A special meeting of the Commissioners' Court of Brazos

`r County, Texas, was held in the Commissioners' Courtroom in

the Courthouse in Bryan, Brazos County, Texas, beginning at
10 00 A M. on Monday, October 27, 1980, with the following
members of the Court present

Thee Court first heard a presentation by Hubert Nelson,
Bryan City Planner, regarding plans for future arterial
routes The Court was urged to voice all ideas and suggestions
to both City Councils.
The Court next considered payment of fire calls to the
City of Bryan and the City of College Station for the month
of September, 1980 On motion by Commissioner Cooley, seconded
by Commissioner Stasny, the Court unanimously voted to approve
payment to the City of Bryan in the amount of $587 50 and the
City of College Station in the amount of $100 04

The Court next considered the Preliminary Plat of HOPES
, CREEK MEADOW in Precinct 1. On motion by Commissioner Cooley,
seconded by Commissioner Stasny, the Court unanimously approved
the plat subject to the following,
1 Tying the long cul de sac into Hopes Creek Road.
2. Addition of all necessary easements.
The Court proceeded to consider the Final Plat of LA
BRISA IV in Precinct 4. On motion by Commissioner Stasny,
seconded by Commissioner Cooley, the Court unanimously
approved the plat subject to the following
1. Approval by the City of Bryan
2. Letter of credit for maintenance.
The Court next considered the Final Plat of FROEHLING
ADDITION in Precinct 3. On motion by Commissioner Cooley,
seconded by Commissioner Stasny, the Court unanimously
approved the plat subject to the following
1. Addition of drainage easements between lots 4,
5, 6 &7
2. Letter of credit for the construction of roads.
The Court next considered an agreement between Brazos
County and Allie Lewis for deferred compensation. On motion
by Commissioner Cooley, seconded by Commissioner Stasny,
the Court unanimously approved the agreement and notified
the County Auditor to take necessary action A copy of
such agreement is attached to and made a part of these
minutes.
The Court next considered Requests For Change In Status

After discussion of the Requests for Ed Feldman and Orum L.
Moss as Assistant Baliffs for the 85th and 272nd District
Courts regarding the need, total dollar amount needed for
amending the budget and the manner in which they were hired
Commissioner Stasny moved that all requests be approved
The motion was seconded by Commissioner Cooley and carried
unanimously.
The Court next considered Certificates of Cancellation
No. 10689 through 10694 for the Tax office On motion by
Commissioner Stasny, seconded by Commissioner Cooley, the
Court unanimously approved the Certificates as presented

WHEREAS ALLIE LEWIS has heretofore been employed as Bailiff
of the 272nd Judicial District Court of Brazos County, Texas, on
a part -time basis, and
WHEREAS the Judge of the 272nd Judicial District Court has

;^ requested that said employee be placed on full -time status, and
WHEREAS said employee has indicated a desire and willingness
x to become employed on a full -time basis by Brazos County, Texas,

as such Bailiff, if a portion of the compensation which would
ui
otherwise be paid to him can be deferred until a later date, and

WHEREAS Article 6252 -3b, Revised Civil Statutes of Texas,
as amended, authorizes Brazos County to agree with any employee

to defer, in whole or in part, any portion of that employee's '

compensation, and

WHEREAS, the said Allie Lewis serves at the pleasure of the
Judge of the 272nd Judicial District Court of Brazos County, Texas,
NOW, THEREFORE,

KNOW ALL MEN BY THESE PRESENTS That Brazos County, Texas,

acting herein, by and through its duly authorized County Judge,
pursuant to a resolution duly adopted by the Commissioners' Court
of Brazos County, Texas, at a meeting held on the 27th day of

October 1980, hereinafter called "County ", and ALLIE LEWIS,

an employee of Brazos County, Texas, hereinafter called "Lewis ",

have agreed and by these presents do agree as follows•

Beginning on October 1, 1980, Lewis will become

employed on a full -time basis by County as Bailiff
of the 272nd Judicial District Court of Brazos County,
Texas, a position for which an annual salary of $10,000.00

! is authorized ($384.60 per two -week pay period),
2. Between October 1, 1980 and December 31, 1980, Lewis shall
be paid one -half of such sum ($192.30 per two -week pay

period) and the balance of the full -time compensation
^ earned by him shall be deferred until the final payment

date hereinafter set forth.

3. Beginning January 1,\ 1981 and continuing through
' - December 31, 1981, should Lewis continue his full-
time service as Bailiff of such Court, he shall be
entitled to and shall earn full -time compensation
i
at the rate specified in the 1981 Budget of Brazos
t
County, Texas, as recommended by the Judge of the
t
272nd Judicial District Court and finally approved
by the Commissioners' Court of Brazos County, Texas.
4. During the calendar year 1981, Lewis shall be paid
at the rate of $211 53 per twb -week pay period (not
to exceed $5,500 00 for the entire calendar year),
And the balance of such full -tlme compensation as
is earned by him during such year shall be deferred
until the final payment date hereinafter set forth.
5. On the 5th day of January, 1982, Brazos County shall
pay to Lewis the deferred portion of the compensation
earned by him between October 1, 1980 and December
31, 1980, together with the deferred portion of the
compensation earned by him between January 1, 1981,
and December 31, 1981, without interest In the event of the
death of the said Lewis prior to January 1, 1982, the deferred
portion of the compensation earned by him, but unpaid
by Brazos County, shall become immediately due and
payable to Jeanelle Lewis, wife of Allie Lewis.
6. Nothing in this agreement shall in anyway limit or
restrict the authority of the Judge of the 272nd Judicial
District Court to appoint the Bailiff for such Court,
nor shall this agreement vest in Lewis any employment
rights not granted to other employees of County. The
sole purpose of this agreement is to defer a portion of
the compensation which would otherwise be earned by
Lewis and paid by County. Should Lewis cease to be an
employee of County or should the number of hours worked
by Lewis be reduced to part -time, this agreement shall

thereupon terminate in all respects except that
the deferred compensation earned by him prior to

termination date shall be paid in;accordance with
this agreement.
