I I COMMISSIONERS' COURT WORKSHOP SESSION AUGUST 29, 1978 The Commissioners' Court of Brazos County, Texas, met in workshop session on Tuesday, August 29, 1978, at 11:00 A. M. in the Commissioners' Couertroom of the Brazos County Courthouse Bryan, Texas, for the purpose of discussing rural fire protection. The following members of the Court and citizens were present: William R. Vance, County Judge, presiding Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; H. L. Cargill, Commissioner of Precinct 3; W. A. Stasny, Commissioner of Precinct 4; Debbie Ramsey, KBTX-TV Don P. Van Huss, Fire Chief, City of Bryan Douglas W. Landua, Fire Chief, City of College Station Sherry L. Albrecht, City of College Station North Bardell, City of College Station Hubert Nelson, City of Bryan John H. Godfrey, Probation Department K. L. S , c the response to fires whether it be on the part of the individual I i't • ~ I 4, 1'r reporting the fire or the organization receiving the report. I , 1 yl r + Many ideas were discussed but at this point there appeared j to be no workable solution to the problem. !1; The County Judge moved to continue full fire protedtion ser- vices in the rural areas until such time as all four Precincts ' could organize and equalize the rural volunteer fire departments and at that time to renegotiate with the Cities. At this time he pointed out that Precinct 3 volunteer fire department was well or- I ganized and in full operation, whereas Precincts 1, 2 and 4 were just getting started. The motion was seconded by Commissioner I Stasny. The motion carried with a vote of three AYES to two NOES. I ( 1 .J I 1 1 1 ` 4 II" i A ` 1 I + 11 ~ t A ' ' a 1 t ` V O L-2-PAGE-h p, 5 ~ THE STATE OF TEXAS j COUNTY OF BRAZOS j 1 AN AGREEMENT COUNTY OF BRAZOS - CITY OF BRYAN This agreement between the City of Bryan, a municipal corporation of the State of Texas, hereinafter referred to as "City," acting by and through its duly elected mayor, and the County of Brazos, hereinafter referred to as "County," acting by and through its duly elected county ,fudge, and the Commissioners Court of Brazos County, agree as follows 1 That the City agrees to furnish fire fighting equipment, supplies and personnel outside the city limits of the City for the benefit of the County until this agreement is terminated by proper notice The amount of aid, men and equipment sent outside the City shall be within the discretion of the City Fire Chief or his designated representative with priority being given to calls within the City 1 2. That the County will reimburse the City for all expenses incurred by the City in the furnishing of these services. The amount of the reim- bursement to the City will be based upon a sum of money per man hours of duty by City Fire Department personnel, a sum of money per engine mile of operation by City Fire Department mobile equipment, a sum of money for City Fire Department personnel fringe benefits pro-rated on the amount of time spent in service to the County in relation to total employment time by the City, and a sum of money for the cost to the City of all supplies, chemicals and products used in fighting fires or safeguarding persons or property from catastrophies or calamities The City will submit an itemized bill to the County each month setting forth the amounts owed to the City by the County, and the County shall pay each monthly bill within fifteen (15) days of the date on which the bill is submitted 3 The County agrees that any disadvantages that may accrue to the City i and affecting adversely the insurance experience ratings and/or premiums, resulting from the acts of any person or persons while fighting fires, traveling to or from fires or in any manner furnishing fire protection to the citizens of this County outside the city limits of the City shall be accepted as additional cost to the County 1 4 The County agrees to indemnify and hold harmless the City for any damages or injuries to employees, agents, workmen, or firemen of the City, or to any person or person's property as a result of answering or performing fire calls outside the city limits of the City. Should any person assert a claim, cause of action, or file a suit for damages to his person, or his property then the County agrees to defend all such claims, causes of action, or suits 5 The County agrees to indemnify and hold harmless the City for any damages or injuries to its fire fighting equipment while answering or traveling to or from, or engaged in, fire calls outside the city limits of the City 6. This agreement may be terminated by either the City or the County by the giving of thirty (30) days written notice of intent to terminate. ATTEST- CITY OF BRYAN Joe E.
