The first matter to come before the Court was the canvass of
!

the results of the General Election held November 7, 1978. The
County Judge stated that by order of the District Judge of the 85th
11

District Court, the canvass of the results of the offices of the
t
t
Governor and U. S. Senator shall be deferred until such time as de-
1=
, r.
signated representatives of the respective offices be permitted to
examine the program used in counting the ballots, materials used in
making the test counts, ballot assemblies for all voting devices
1 ,
and to make a recount of the test count and all ballots for all
election precincts in the races.
The County Judge further stated that by order of the United
l
States District Court Brazos County was enjoined from canvassing
,
1 votes and certifying the results for the offices of Commissioners
Precinct 2, Precinct 4 and Justice of the Peace Precinct 4, Place
2. A copy of both orders are attached to and made a part of these
11
minutes. r~
,
The Court proceeded to canvass the results of all other races
according the accumulative print out of the electronic counting
device used by Brazos County for this purpose. On motion by Com-
missioner Cooley, seconded by Commissioner Cargill, the Court un-
animously voted to accept the results and to authorize the CaUnty
Clerk to certify the accumulative results to the Secretary of,State.
A copy of such accumulative print out is attached to and made a
part of these minutes as evidence of the canvass.
On motion by Commissioner Cooley, seconded by Commissioner
Stasny, the Court unanimously voted to pay the statements of Jack
Cumpton Architect as follows.
$1,110 for services in connection with a study for a Juvenile
Facility to be paid out of the General Fund.
$2,546.48 for services in connection with the Regional Multi- ,
Use Facility to be paid out of the EDA Funds.
On motion by Commissioner Cooley, seconded by Commissioner Wilcox,
the Court unanimously voted to pay Marcal, Inc. for work completed

at the Brazos County Pavilion according to the award of the bid and

and the agreement with the Brazos County Youth Livestock Association
and the receipt of their share of the funds for the project.
The Court next considered the following quotes for furniture

for the Distict Attonrey's Office:
Secretarial Desk with return and Executive Chair:
News Office Supply bid a total of $495.40
Advanced Business Equipment bid $299.00 on the desk but i
passed bidding on the Chair.
Engineering and Office Supply bid a total of $ 542.21

On motion by Commissioner Cooley, seconded by Commissioner Cargill,
the Court unanimously voted to accept the low bid of News Office
i
Supply and to amend the Budget if necessary to accommodate the
purchase of the equipment.
As a result of a letter received from the Criminal Justice !
Division of the Office of the Governor, in connection with a Grant

Application submitted by Brazos County for a Court Coordinator,
J. Bradley Smith, Judge of the County Court-At-Law was present

to request the Court to consider the resubmission of an amended
application before January, 1979. After discussion of the con-
ditions of the Grant, it was sugessted that Judge Smith obtain
further information from Claude Stewart, with the Brazos Valley !
Development Council on Criminal Justice Grants and return to the
meeting of the Commissioners' Court on November 27, 1978. j
On motion by Commissioner Cooley, seconded by Commissioner
Wilcox, the Court unanimously voted to approve the statement of
Thurmond and Stuart in the amount of $59,300.10 for work completed
at the Regional Multi-Use Facility.
The Court next considered Requests For Change In Status for
the following employees:
Linda Ricketson, District Clerk's Office
Helen B. McKinney, District Clerk's Office
John G. Gossett, Sheriff's Department
Larry A. Catlin, District Attorney's Office
Earl Clay, County Shop
Donna S. Goswick, Probation Department
On motion by Commissioner Cooley, seconded by Commissioner Wilcox,
the Court unanimously voted to approve the Requests as submitted.

3r viosly dedicated as a road and to accept the relocation
of Independence Avenue. On motion by Commissioner Stasny,
seconded by Commissioner Cooley, the Court uanimously

voted to approve the relocation of the right-of-way sub-
3ect to the approval of the Planning and Zoning Commission

t of the City of Bryan.

The Court next considered for approval a Memorandum Agreement
with Texas A & M University in connection with a previous agee-
ment by Brazos County to contribute $30,000 annually,for five years,
to support the capital improvement program at Easterwood Airport.

The County Judge advised the Court that this same Agreement had

been forwarded to both Cities for their consideration. On motion
by Commissioner Cooley, seconded by Commissioner Wilcox, the Court
unanimously voted to accept the Agreement and to authorize the County

Judge to execute same on behalf of Brazos County.

came on for hearing the Request for Preliminary Injunction in the (
above captioned and numbered cause, when came all parties, by and
through their respective attorneys of record, and announced to
the Court that they had entered into a compromise agreement
regarding the issuance of a Preliminary Injunction, and requested
that the Court approve said agreement. The Court, having heard
the arguments of counsel, and being fully advised in the premises,
is of the opinion that said agreed Injunction is proper and

ORDERED, ADJUDGED and DECREED that the Commissioners Court
of Brazos County, Texas, be, and the same is hereby enjoined from
canvassing votes after the general election to be held on November ~

only as to the following offices, those being the Brazos County
Commissioner Precinct Two, Brazos County Commissioner Precinct
Four; and Justice of the Peace Precinct Four, Place Two, Brazos

County, Texas. It is further,
ORDERED, ADJUDGED and DECREED that this Injunction shall in
no way affect the power of the Commissioners Court of Brazos
County to hold the general election on November 7, 1978, and to
fill vacant offices by appointment, as provided under the laws of
the State of Texas. It is further
ORDERED, ADJUDGED and DECREED, pursuant to State law,'that
any and all incumbents in the offices specified herein above
shall remain in office until successors are duly elected and
