The County Judge and all members of the Court stated that they would need additional time to study the bids and acquaint themselves with the terminology used. The County Judge stated that the meeting would be recessed until 10.00 A.M. Tuesday, February 13, 1979 at which time a descisi.on would be made. The results of these races according to the accumulative print out of the electronic counting device used by the County for this purpose are. County Commissioner, Precinct 2 - Walter Wilcox received 3,352 votes County Commissioner, Precinct 4 - W. A. (Bill) Stasny rece,Ned 2,029 votes Justice of the Peace, Precinct 4, Place 2 - Carolyn M. Hensarling received 6,641 votes Commissioner Cooley moved to accept the results of the General Elec- tion as final and to direct the County Clerk to certify the accumu- lative results of these races to the Secretary of State and ordered a copy of the Court order be attached to and made a part of these minutes Motion was seconded by Commissioner Cargill and carried unanimously. I Next the Court considered reauests for exemption fr an ad valorem taxation from the following 1. The College Station Baptist Chapel on .75 acres to be used as a Parsonage. 2. The Somerville Church of God on 6.16 acres of srA League. Warren Robertson representing the Church assured the Court the building will be used as a place of worship. The County Tax Assessor advised the Court that the building and up to 1 acre of land on which it sits is eligible for exemption. Action on this matter was deferred until the continued sepsion on Tuesday, February 13, 1979 at 10:00 A.M. at which time the Tax Assessor Collector would give the Court his recommendation on the matter. The Court next discussed the agreement with General Telephone Company passed in October 1971 concerning the utilization of County rights-of-way for buried cable After discussion Commissioner Cooley moved to authorize the'utilization of the rights-of-way according to the following provisions- a VOL-a PALS c2 IL' i' r '-+~.cura..o.~«. .,.wow.-..r.....+...•......- COMMISSIONERS' COURT MEETING - FEBRUARY 12, 1979 CONTINUED V066Q.rAGE ~10 I 1. The General Telephone Company secure the approval of the c~ Commissioner in whose precinct the work is to be done as to location of the actual work, such approval be obtained prior to the beginning of actual construction. 2. That General Telephone Company repair all damage done to any road by reason of such construction and restore the road and right-of-way to its condition prior to construction, and cause any contractor employed by it to do likewise. 3. That Brazos County reserve the right to require General Telephone Company to relocate any such cable at no cost to Brazos County, should same become necessary due to the widening, lowering, or other alteration of the road or right-of-way. 4. That Brazos County will in no way be responsible foe any damage that might occur to any existing utility lines in the right-of-way. S. That the line will be constructed and maintained on the County right-of-way in accordance with governing laws., 6. That the method for crossing of hard surface or gravel roads will be left to the descreti.on of the Commissioner in whose precinct the right-of-way lies. 7. The Brazos County reserves the right to deny the use of a road right-of-way if a public utility easement exists. Motion was seconded by Commissioner Cargill and carried unanimously. Next to be considered was an application to the Criminal Justice Division for third year funding for the Foster Group Home. The appli- cation being 60% funded by the Criminal Justice Division and 40% funded by Brazos County for a total amount of $47,109. Several ques- tions were raised by the Court that could not be answered due to the absence of John Godfrey, Probation officer and action was deferred until Tuesday, rebruary 13, 1979 at 10:00 A.M. Next to be considered was the payment of annual dues to The County Judges' and Commissioners' Association of Texas. Commissioner Stasny moved that the annual dues totaling $100.00 be paid. Henry It being the intent of the Court to make additional appointments at a later date. The Court proceeded to consider the Final Plat for WOODLAKE SUBDIVISION, SECTION II, PHASE I in Precinct 1. After careful review of the Plat, Commissioner Cooley moved to approve the Plat subject to the following corrections: 1. Addition of drainage and utility easements along alternate lot line. ,44 2. Filing of a bond for the completion of the roads. Motion was seconded by Commissioner Wilcox and carried unanimously. On motion by Commissioner Cooley, seconded by Commissioner Cargill, the Court unanimously voted to approve Requests For Change In Status Of Employees as follows: Louis M. The Court proceeded to consider for payment the following Claims submitted by the County Auditor for payment: General Fund Claims 212 through 450 Revenue Sharing Fund Claims 1 through 7 Shop Claims 15 through 42 Precinct 1 Claims 18 through 38 Precinct 2 Claims 15 through 39 Precinct 3 Claims 9 through 33 Precinct 4 Claims 12 through 34 Bridge House Claims 8 through 22 Law Library Fund Claims 3 through 7 Adult Probation Fund Claims 8 through 21 Juvenile Probation Fund Claims 11 through 39 On motion by Commissioner Cargill, seconded by Commissioner Stasny, the Court voted unanimously to pay the Claims as presented. Having advertised for bids for a lawn mower for Brazos Center, the Court proceeded to the opening of bids. The County Judge opened the only bid received, that being from Universal Service for a 48" Yazoo in the amount of $2,397.99. On motion by Commissioner Cooley, seconded by Commissioner Stasny, the Court accepted the only bid received and authorized the purchase of the lawn mower. There being no further business the Court recessed at this time to reconvene Tuesday, February 13, 1979 at 10:00 A.M. The Court next considered an application to the Criminal Justice Division for thud year funding for the Bridge House. This application to be 60% funded by the Criminal Justice Division funds and 40% County funds. After careful inspection of the proposed budgeted for the third year and the entire application, Commissioner Cooley moved to approve the submission of the application and to authorize the County Judge to execute the necessary application. Motion was seconded by Commissionex Wilcox. Commissioners Cooley, Wilcox and Stasny voted YES, Commissioner Cargill voted NO, where upon the County Judge announced the Motion carried. The Court proceeded to consider the requests for exemption from ad valorem taxation from the College Station Baptist Chapel on 0.75 acres of land in the Morgan Rector League, Abst. 45 to be used as a Parsonage and from the Somerville Church of God on 6.16 acres in the Stephen F. Austin League No. 10, Abst. 63. Tax Assessor-Collector Gerald L. Winn was present and advised the Court that the request by the College Station Baptist Chapel was eligible. He further advised the Court that only one acre of land as requested by the Somerville Church of God was eligible for exemption. FEBRUARY 16, 1979 The Commissioners' Court reconvened at 10:00 A.M. on Friday, February 16, 1979, with the following members of the Court presents R. J. Holmgreen, County Judge, presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; H. L. Cargill, Commissioner of Precinct 3, W. A. Stasny, Commissioner of Precinct 4. The following citizens and officials were in attendance: John Morris Craig Rogers . The County Judge opened the meeting and once again read aloud the names of the local financial institutions that had bid on the County Depository for the 1979-60 biennium. Those banks being- City National Bank First Bank & Trust First National Bank University National Bank After much discussion Commissioner Cooley moved to accept the bid of the University National Bank, stating his belief that it was the only firm bid received. The motion died for lack of a second. Commissioner Wilcox moved to accept the bid of First National Bank of Bryan. The motion was seconded by Commissioner Stasny, with Commissioner Wilcox, Commissioner Stasny and Commissioner Cargill voting AYE. Commissioner Cooley abstained, whereupon the County Judge announced the motion carried and the Depository Contract be awarded to the First National Bank of Bryan. There being no further business the Court adjourned.
