The first item to come before the Court was the matter of
Weight Limit Regulations on roads and bridges in Brazos County.
This item having been deferred from the June 26, 1978, meeting.
The Court discussed the Traffic Engineering Study that was being
made for Brazos County and the possibility of incorporating the
results of the study into the Weight Limit Regulations. Commis-
I sioner Cooley moved to load zone all County roads and bridges
at a maximum gross weight of 588420 pounds effective August

1. Punishment For Violations: The Court should adopt +
tie Ines and penalties set forth in Section 6, Art.
6701g of the Texas Revised Civil Statutes as punish-
ment for violation of the Load Limit Regulation adopted
by the Court.
2. Permits For Overweight Loads: Tie Court should recog-
nize permits grants by the State Highway Department for
overweight loads on farm-to-market roads. That is, if
a vehicle is issued a permit by the State Department of
Highways and Public Transportation to transport loads
in excess of the load limits established for farm-to-
market roads that such permits will also allow such
vehicle to legally;'transport such loads on county roads
with no further permit or authorization being required.
By recognizing the state permits, the county would have
the registration and enforcement facilities of the State
Department of Highways and Public Transportation behind
it, without having to acquire the facilities or hire
the personnel that would be required to weigh vehicles,
grant permits and enforce a special permitting procedure
on county roads. The recognition by the Court of such
permits would allow free and unrestricted use by per-
mitted vehicles of the state highways, farm-to-market
roads and county roads but at the same time would pro-
vide the Court with the regulatory power that it desires.
3. Liabilit For Damage To Roads or Bridges: The Court
should adopt a regulation providing that the owner of
an overweight vehicle, whether possessing a permit or
not shall have the same liability for damage to the
county roads or briages that such person has with re-
spect to farm-to-market roads under section 5, Art.
6701d-16 of the Texas Revised Civil Statutes. That is,
that such owner shall be gtrictly liable for damage to
roads or bridges caused by the movement of an overweight
load.

It was further moved that if the results of the Traffic Engineering
Study should change the load limits on bridges, that the Regulations
on bridges be amended. The motion died for lack of a second.
Commissioner Cargill moved to load zone roads only at 58,420
pounds gross weight and that consideration of load zoning bridges
be deferred until the results of the Traffic Engineering Study is
completed and that Brazos County adopt the regulations as set forth
above in Commissioner Cooley's motion. The motion was seconded by
Commissioner Stasny and carried unanimously.

The Court next heard a request from the District Judge and
'District Clerk for authorization to hire an additional employee to

'be entitled "Docket Clerk" to handle the added duties imposed by

the District Judge. On motion by Commissioner Wilcox, seconded by
Commissioner Cargill, the Court unanimously voted to authorize the

District Clerk to hire a "Docket Clerk" at a salary to be set at
}
$3.30 per hour and that such authorization be effective immediately.

The Court next considered a request from the Board of Trustees
of the Brazos Valley Mental Health-Mental Retardation Center for,

a continuation of the monthly rental agreement of $1,800 per month

}'I and the consideration of a lease agreement for a one year period.
After discussion, and on motion by Commissioner Stasny, seconded
by Commissioner Cargill the Court unanimously voted to rent the
I second floor of the Courthouse Annex to the Mental Health-Mental
Retardation Center at the current montly rate of $1,800 but could
not agree to the one year lease agreement.

On motion by Commissioner Cooley, seconded by Commissioner
Stasny, the Court unanimously voted to pay $750 to the City of
Bryan for fire calls for the month of June, 1978.

The Court next considered Requests For Change In Status for
the following employees.

On motion by Commissioner Cooley, seconded by Commissioner Cargill,
the Court unanimously voted to approve the Requests as submitted.
On motion by Commissioner Cargill, seconded by Commissioner
Stasny, the Court unanimously voted to approve Certificates of
Cancellation numbered 10551 through 10555 and Certificates of
Correction numbered 1315 and 1316 as presented by the Tax Assessor-
Collector.

Next to be disucssed was reallocation of the Road and Bridge
Budgets by Precincts. George,Smith, Assistant Auditor presented a
study of the figures compiled by the Auditor's Office in regard to
the Road and Bridge Account. After hearing the presentation, Com-
i
missioner Cooley moved to authorize the County Auditor to transfer
all soil conservation money to the respective budgets by transferring
I
actual cash dollars to the Road and Bridge Bank Account, to amend
the revenue section of the Road and Bridge Budget to accomodate
I
the transfer, to amend the transfer section of the appropriations
and to amend the Precinct Budgets to show the revenue and appropria-
tions of the transfer. Motion died for lack of a second. The
County Judge moved to authorize the County Auditor to change the
accounts now styled "Soil Conservation Funds" to "Road & Bridge
General II (Soil Conservation)" and that such funds be accounted
for as a separate, identifiable part of the Road and Bridge Budget
and that no funds be expended therefrom without being appropriated
by the Commissioners' Court. It being intended that funds in this
section of the Road & Bridge Budget be carried over from year to
year, by Precinct. The motion was seconded by Commissioner Wilcox
with Commissioners Cooley, Wilcox and the County Judge voting AYE.
Commissioners Cargill and Stasny voted NO whereupon the County Judge
announced the motion carried.

The Court next considered for payment Claims numbered 1771
through 1893 from the Genral Fund. Such Claims being presented
by the County Auditor. Motion was made by Commissioner Wilcox
for the payment of the Claims as submitted. Commissioner Cooley
seconded the motion with Commissioners Cooley, Wilcox and Cargill
voting AYE. Commissioner Stasny abstained.
There being no further business to come before the Court at
this time the Court recessed until 1:30 P. M.

The Court reconvened at 1:30 P. M. and considered for approval ,

the following Plats.
1. Preliminary Plat of MEADOWLARK SUBDIVISION, FIRST
INSTALLMENT in Precinct 4. After careful review
of the plat Commissioner Stasny moved to approve
the plat subject to the following additions and
amendments.
a. That the Developer provide for a temporary turn-
around on Meadowlark Circle.
b. That the Developer tap the adjoining property with
Meadowlark Circle

The motion was seconded by Commissioner Cooley and carried unan-
imously.

Pursuant to action taken at an earlier meeting the County ,

Judge asked for further discussion on rural fire protection. His

primary request being for clearance to add an item regarding struc-
ture fires to the list of amendments to the County's fire protection
contract with the Cities and with an initiation date of September
1, 1978. After hearing from interested persons in the audience and
discussion of the Court, Commissioner Wilcox moved to authorize the

addition of an item covering structure fires to the County's request
to the Cities. Motion was seconded by Commissioner Cargill and
{
carried unanimously. A copy of such letter from the County Judge
to the two Cities is attached to and made a part of these minutes.

The Court next discussed the County's present insurance cover-

age on county buildings and property and liability coverage on

County vehicles. It was generally decided to consider the matter
at the meeting to be held August 14, 1978.
There being no further business, the Court adjourned.

After that date, Brazos County desires to pay for fire calls
outside your respective Cities only when fire assistance is I
requested in one of the following manners:
1. By an officer of a Precinct Volunteer Fire Dept.
2. By any law enforcement officer "
3. By a County Commissioner
4. By any private individual who requests'assistance
for a building structure fire or where a building i
{ structure is in imminent danger and, in either
event, such private individual gives his name,
I address and telephone number.
We appreciate the service which we have received in the past.
We look forward to continuing this agreement with these mod-

ifications.
