Home My WebLink About1977-07-26-1000AM-Specialw®LhpAGES COMMISSIONERS' COURT SPECIAL MEETING JULY .26•, 1977 A meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 a.m., on Monday, July 25, 1977, with the following members of the Court present: William R. Vance, County Judge, presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; H. L. Cargill, Commissioner of Precinct 3; Frank Boriskie, County Clerk. The following citizens and Officials were in attendance: Suzanne Black, KBTX-TV Marla Gammon, KTAM Jane :Mills Smith, The Eagle Steve Stites, WTAW B. G. Bockmon, SDH & PT John A. Cumpton, Jack Cumpton & Associates The Court heard a presentation. by the Texas Department of Highways and Public Transportation respecting the installation of curb and gutter along approximately 450 feet of Metropolitan High- way 154 (Briarcrest Extension). The State presented a proposed agreement between the State and Brazos County, a copy of which is attached to these minutes. After discussion, Commissioner Cooley moved, seconded by Commissioner Cargill, to authorize the County Judge to execute such i i r{ J I~ : agreement with the State, after execution of an agreement with Dr. R. H. Harrison, the adjoining property owner, whereby Dr. Harrison would make the initial deposit of funds required and reimburse Brazos County for all additional funds necessary. All i present voted Aye. None voted No, and'It is so Ordered. Next to be considered was the appointment of a member to the Brazos County Child Welfare Board to fill the vacancy created by the resignation of Jesse Vivero. On motion by Commissioner Wilcox, seconded by Commissioner Cooley the Court unanimously voted to appoint Mrs. Robert Otterstad, she being one of the per- sons nominated by Reverend Hubert Beck. The County Judge advised the Court of the resignation of Travis B. Bryan III from the Board of Trustees of the Brazos Valley i Mental Health - Mental Retardation Center and recommended the appointment of Mrs. Thelma van Overbeek to fill the vacancy. On motion by Commissioner Wilcox, seconded by Commissioner Cargill, the Court unanimously voted to appoint Mrs. van Overbeek to the j Board for a two year period ending March 31, 1979. Next to be considered was a request by Brazos Valley Utilities Inc. for authorization to place a water line within the right- of-way of Briarcrest Drive, perpendicular to Station 22 & 55. J After careful review of the drawings submitted and the approval of the State Department of Highways and Public Transportation, Commissioner'Cargill moved that authorization be granted to bore the right-of-way. Motion was seconded by Commissioner Coc•_ey and carried unanimously. Such authorization is subject to the following conditions: 1. That Brazos Valley Utilities, Inc. or its contractor must notify the Commissioner of the Precinct in which the right-of-way lies prior to the beginning of con- struction in order that the Commissioner might be on hand to designate the actual location of the installation. 2. That Brazos Valley Utilities, Inc. or its contractor will repair all damage to the roadways and rights-of- way to their original condition to the satisfaction of the Commission in which the roadway or right-of-way lies. -2- V®L-J-VPAGE2Z , VO1L-,6/ PAGE . 3. That Brazos County reserves the right to require Brazos Valley Utilities, Inc. to relocate or lower any such line at no cost to Brazos County, should same become neces- sary due to the widening or lowering, or other alteration of the roadway or right-of-way. 4. That Brazos County will in no way be responsible for any damage that might occur to any existing utility lines in the right-of-way. The Court, having previously authorized the purchase of a Type III Ambulance through the Emergency Medical Services of the Brazos Valley Development Council, proceeded to consider their Statement for Payment. Commissioner Cargill moved that the sum of $9,655.00 be paid to the Brazos Valley Development Council (BVDC) for the vehicle, and to amend the budget to accomdate the payment. Such amount being the county's share of 50% of the total cost of the ambulance. Motion was seconded by Commissioner Cooley i l and carried unanimously. Next to be considered were Requests For Change In Status Of Employees for the following: Gail Louise Miller - County Treasurer's Office Barbara Ann Robinson - Janitorial Department Billy Terrell - Precinct 1 On motion by Commissioner Cooley, seconded by Commissioner Wilcox, the Court unanimously voted to approve the requests as submitted. The Court proceeded to the consideration of claims numbered 1423 through 1492 in the General Fund, submitted by the County Auditor. On motion by Commissioner Wilcox, seconded by Commissioner Cooley, the Court unanimously voted to approve the payment of such claims as submitted. Next to be discussed was the realignment of voting precincts and Commissioner precincts. Commissioner Cooley stated that due to the requests of a number of residents and the unequal number of registered voters in the voting and Commissioners' precincts, he felt that this matter needed to be considered by the Court. The Court proceeded to the opening and consideration of the following bids for the purchase of a front-end loader for Precinct Two. Mustang Tractor and Equipment Company - $32,304.00 Plains Machinery Company ' - $29,985.00 Commissioner Wilcox moved to accept the bids of Mustang Tractor and Equipment Company in the amount' of $32,304.00 stating that Plains Machinery Company did not meet the published specifications, and that Precinct two (2) be authorized to issue a Time Warrant to the First National Bank, Bryaci, Texas, in the amount of $21,000. for ene purchase of the equipment. T"_otion was seconded by Commissioner Cooley and carried unanimously. 4:00 P.M. The Commissioners' Court, having advertised for bids for the construction of a Multi-Use Facility at the Brazos County Park, received the following bids From Jack Cumpton, Architect for the project: Thurmond & Stuart - Base Bid $1,485,000.00 R. B. Butler, Inc.- Base Bid $1,552,148.00 ; Spaw-Glass, Inc. - Base Bid $1,592,000.00 Jones & Williams - Base Bid $1,630.000.00 ' Marcal, Inc. - Base Bid $1,593.000.00 The County Judge announced that all bids were over budget for the project, and suggested that they be referred to the Architect for further study. All members present were in agreement. WHEREAS, the County desires the construction of concrete curb and gutter,. inlets, and incidental items within the limits from Station 29+00 to Station 35+52 on the right on Metropolitan Highway No. 154, which the County has requested the State to construct or have constructed. The State will con- struct or have constructed this work for and on behalf of the County and at the County's'sole expense, excluding preliminary engineering. The estimated construction cost of this work is Six Thousand Six Hundred and No/100 Dollars ($6,600.00), including contingencies and construction engineering. N014 THEREFORE, it is understood that this proposed work will be con- structed by the State and the County will transmit to the State with the return of this agreement, executed by the County, a warrant or check made payable to the State Treasurer, Account of Trust Fund No. 927 in the amount of Six Thousand Six Hundred and No/100 Dollars ($6,600.00), to be used in paying for the work proposed by Field Change Request No. 1 on project M J018(1). It is further understood that the State will construct only those items pro- posed by Field Change Request No. 1, and the 'entire cost of such items, excluding preliminary engineering, will be borne by the County. If during ' the construction of those items proposed by Field Change Request No. 1 it is found that this amount is insufficient to pay the County's portion, then the County upon request of the State will forthwith supplement this amount by an amount equal to the County's full actual share of the cost of this work less the amount previously paid into Trust Fund No. 927. In the event the amount as paid is more than the actual cost, then the excess amount will be returned to the County.
