J. Holmgreen, County Judge, presiding: Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2, H. L. Cargill, Commissioner of Precinct 3,tt W. A. Stasny, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The Court received, approved and ordered filed as sub- mitted the following reports for June, 1979: W. T. Cumpton Architect Mary Nichols Auditor Kurt Abraham WTAW Larry Wells Jerry Bishop & Associates 1.30 i Dede Matthews Architect on motion by Commissioner Stasny, seconded by Commissioner Cooley, the minutes of the meeting held June 11, 1979, were examined and approved without change. ,r The Court having advertised for bids for the sale of surplus property proceeded to the opening of the following bids: 1. Jerry Catrone - $229.95 for boat #3; Tubbs - Craft • Corsair, 14 foot aluminum, three seats with flotation, 18 hp Johnson Sea Horse Engine, five gallon gas can, and two wheel trailer. r 2. Leroy J. Kleinsasser - $475.00 for boat #1; Arkansas Traveler, 15 foot heavy duty aluminum, three seats with flotation, 18 hp Evinrude Fastwin, five gallon gas can, and two wheel tilt bed trailer. No bid was received on boat two (2) or the lot. After discussion Commissioner Cargill moved to refer the bids to the Sheriff for his examination and recomendation and to take the matter up at Y the next meeting to be held July 23, 1979. The motion was seconded by Commissioner Cooley and carried unanimously. The next matter to come before the Court was the appoint- ment of Election Judges for the 1979 voting year. The County Judge announced that he would like to defer this item until the meeting to be held July 23, 1979. Mr. N. A. McNiel, Republican Party Chairman, who was present in connection with this matter, announced that he had no objection to the matter being deferred. The Court next considered the appointment of persons to serve as advisory to the Director of the Brazos Center and the VOAGE?'71 COMMISSIONERS' COURT MEETING - JULY 9, 1979 CONTINUED VOL _0PAGE .278 Brazos County Livestock Facilities. Such group to be known as the Brazos County Recreational Facilities Advisory Committee, to advise the Director on such matters as; regulations, fees, policies and any other matters that the Director deems necessary. On motion by Commissioner Stasny, seconded by Commissioner Cooley, the following persons were appointed: D. A. On recommendation of the Tax Assessor-Collector and motion by Commissioner Wilcox, seconded by Commissioner Cargill, the Court unanimously voted to authorize the refund in the amount of $.75 and directed the County Auditor to make such payment. The Court next considered the matter of payment for fire calls made by the City of Bryan and the City of College Station as follows: City of Bryan - $447.31 City of College Station - $767.82 f After much discussion Commissioner Cooley moved for the pay- ment of both bills. The motion died for lack of a second. The motion died for lack of a second. Commissioner Stasny moved that the matter be deferred r until the next meeting but received no second for the motion, at which time the Couhty Judge announced that the matter would be taken up at the meetiAig to be held July 23, 1979. It being the consensus S f E r V®Qq 0 PAGE 4279 I ' C COMMISSIONERS' COURT MEETING - JULY 9, 1979 CONTINUED 14 ` VOL 0 PAGE of the Court at their meeting held May 29, 1979, that due to the annexation of seventy-three (73) acres of raw land by the City of Bryan that this matter be considered at the July term of Court and after discussion Commissioner Wilcox moved that the following order providing for the reformation of Election Precinct 14 and Precinct 3 WHEREAS there exists at the present time a certain rural election precinct in Brazos County that includes territory inside the corporate limits of the City of Bryan. After discussion and on motion by Commissioner Cooley, seconded by Commissioner Wilcox, the Court voted unanimously to approve the dedication as pre- , { sented: Koppe Corporation next requested authorization to utilize the following County rights-of-way: 1) Dowling Road in Precinct 1, 2) North Graham Road in Precinct 1, 3) Cain Road in Precinct 1. On motion by Commissioner Cooley, seconded by Commissioner Wilcox, the Court unanimously voted to approve the requests for installation subject to the following: 1. Tnat the Commissioner of the Precinct in which the right-of-way'lies must be notified prior to the beginning of the construction in order that the Commissioner might be on hand to designate the actual location of the installation. 2. That all damage to the roadways and rights-of-way will be repaired to their original condition to the satis- faction of the Commissioner in which the roadway or right-of-way lies. 3. That Brazos County reserves the right to require Koppe Corporation to relocate or lower any such line at no cost to Brazos County, should same become nece- ssary due to widening or lowering, or other altera- tion of the roadway or right-of-way. 4. That Brazos Counts will in no way be responsible for any damage that might occur to any existing utility lines in the right-of-way. 5. That the line will be constructed and maintained on the County right-of-way in accordance with governing + laws. The Court next discussed the implementation of H.B. 1060, an act relating to implementation of the Tax Relief Amendment to the Texas Constitution, relating to the appraisal of agri- cultural land. The Tax Assessor-Collector requested that the Act not be put into effect this year due to the length of time it would take to re-appraise the property and the time required by law to complete the tax roll. After much discussion Commis- sioner Cooley moved to take the recomendation of the Tax Assessor-Collector to implement the Act effective in 1980. The motion was seconded by Commissioner Wilcox and carried unan- imously. The Court next entertained a request by Commissioner R Y 3 x , 1:30 P.M. The Court reconvened at 1:30 P.M. and heard a presentation Cargill for authorization to purchase a surplus truck from the Department of Highways and Public Transportation in the amount of $800.00. Such truck to be used to replace a fire truck used by the Precinct 3 Volunteer Fire Department and to be paid for out of Fire Protection Funds. On motion by Com- missioner Cargill, seconded by Commissioner Wilcox the Court unanimously voted to authorize the purchase. Commissioner Stasny moved to authorize the purchase of a new truck out of Fire Protection Funds in the amount of $12,000.00 to be used by Precinct 4 Volunteer Fire Department. The motion died for lack of a second. There being no further business to come before the Court, the Court recessed until 1.30 P.M. by W. R. Mr. Matthews was advised that all qualified and interested archi- tects would be given an opportunity to make a formal presen- tation on any work that is not now under contract. Jack Cumpton, Architect, was present to report on the walk through inspection of the jail made by the inspector from the Texas Jail Commission. The Court was advised that a number of areas that the jail did not meet the stand4rds for had been corrected and that the list of nonconformances had been reduced considerably. They were further advised that several of the areas could be corrected by the County maintenance department. 1 D L The court once again discussed the purchase of a fire truck for the Precinct 4 Volunteer Fire Department. Commissioner Stasny moved that authorization be given to get prices on a new fire truck. The motion was seconded by Commissioner Cargill, with Commissioners Stasny, Cargill and the County Judge voting AYE. Commissioners Wilcox and Cooley voted N0, whereupon the County Judge announced the motion carried. Commissioner Wilcox then moved that authorization be given to secure prices for the purchase of a fire truck to be used by the Precinct 2 Volunteer Fire Department. The motion died for lack of a second.
