COMMISSIONERS' COURT
SPECIAL MEETING
MAY 22, 1978
A meeting of the Commissioners' Court of Brazos County,
Texas, was held in the Commissioners' Courtroom of the Brazos
County Courthouse, Bryan, Texas, beginning at 10:00 A. M. on
Monday, May 22, 1978, with the following members of the Court
present:
William R. Vance, County Judge, presiding;
Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
H. L. Cargill, Commissioner of Precinct 3;
W. A. Stasny, Commissioner of Precinct 4,
Frank Boriski.e, County Clerk.
The Court first considered a statement from Davis, Stacy
and Lohmeyer for legal services in connection with the Walter
Joe Coleman case in the amount of $3,000. The firm was appointed
by the District Court as defense attorneys for Mr. Coleman. On
motion by the County Judge, seconded by Walter Wilcox, the Court
unanimously voted to pay the statement.
Next to be considered was a request by the Department of
Highways and Public Transportation for the relocation of three
,electric utility poles in the Villa Maria Extension right-of-way.
After discussion Commissioner Stasny moved to authorize the County
Judge to direct the City of Bryan to relocate the utilities poles.
The motion was seconded by Commissioner Cargill and carried unan-
imously.
Richard Smith, Mayor for the City of Bryan was present and
requested the County to consider allowing the City of Bryan to
acquire a section of property off the west end of the Livestock
Area property for a fire station site.' After discussion Commiss-
ioner Wilcox moved to reject the request and proposal and to assist
the City in obtaining a different site'in the same vacinity. The
motion was seconded by Commissioner Cargill with Commissioners
Wilcox, Cargill and Stasny Voting AYE. Commissioner Cooley voted
NO.

r''3 Next to be considered was a request by the Brazos Countyl
Senior Citizens Assocation of tax exempt status for a 1.33 acre
t
tract of land located at the corner of Bristol and 29th Street
in the City of Bryan. Such property to be used as the future
' site for the Senior Citizens Center. On motion by Commissioner
Wilcox, seconded by Commissioner Cargill, the Court unanimously
voted to grant the exemption from ad valorem taxation and to

` notify the County Tax Assessor-Collector.

y The Court next considered a request by the Saints Rest Baptist
I
Church in Steep Hollow for a Quit-Claim Deed for property formerly
used for a county school. This matter was deferred pending a
.
more clearly defined description of the property
Brazos County, having previously advertised for bids for an
air handler to be installed at the Courthouse Annex proceeded
open and consider the only bid received. On motion by Commissioner
Wilcox, seconded by Commissioner Cooley, the Court unanimously
voted to accept the bid of Baggerly Service Company in the amount

of $4,435, subject to the approval of Mr. Dobbins on the type of
equipment bid.
On motion by Commissioner Cargill, seconded by Comm-
issioner Cooley, the Court unanimously voted to pay $1,484.75 to
the City of College Station and $1,650.00 to the City of Bryan
for fire calls made for the month of April, 1978. At this time
Commissioner Cooley presented a petition from citizens in this
precinct concerning an amendment to the budget in connection
with the payment of fire calls.
On motion by Commissioner Cargill, seconded by Commissioner
Cooley, the Court unanimously voted to grant authorization to
Wixon Water Supply Corp to lay a 41nch water line across Dyess
Road in Precinct 3.
The next matter to come before the Court was the appointment of
two members to the Board of Directors of the Brazos Valley Develop-
ment Council. The County Judge advised the Court that the three

year term of Vera Martinez and his term had expired. On motion
by Commissioner Cooley, seconded by Commissioner Cargill, the
Court unanimously voted to reappoint- Vera Martinez for a three
year term ending June 30, 1981, and to reappoint Judge Vance
whose term would automaticly expire at the end of his term of
office on December 31, 1978.
Next to be considered was the Change In Status of the following
employees:
Earl Clay, Precinct 3
George E. Minor, Precinct 1
Randy Engle, Precinct 1
On motion by Commissioner Cooley, seconded by Commissioner Cargill,
the Court unanimously voted to approve the Changes as submitted.
On motion by Commissioner Cooley, seconded by Commissioner
Cargill, the Court unanimously voted to approve Claims 1266 through
1316 of the General Fund as presented by the County Auditor for
payment.
1:30 P. M.
The Court reconvened at 1.30 P. M. and considered the following
plats:
1. Preliminary Plat of East Industrial Park in Precinct 2 and
the extraterritorial jurisdiction of the City of Bryan.
After careful examination of the plat Commissioner Wilcox
moved to approve the plat subject to the following amend-
ments:
a. Cut corners at intersection of highway 21 to 25 foot
turn-out
b. Addition of 50 foot set back line on highway 21.
c. Addition of drainage easement on all cul-d-sacs.
d. Addition of 16 foot utility easements.
e. Consider changing the name of the site.
f. Addition of 80 foot right-of-way on Crosswinds Drive.
g. Addition of names of adjoining property owners.
The motion was seccnded by Commissioner Cargill and carried
unanimously.
The Court next heard a presentation by Jean Marsico in conn-'
ection with the Child Welfare Budget for 1978. After hearing the
explanation of why the Budapt was nnmincs hAfnra the Cnur* a#' fhin
time and of the increase, Commissioner Cooley moved that the amount
of $6,000 be added to the amount budgeted for the Child Welfare
Board and to amend the County Budget to accomodate the increase.

The motion was seconded by Commissioner Wilcox and carried un-
animously.
The Court next heard a presentation by Bernard Weller of
the National Humane Society who presented a picture of the animal
,
control problem in Brazos County and the Cities of Bryan and
College Station. Mr. Weller offered the assistance of the Humane
Society in initiating a procedure for animal control for Brazos
County.
