COMMISSIONERS' COURT
REGULAR MEETING
AUGUST 14, 1978
A regular meeting of the Commissioners' Court of Brazos
County, Texas, was held in the Commissioners' Courtroom in the
1
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
A. M. on Monday, August 14, 1978, with the following members of
the Court present:
William R. Vance, County Judge, presiding?
Bill J. Cooley, Commissioner, Precinct 1;
Walter Wilcox, Commissioner, Precinct 2;
H. L. Cargill, Commissioner, Precinct 3;
W. A. Stasny, Commissioner, Precinct 4;
Frank Boriskie, County Clerk.
The County Judge asked for approval of the Minites of the
Commissioners' Court meetings through June 12, 1978, noting that
all minutes had been distributed and posted. On motion by Comm-
issioner Stasny, seconded by Commissioner Cargill, the Court un-
animously voted to approve the minutes as submitted and ordered
them recorded in the permanent records of the County Clerk's Office.
The Court received, approved and ordered filed as submitted
the following reports for July, 1978:
W. T. Sistrunk, County Extension Agent;
Curtis Taylor, Jr., County Extension Agent;
LeRoy Grebe, County Extension Agent;
Mable Walker, County Extension Agent;
Wanda L. Pope, County Extension Agent.
The Court received, considered and approved the following
reports from County and Precinct Officers showing official fees of
office collected and remitted to the County Treasurer according to
duplicate copies of the Treasurer's Official Receipts attached
thereto.

The first matter
to come before the court was a
proposal from

Inc. for services and supplies
in connection

with the General Elect

to be held November 7, 1978. After discussion, and on motion by

" Commissioner Stasny, seconded by Commissioner Cargill, the Court
' 'unanimously voted to accept the proposal for services and supplies
in the amount of $7,200 and to authorize the County Judge to execute
i
` the contract.

Nest to come before the Court was the matter of bids for
I
equipment and construction for various departments in the County.
The County Judge noted that proper notification had been made by
publication for all bids received and proceeded to open the follow-
rj ing bids:
1. Bids for sealcoating various roads in Precinct 1 were
received from Cox Paving and R. T. Montgomery. After
reviewing the bids received Commissioner Cooley re-
quested that the award of the bids be deferred until
the meeting to be held August 28, 1978.

2. Bids for the purchase ofa used tractor for Precinct 1
were received from Cen-Tex Tractor Co., Inc. in the
amount of $2,200 and from Fountain Tractor Rental and
Sales, Inc. in the amount of $5,312. On motion by
Commissioner Cooley, seconded by Commissioner Cargill,
the Court unanimously voted to accept the low bid of
Cen-Tex Tractor, Co., Inc. in the amount of $2,200.
3. Bids for the purchase of a used truck for Precinct 1 'I
were received from Bud Ward Volkswagen. The County
Judge noted that this was the only bid received and '
it being in the amount of $3,150. On motion by Comm-
issioner Cooley, seconded by Commissioner Wilcox, the
I Court unanimously voted to accept the only bid received
in the amount of $3,150.
4. Bids for the installation of the north end of the Brazos
County Pavilion on Tabor Road. Bids received from J. R.
Loy Builders in the amount of $8,000 and from Marcal, Inc.
in the amount of $7,535. After a study of the bids
received and the services and materials bid on the bids
were referred to Mr. Ray Robertson who had drawn up the
plans for further study by him and for his recommendation
to the Court on August 28, 1978.
On motion by Commissioner Cargill, seconded by Commissioner
Cooley, the Court unanimously voted to pay $4,750 to the City of
Bryan and $2,208.51 to the City of College Station for fire calls
for July, 1978.

On motion by Commissioner Wilcox, seconded by Commissioner
Cooley, the Court unanimously voted to approve the folloiwng Public
Weighers Bonds: '
1. Donald J. Helton in the amount of $2,500 with United
States Fidelity and Guaranty as surety.
2.' William D. Hahn in the amount of $2,500 with United
States Fidelity and Guaranty as surety.
The County Judge advised the Court that the County's share
of surplus lateral road funds available through the Board of County
and District Road Indebtedness, as of August 31, 1978, would be the
sum of $20,177.89. Commissioner Wilcox moved that Brazos County
request that such sum be transferred to Brazos County for the con-
struction and improvement of the County's lateral roads. The motion
was seconded by Commissioner Cooley and carried unanimously.
The County Judge next laid before the Court the County's
Statement of Assurances for Entitlement Period Ten from the General
Revenue Sharing Office and asked the Court for authorization to ex-
ecute the statement and return it so that the County would continue
to receive Revenue Sharing Funds. On motion by Commissioner Cooley,
seconded by Commissioner Stasny, the Court unanimously voted to
authorize the County Judge to execute the Statement on behalf of
Brazos County.
The Court next considered the following statements for work

and services completed at the Regional Multi-Use Facility.
Soil Mechanics, Inc..;' $ 214.50

Jack Cumpton, Architect $ 5,253.33
On motion by Commissioner Wilcox, seconded by Commissioner Cargill,(
the Court unanimously voted to pay all three statements as submitted.

The Court next discussed a contract between the Railroad Com- `
mission of Texas and Brazos County. Such contract being for a study
of the problems in the area relating to the railroad and to be a
908/10$ grant with the Railroad Commission's share being $95,000
and the local monies to be in the 'amount of $9,500 to be contributed

Commissioner Wilcox moved that the County Judge be authorized to
}ti execute the contract subject to the receipt of an agreement from t
11?'rfi the two cities as to their inkind contributions. Motion was seconded '
by Commissioner Stasny and carried unanimously. I
The Court next considered Request For Change In Status for the

The Court next considered the followwng applications for

7 motor grader work and dozer work to be done at his property `

Charlie Patranella, 700 East 23rd Street, Bryan, requested

north of Bryan in Precinct 2.
On motion by Commissioner Stasny, seconded by Commissioner Wilcox,,

the Court unanimously voted to approve the applications as submitted.
The Court next consiaered for payment the following claims as
submitted by the County Auditor.

The Court reconvened at 1:30 P. M.'and proceeded to consider
' the following plats:
it Final Plat of CARRABBA INDUSTRIAL PARK, PHASE II, in
Precinct 2, After careful review of the plat Commissioner
Wilcox moved that the plat be approved as presented,
subject to the filing of the bond for the completion
of the roads and improvements. The motion was seconded
by Commissioner Cargill and carried unanimously.
2, Final Plat of MEADOWLARK FIRST INSTALLMENT in Precinct 4,
After reviewing the plat and on motion by Commissioner
Stasny, seconded by Commissioner Cooley, the Court un-
animously voted to approve the plat subject to the filing
of a $9,000 bond for the construction of the roads in
the subdivision.
3. Preliminary Plat of TIMBERWILDE SUBDIVISION, PHASE II,
in Precinct 3. On motion by Commissioner Cargill,
seconded by Commissioner Cooley, the Court unanimously
voted to approve the preliminary plat as submitted.
4. Final Plat of the resubdivision of POWERS SUBDIVISION,
SECTION I, in Precinct 4 and the extraterritorial jur-
isdiction of the City of Bryan. After a review of the
plat and discussion with the engineer the Court agreed
to defer action on the plat until the August 28, 1978,
meeting.
The Court next discussed a proposal for total insurance cover-
age for Brazos County as presented by George K. Mallard, Insurance
Agency. The premium for total coverage for a three year period
would be $51,393 and can be paid annually with a 40% down payment
f
with no interest charge on the second and third year period. After
hearing the proposal and coverage suggested under this plan, Comm-
issioner Cooley moved that the Court accept the proposal and to
authorize George Mallard to write the insurance coverage. Motion
was seconded by Commissioner Cargill and carried unanimously. Mr.
Mallard was directed to devise a formula for the division of the
commission earned on the premium to be paid.
The Court next heard a report from Jack Cumpton, Architect
regarding the construction of a juvenile facility on the Bridge
House property, and moving the Juvenile Probation Department to
that location. A report was also received from John Godfrey
Probation officer covering a work schedule for the Juvenile Pro
bction Officers if housed in the facility. There was no action

The Court next discussed the vacancy in the Office of the

Sheriff created by the death of J. W. Hamilton, on August 10, 1978.
Mr. George Hamilton, son of the late Sheriff was present and thanked

the Court for their support and cooperation during the many years
that his father served as Sheriff.

The County Judge announced that Bobby H. Yeager had been des-

ignated by the Commissioners' Court as the "Acting Sheriff" for
I
t. t
r
Brazos County, but that it was the duty of the Commissioners' Court
I

'
to appoint a successor to the position until the next General Election
w
`
in November. George Hamilton stated that he felt the public would
react better to a "Sheriff" than they would to an "Acting Sheriff"
and urged the Court to make an appointment at this time. After
'
r
hearing from all interested persons, Commissioner Cargill moved
S
that the Court appoint Bobby H. Yeager as the Sheriff for Brazos
t
County until the next General Election. Motion was seconded by
I
Commissioner Wilcox with Commissioners Wilcox, Cargill and Stasny
t
'
voting AYE. Commissioner Cooley announced present but not voting,
whereupon the County Judge announced that Bobby H. Yeager had
been appointed Sheriff of Brazos County and would serve in that
capacity until the next General Election upon the filing of the
I
proper bond with the County Clerk.
