan representing the County, and to execute such agreements and contracts as are necessary to implement the program It is implicitly understood that, other than the incidental expenses of collecting and disbursing of the employee's deferrals and other minor administrative matters, there is to be no cost or contribution by the County to the program IT IS HEREBY FURTHER ORDERED, that a true copy of this Resolution be spread upon the Court's record of this date 1 �i 0', �'.
