REGULAR MEETING
January 8, 1979
A regular meeting of the Commissioners' Court of Brazos
County, Texas, was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A.M.
on Monday, January 8, 1979, with the following members of the
Court present:
R. J. Holmgreen, County Judge, presiding;
Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
H. L. Cargill, Commissioner of Precinct 3;
W. A. Stasny, Commissioner of Precinct 4,
Frank Boriskie, County Clerk.
The Court received, approved, and ordered filed as submitted
the following reports for December 1978:
W. T. Sistrunk, County Extension Agent;
Curtis Taylor, Jx., County Extension Agent;
Mable Walker, County Extension Agent;
Wanda L. Pope, County Extension Agent.
The Court received, considered, and approved the following
reports from County and Precinct Officers showing official fees

Judge Holmgreen opened the meeting and recognized Richard
Smith, Mayor of the City of Bryan, acknowledging that Mayor Smith
was not on the agenda but had asked to address the Court on the
possibility of consolidating functions of the City and County
Tax Departments. Mayor Smith asked the Court to discuss the
matter and to designate a representative to meet with repre-
sentatives of the City. No action was taken at this time.
The next matter for consideration was the matter of setting
f f
salaries for all County employees for the year 1979. Judge
Holmgreen recommended that the salaries be set as budgeted in
October with a few exceptions. The Court heard requests from
Officials as follows:
1. B. V. Elkins, County Treasurer requested that the salary
of the Clerk in his office be increased an additional
two percent.
2. Bobby H. Yeager, Sheriff, requested that the jailers in
his department be increased to $3.00 per hour. He
asked for clarification of the number of jailers that
were budgeted since he was authorized a Records Clerk
for his department. Sheriff Yeager was advised that the
money budgeted reflected salaries for 4 jailers and an
additional $1,000.00 for a jailer's salary.
3. Judge Bradley Smith requested that consideration be
given to the employment of a part-time Baliff for the
County Court-at-Law to be paid $4,500.00. Judge Smith
was advised that this was not a budgeted salaryi however,
this matter might be considered later, after Judge
Holmgreen had more time to acquaint himself with the revenues
and appropriations of the budget.

There being no further requests, Commissioner Cooley moved that
the salaries be set and presented on the 1979 salary schedule.
The Motion was seconded by Commissioner Stasny and carried
unanimously.
On motion by Commissioner Wilcox, seconded by Commissioner
Stasny, the Court unanimously set the rate for out of County
travel at $.18 per mile.
The Court proceeded to the approval of bonds for those
Officials elected in the 1978 November election as follows:
1. James Bradley Smith, Judge, County Court-at-Law - $5,000.00
2. R. J. Holmgreen, County Judge - $5,000.00
3. Frank Boriskie, County Clerk - $5,000.00
4. Gerald L. (Buddy) Winn, Tax Assessor-Collector - $50,000.00
to Brazos County Judge and $50,000.00 to the Governor of
Texas.
5. John M. Barron, Jr., County Attorney - $2,500.00
6. Bobby H. Yeager, Sheriff - $5,000.00
7. W. D. Burley, District Clerk - $5,000.00
8. A. B. Boyett, Jr.,Justice of Peace, Precinct 7,
Placel - $5,000.00
9. Joe Daniel Novosad, Justice of Peace, Precinct 5 - $5,000.00
10. Clyde Wesley Day, Justice of Peace, Precinct 1 - $5,000.00
11. Jerry Hutchinson,Justice of Peace, Precinct 3 - $5,000.00
On motion by Commissioner Stasny, seconded by Commissioner Cargill#
the Court voted to set the bond of the County Treasurer, Bill
Elkins at $10,000.00 and to approve the above listed bonds.
The Court next authorized advertisement for the bids for
the County Depository for the 1979-80 biennium by the Publication
of the following Notice:

NOTICE TO BIDDERS FOR COUNTY DEPOSITORY
Notice is hereby given that the Brazos County Commissioners'
Court will receive bids up to ten o'clock A.M. on Monday, February
X12, 1979, for a depository for the biennium of 1979-80 for official
County funds, including those of the common school districts.
All funds must be protected by bonds and pledges of cash or
securities, as well as by provisions of the Federal Deposit
Insurance Corporation.
All bids must be accompanied by certified check payable to the
Commissioners' Court of Brazos County, Texas, for not less than
one-half of one percent of the County revenue for the year 1978,
which shall be forfeited if the successful bidder does not enter
into the necessary bonds and pledges of cash or securities.
Bids will publicly opened and considered at the time specified,
and Brazos County reserves the right to reject any or all bids.
Dated at Bryan, Texas, this the 8th day of January, 1979.

The Court next considered the reappointment of the Civil
Defense Coordinator for Brazos County. Judge Holmgreen recommended
the reappointment of Jake Cangelose. On Motion by Commissioner
Stasny, seconded by Commissioner Cooley, the Court unanimously
voted to reappoint Jake Cangelose as the County's Civil Defense
Coordinator.
The Court next received from the District Clerk the names of
all persons serving on the Grand Jury during the past twelve months
and proceeded to draw names for the Salary Grievance Committee as
f of lows :

On Motion by Commissioner Cooley, seconded by Commissioner
Stasny, the Court unanimously voted to designate the following
dates as'official holidays for Brazos County:
May 28 - Memorial Day
July 4 - Independence Day
September 3 - Labor Day
Novembex 22 and 23 - Thanksgiving Day
December 24 and 25 - Christmas
January 1, 1980 - New Year's Day

The Court next considered the letter from the Texas Department
of Health advising that the appointment of George McIlhaney as
County Health Officer terminated December 31, 1978. On Motion by
Commissioner Stasny, seconded by Commissioner Wilcox, the Court
unanimously voted to reappoint Dr. McIlhaney for a two year term

ending December 31, 1980.
On Motion by Commissioner Wilcox, seconded by Commissioner
Stasny, the Court unanimously voted to approve the following
statements for work completed at the Regional Multi-Use Facility:
Thurmond & Stuart $20,853.00
Soil Mechanics, Inc. 240.00
Jack Cumpton, Architect 1,825.00
The Court next considered contracts between Brazos County and
Southwest Texas State University for two interns who will be
working with Judge Bradley Smith, County Court-at-Law Judge and
John M.Barron, Jr., County Attorney. These interns are students
of Political Science who will gain practical experience in
government that cannot be provided in a classroom. The recom-
mended rate of pay for the interns is $3.00 per hour for about
270 hours or a total of $800.00 per intern, of which the County's
share would be approximately $80.00. After discussion of the
contracts and the service they could provide, Commissioner Cargill
moved to authorize the County Judge to execute the two contracts
on behalf of Brazos County at a cost to Brazos County not to
exceed $80.00 per intern. The Motion was seconded by Commissioner
Wilcox and carried unanimously.
The Court considered two requests from Wixon Water Supply
Corporation concerning the crossing of County right-of-way with
waterlines. After discussion and on Motion by Commissioner Wilcox,
a Motion was made that Wixon Water Supply Corporation be authorized

to cross all County roads providing that it shall comply with
the following conditions:
1. That Wixon Water Supply Corporation secure the approval
of the Commissioner in whose Precinct the work is to
be done as to the actual location prior to the beginning
of actual construction.
2. That Wixon Water Supply Corporation repair all damage
done to any road or right-of-way by reason of such
construction and restore the road and right-of-way to
its condition prior to construction, and cause any
contractor employed by it to do likewise. All repairs
to be to the satisfaction of the Commissioner in which
the road or right-of-way lies.
3. That Brazos County reserves the right to require Wixon
Water Supply Corporation to relocate or lower any such
lines at no cost to Brazos County, should same become
necessary due to the widening, lowering, or other
alteration to the roadway or right-of-way.
4. That Brazos County will in no way be responsible for any
damage that might occur to any existing utility lines
in the right-of-way.
5. That the line will be constructed and maintained on the
County right-of-way in accordance with governing law.
The Motion was seconded by Commissioner Cargill and carried
unanimously.
Next to be considered by the Court was Requests for Change
in Status for the following employees:

On Motion by Commissioner Cooley, seconded by Commissioner Stasny,
the Court unanimously voted to approve the above Requests as
submitted.

On Motion by Commissioner Cooley, seconded by Commissioner Stasny,
the Court unanimously voted to accept the resignation of
Judge Vance and to appoint Judge Holmgreen to the above mentioned

the respective agencies.

1. Final Plat of INDEPENDENCE AVENUE in Industrial Park
and Precinct 4. On Motion by Commissioner Stasny,
seconded by Commissioner Wilcox, the Court voted unan-
imously to approve the Plat as submitted.
2. Final Plat of WOOD MEADOW in Precinct 1. After careful
review of the Plat, Commissioner Cooley moved to approve
the Plat subject to the following additions:
(a) That the developer add a 16 foot easement along
Hunter Creek Road.
(b) That the developer add a notation on the Plat that
the utilities in Valley Ridge right-of-way will
be placed within the 16 foot utility easement and
if they need to be moved in the future, it will be
done at the expense of the utility company.
The Motion was seconded by Commissioner Cargill and
carried unanimously.
3. Final Plat of EAST BRAZOS INDUSTRIAL PARK, PHASE I in
Precinct 2, on Motion by Commissioner Wilcox, seconded
by Commissioner Cargill, the Plat was unzuz.imously
approved and the two year road maintenance period
would begin immediately and be subject to the addition of
the notation regarding septic tank regulations.
4. FINAL PLAT OF EAST BRAZOS INDUSTRIAL PARK, PHASE II in
Precinct 2. After careful study of the Plat, Commissioner
Wilcox moved to approve the Plat subject to the following
conditions:
(a) That the developer construct the roads to county
standards or file the appropriate bond.
(b) That the developer construct a temporary turn-around
at the end of Cross Wind Drive.
(c) That the developer add the notation regarding the
County's septic tank regulations.
The Motion was seconded by Commissioner Cargill and
carried unanimously.
The Court proceeded to consider for payment the following
