SPECIAL MEETING
= SEPTEMBER 26, 1977
A,meeting of the Commissioners' Court of Brazos'County, Texas,
was held in the Commissioners' Courtroom in the Courthouse in Bryan,
Brazos County, Texas, beginning at 10:00 A. M. on Monday, September
26, 1977, with the following members of the Court present:
W. A. Stasny,lc8mmissioner, Precinct 4, presiding;
Walter Wilcox, Commissioner, Precinct 2;
H. L. Cargill, Commissioner, Precinct 3;
Frank Boriskie, County Clerk.
The following citizens and officials were in attendance:
Lillian Sterling, Booneville Cemetary Assoc.
Shirley J. Jones, Booneville Cemetary Assoc.
Terri Choate, League of Women Voters.
John Godfrey, Probation Department
Buddy Winn, Tax Assessor-Collector
Steve Stites, WTAW
B. J. Kling, Kling Engineering and Surveying
Mary Nichols, County Auditor
Jane Smith, The Eagle
The first matter to be discussed was the purchase of a duplicating
machine for the Probation Department at a total cost of $2,875.00 to
be paid out of the 1978 equipment budget for that department. After
discussion the Court deferred action on the matter until such time
as the County Judge could be consulted regarding the equipment budget.
Next to be considered was the payment of fire calls made by the
City of Bryan in the amount of $2,100. After discussion of various
calls, Commissioner Wilcox moved to pay the statement subject to the
County Judge discussing two of the fire calls with the fire chief.
.Motion was seconded by Commissioner Cargill and carried unanimously.
On motion by Commissioner Cargill, seconded by Commissioner

Wilcox, the Court unanimously voted to pay the statement of Spencer
~i
J. Buchanan and Associates in the amount of $619.34 for services in -
connection with the Brazos County Park project.
On motion by Commissioner Wilcox,.seconded by Commissioner
„,-Cargill, the Court unanimously voted to'pay the statement of Jack.

W. Cumpton,•and Associates in the amount of $1,300 for,services
in connection with the Brazos County Park project.
Next to be considered were Requests For Change In Status for
the following employees:
it Sherril Hammond in the Health Department,
Archie P. Clark,'in the Sheriff's Department
On motion by Commissioner Cargill, seconded by Commissioner Wilcox,
the Court unanimously voted to approve the Request of Sherrill
Hammond in the Health Department and deferred action on the Request
for Archie P. Clark until the bctober meeting.
The Tax Assessor-Collector next presented a request by Mrs.
Mary, Ruth Hensarling for refund of the County's portion of the

sale's tax and. state stax collected' for the purchase of a' new .

Chevrolet stating that the safe "fell through". Such amount of
tax to be $11.17. On motion by Commissioner Wilcox, seconded by
Commissioner Cargill,,the Court unanimously voted to refund the
tax money, subject to the refund by the State of Texas.
On motion by Commissioner Wilcox, seconded by Commissioner '
Cargill, the Court unanimously,voted to approve Claims 1893 through
{ 1962 in the General Fund as presented by the County Auditor.
The "Court heard a presentation by the Texas Department of
Highways and Public Transprtation respecting the installation of
curb and gutter along a roadway known as Metropolitan Highway No.
I 240, (Villa Maria Road Extension) within the limit from Farm to
Market Road No. 2818 to Finfeather Road. The State presented a
proposed agreement between the State and Brazos County, a copy of
which is attached to these minutes.
After discussion, Commissioner Wilcox moved, seconded by Comm-
issioner Cargill, to authorize the County Judge to execute such
agreement with the State,'after execution of an agreement with the
Braver Corporation, the adjoining property owner, whereby the Braver
Corporation would make the initial deposit of funds required and
reimburse Brazos County for all addition funds necessary. All present
voted AYE. None voted NO, and it is so ordered.

The Court next reviewed the following plats:
1.'. Preliminary Plat of a portion of DEERFIELD ESTATES in
Precinct 1. On motion by Commissioner Cargill, second-'
ed by Commissioner Stasny the Court unanimously voted
to approve the plat-subject to the following corrections:
a, easement for drainage of cul-d-sacs
b. intersection set back on'Fawn Lane.
2.
Preliminary Plat of VILLA FOREST in Precinct 4, and the
extraterritorial jurisdiction of the City of Bryan. On

motion by Commissioner Stasny, seconded by Commissioner
Cargill, the Court unanimously voted to approve the plat
=
as submitted, subject to the approval of the Planning
and Zoning Commissioner of the City of Bryan..
3.
Final Plat of a Resubdivsion of WESTWOOD ESTATES in
' o
Precinct 4 and the extraterritorial jurisdiction of
of the City of Byran. On motion by Commissioner Wilcox,
seconded by the Commissioenr Stasny, the Court unan-
imously voted to approve the plat subject to the approval
of the Planning and Zoning Commission of the City of Bryan.
' On
motion by Commissioner Cargill, seconded by Commissioner
Wilcox,
the Court unanimously voted to authorize the purchase of
one IBM
Correcting Selectric typewriters for the Sheriff's Dept.
There being no further business, the Court adjourned.

September 26, 1977, !were examined and approved in open Court this

between Brazos County, Texas, hereinafter called the "County", Party of the
First part, acting by and through its Commissioners Court and the State of
Texas, hereinafter called the "State", Party of the Second Part, acting by
and through its State Highway and Public Transportation Commission.
WHEREAS, the County desires the construction of concrete curb and
gutter, storm sewer system and incidental items within the limits from Farm
to Market Road No. 2818 to Finf eather Road in Bryan and College Station on
Metropolitan Highway No. 240, which is-solely the County's responsibility
and the County has requested the State to construct or have constructed

this work. The State will construct or have constructed this work for and
on behalf of the County-and,at the County's sole expense, excluding pre-
liminary engineering. The estimated construction cost of this work is
Forty Four Thousand One Hundred and No/100 Dollars ($44,100.00), including-
' contingencies and construction engineering.,
NOW THEREFORE, it is understood that this proposed work will be
constructed by the State and the County will transmit to the State with '
the return of this agreement, executed by the County, a warrant or check .
made payable to the State Treasurer, Account of Trust Fund No. 927 in the
amount of Forty Four Thousand One Hundred and No/100 Dollars ($44,100.00),
to be used in paying for the proposed work required by the County. It is
further understood that the,State-Hill construct only those items for the

County as requested and required by the County and the entire cost of such
items, excluding preliminary engineering, will be borne by the County. If
the state'elects to receive bids and if upon receipt of bids by the State and/
or the actual construction and/or-approved changes in the contemplated im-
provements it is found that this amount is insufficient to pay the County's
portion, then the County upon request of the State will forthwith supplement
this amount by an amount equal to the County's full estimated or actual share
of the coat of this work less the amount previously paid into Trust Fund No.
997. In the event the-amount as paid is more than the actual cost, then the
exeess amount will be -returned to the County. It is further understood that
the work to be done on behalf of the County, as herein provided, will include
the cost of contingencies and construction engineering.
IN TESTIMONY WHEREOF, the parties hereto have caused these presents
