HomeMy WebLinkAbout1977-06-13-1000AM-RegularCO?•1iMISSIONERS' COURT REGULAR MEETING 'JUNE 13, 1977 6 A regular meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A. M. on P4onrlay, June 13, 1977, with the following members of the Court present: William R. Vance, County Judge, presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; H. L. Cargill, Commissioner of Preicnct 3; W. A. Stasny, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The minutes of the previously held meetings were examined and approved without change. The Court received, approved and ordered filed as submitted the following reports for May, 1977: W. T. Sistrunk, County Extension Agent; Curtis Taylor, Jr., County Extension Agent; LeRoy Grebe, Jr., Coungt Extension Agent;, Mable'Walker, County Extension Agent; ~i 'Wanda L. Pope, County Extenison Agent. Burley, District Clerk Judy Donaldson, KTAM Bradley Smith, Judge County Court At Law .-i i The Court listened to a presentation by Mr. Virgil Litchford, Comander of VFW Post 4692 who requested the placement of a monument on the Courthouse grounds in memory of all Brazos County veterans who fought and died in all wars. Mr. Litchford proposed that the County and the VFW participate on a 50-50 basis for the purchase of r the monument. It was the consenus of the Court that they would con- sider the matter and requested Mr. Litchford to contact the other veteran organizations in Brazos County so that'it could be a County- wide venture. The Court next recognized Mr. D. A. "Andy" Anderson, represent- ing the Brazos County Arboretum Committee who requested the allocation of $3,000 to the Committee for additional trees to be placed in the Arboretum. After much discussion, Mr. Anderson was advised that the County would consider the realocation of the $2,000 budgeted for Oral History when the Committee could submit their articles of inc- orporation making them a legal intity and an agreement between the City of College Station and the Committee allowing the Committee to do work on city property, however the $1,000 would be a separate matter to be considered. The Court next heard from Dr: Cornelius van'Bavel representing the Harvey Community Center who requested,~the.reestablishment of a polling palce at the Community Center 'for the citizens of the Harvey community. Dr. van Bavel informed the Court that there are over 400 residents in the area and that-the Community Center building is presently being restored and that they would offer it to the County for the use of the polling place. Dr. van Bavel stated that a poll- ing place in that area would not only benefit the citizens in the Community but would also help to reestablish the identity of the community. Commissioner Cooley advised the Court that he has had several requests regarding the voting precincts and felt that the time was at hand for the County to look into the matter of reaportion- ment of the County. Dr. van Bavel was advised that the time to con- sider this matter was in'the months of July and August and was assured that the matter would be given some consideration. Mrs. Lola Thompson, representing the Brazos County Senior Citizens Center was present to request the continued support of Brazos County for their Center. The County Judge stated that he felt the $5,700 ; budged for 3.976 and not used should be allocated for 1977, thereby increasing the 1977 allocation to $25,700, in order to get the Center's funding period in line with the County budget period. Commissioner Wilcox moved that such action be taken by the Court. Motion was sec- onded by Commissioner Cooley and carried unanimously. Judge Bradley Smith, Judge of the County Court At Law was present ~.n support of his letter previously delivered to the Court requesting them to determinewhether the Court considers the position of Judge of The County Court At Law a part-time position or full-time position. Judge Smith advised the Court that the Supreme Court of Texas had amended the compliance provision of the Code of Judicial Conduct to removed the law practice prohibiation from part-time judges. Judge Smith further advised the Court that this determination fell within the.duties of the Commissioners' Court. I Commissioners' Court, Regular Meeting - June 13, 1977..0696 because of the Code of Judicial Ethics adopted by the Supreme Court of Texas. Commissioner Wilcox moved that the salary of the Judge of County Court At Law be increased to $20,000 annually effective July 1, 1977. Motion was seconded by the County Judge with Commissioner Wilcox and the County Judge voting AYE. Commissioners Cargill, Cooley and Stasny voted NO, whereupon the County Judge announced the motion failed. Next to be considered was the Preliminary Plat of THE WOODLANDS in Precinct 1 and the Extra-territorial Jurisdiction of the City of College Station. On motion by Commissioner Cooley, seconded by Comm- issioner Cargill, the Court unanimously voted to approve the plat subject to the following corrections: 1. Beginning of the subdivision be set back 35 feet from the center of Dowling Road. 2. Dedication for drainage. 3. Approval of the Planning and Zoning Commission of the City of College Station. On motion by Commissioner Cooley, seconded by Commissioner Stasny, the Court unanimously voted to approve the Public weigher's Bond of • W. H. Henry, Jr. in the amount of $2,500 with United States Fidelity and Guaranty as surety. Next to be considered were applications for soil conservation work as follows: ~ 1. Marvin Shealy, Rt. 3, Bryan, reqeusted approximated 3 hours grader work to be one off Riley Road in Precinct 3. On motion by Commissioner Cooley, seconded by Commissioner Wilcox, the Court unanimously voted to approve the application and authorized the Commissioner to do the necessary work. The Court proceeded to consider Requests For Change In Status of Employees as follows: Jim Scherff, Tax Office Gary M. Gray, Precinct 3 Carl M. Raymond, Precinct 2 Stephen R. Browning, Precinct 2 On motion by Commissioner Cargill, seconded by Commissioner Wilcox, the Court unanimously voted to approve the Requests as submitted. Precinct 1 Claims 107 through 130 4 Precinct 2 Claims 107 through 137 Precinct 3 Claims 79 through 100 Precinct 4 Claims 91 through 111 Probation Department Claims 89 through 105 • Revenue Sharing Fund Claims 54 through 70 I on motion by Commissioner Stasny, seconded by Commissioner Cargill, 4 the Court unanimously voted to approve such Claims as submitted. There being no further business at this time the Court recessed until 1:30 P. M. 't The Court reconvened at 1:30 P. M. and the first matter to be discussed was the use of the County Modulance by the City of College Station. After much discussion Commissioner Stasny moved to term- i' inate College Station's use of the Modulance effective August 31, 1977. Motion was seconded by Commissioner Wilcox, with Commissioners Wilcox, Cargill, Stasny and the County Judge voting AYE. Commissioner Cooley voted NO, whereupon the County Judge announced the motion carried. Gerald L. Winn, Tax Assessor-Collector requested the Court to ' ; determine the amount of money to be charged for the sale of voter J registration lists to the public. After discussion, Commissioner Stasny moved to set the charge at $.02 per name. Motion was seconded by Commissioner Cooley, with Commissioners Wilcox, Stasny, Cooley and the County Judge voting AYE. Commissioner Cargill voted NO. j Mr. D. D. Williamson with the State Department of Highways and Public Transportation advised the.Court of the availability of State '1 f r Commissioners' Court, Regular Meeting - June 13, 1977...... funds for a traffic engineering study for this area on an 80%-20% funding basis. Mr. Williams stated that that the two Cities were interested in,the study and would be willing for the County to make application to the State for such funds for the study on a county- wide basis. The County Judge stated that the County would need a resolution from the two Cities stating that they were in agreement with this plan. Commissioner Cooley moved that the County make app- ' lication to the State for the funds for the study upone receipt of r the resolutions for the Cities. Motion was seconded by Commissioner' Wilcox and carried unanimously. On motion by Commissioner Wilcox, seconded by Commissioner Cooley, the Court unanimously voted to pay $450.00 to Hogan Con- s-.-ruction Co. for the purchase and installation of one "T" in the Briarcrest water service line by the County Park Site. This "T" to have a six-inch stub-out with a six-inch valve. The Court next considered the Final Plat of OAK HOLLOW ACRES, PHASE III, in Precinct 3. On motion by Commissioner Wilcox, seconded by Commissioner Stasny, the Court unanimously voted to approve the Plat subject to the elemination of the 60' easement and moving the subdivision boundry line over 60 feet. Commissioner Cargill abstained from voting. On motion by Commissioner Cooley, seconded by Commissioner Cargill, the Court unanimously voted to purchase four (4) IMB Model 721 type- writers for the County Tax Office for a total amount of $2,070.00..
