M. on Monaay, April 11, 1977, with the following members of the Court present:` William R. Vance, County Judge, presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; H. L. Cargill, Commissioner of Preiinct 3; W. A. Stasny, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The minutes of the previously held meetings were examined and approved without change. The Court received, approved and ordered filed as submitted the following reports for March, 1977 W.'T. Sistrunk, County Extension Agent; Curtis Taylor, Jr., County Extension Agent; LeRoy Grebe, Jr., Coungt Extension Agent; Mable Walker, County Extension Agent; Wanda L. Pope, County Extenison Agent. Powers, J.E. Powers Plumbing, Inc. . Royce Watson, Brazos County Volunteer Fire Dept. Precinct 3. James H. Williams, Jr., Bryan County Volunteer Fire Dept. Carl Fisher, Kustom Signals Ed Pfeiffer, MPH Industries, Inc. Jerry Gray, The Eagle William Benford Dale Watson, Brazos County Fire Department 'Alan Sayre, WTAW - AM-FM Mary Nichols, County Auditor Jack Hodges, KBTX-TV Bill Payne, Attorney Raymond B. Buxhanan, Tax Collector-Assessor Jack Cumpton, Bryan ' E . E'. Merrell, Bryan The Court first discussed a request by Ramero Galindo to serve as the instrument between The Braver Corporation and the State of Texas for curb and gutter streets on Villa Maria Extension in Villa West Sub- divisions. After discussion Commissioner Stasny moved that the County act as such instrument for the purpose of getting the road curbed and guttered. Motion was seconded by Commissioner Wilcox and carried unanimously. The Court proceded to discuss the matter of curb and gutter of six-hundred feet of road to serve as a left hand turn-out, at the Finfeather Intersection. Commissioner Cargill made a motion to pay for -the,curb and gutter modifications to Villia Maria Road out of the State Lateral Road Fund, not the exceed $3,000.00, and to allot $10,000.00, to each Precinct out of the State Lateral Road Fund for use on the County's Roads. Motion was seconded by Commissioner Wilcox and .carried unanimously. The Court next received a Proposed Budget for the Brazos County Precinct 3 Volunteer Fire Department, in the amount of $13,200.00, presented by James Williams, Vice President of the Organization. After discussing the items on the budget, Commissioner Cooley moved that the Budget be approved as submitted with monies to be paid out of the 'General Fund Fire Protection. Motion was seconded by Commissioner Cargill and carried unanimously. The Court next considered a request by Kenneth Powers to bore under Turkey Creed Road in Precince 4, to install sewer and water lines to the Texas A & M University Horse Barn. Mr. Powers was ad- vised that the Court would require a written request from the University and the permit would be issued to the University. That the University or its contractor must notify the Commissioner of Precinct 4 prior to the beginning of consturction in order that the Commis- sioner might be on hand to designate the actual location of the installation. 2. That the University or its contractor will repair all-damage to the roadway and right-of-way and restore the roadway and right-of-way to their orig- nal condition and satisfaction of the Commissioner of Precinct 4. •3: That Brazos County reserves the right to require the University to relocate or lower any such line at no cost to Brazos County, should same become necessary due to the widening, lowering, or other alteration of the roadway or right-of-way 4. That.Brazos County will in no way be responsible for any damage that might occur to.any existing utility lines in the right-of-way. The Court again considered the purchase of four Moving Radar Units to be used by the Department of Public Safety in Brazos County, and heard presentation by Mr. Ed Pfieffer, representing M P H Inc. and Carl Fisher representing Kustom Signals. After hearing the presentations and discussion the Court deferred action to the April 25, 1977 meeting to allow the Court time to study the matter further. The Court next reviewed the Preliminary Plat of Villa Forest in Precinct,'4 and the Extra Territorial Jurisdiction. On motion by Commissioner Stasny, seconded by Commissioenr Cooley the Court unanimously approved the preliminary plat as submitted. Raymond B. Buchanan, Tax Assessor-Collector was present to re- quest the employees of his office be paid time and half for the ovetime. hours worked during automobile'registration. After discussion of the current status of Braozs County for paying time and half for over- time hours, Commissioner Cooley moved that the Auditor be instructed to pay the overtime and that a memo be delived to all Department Heads advising that any employee who must work overtime be allowed to take compensatory time where possible and that compensation for overtime hours worked would be at the straight hourly rate. Commissioners' Court, Regular Meeting - Apirl 11, 1977 Don Mauro was present to request permission on behalf of the of the Municipal Uitlity District # l'to bore under Rockwood Drive to lay a four inch sewer line, such construction to take place 140 feet from the intersection of FM 2818 and Rockwood Drive. Mr. Mauro was advised that a written request should be made to the Court. On motion by Commissioner Cooley, seconded by Commissioner Cargill the Court voted unanimously to authorize the Municipal Utility District #1 to bore Rockwood Drive conditioned on the following: 1. That the Brazos County Municipal Utility District No. 1 or its contractor must notify the Commissioner of Precinct 4 prior to the beginning of construction in order that the Commissioner might be on hand to disignate the actual location of the installation. 2. That Brazos County will in no way be responsible for any damage that might occur to any existing utility lines in the right-of-way, The Court next opened and considered the following bids for the sale of a 1970 Dodge Dump Truck and a 1972 GMC Dump Truck: 1970 Dodge Dump Truck: $565.00 bid by William Benford $425.00 bid by Robert Murphy. 1972 GMC Dump Truck: $500.00 bid by Robert Murphy $501.00 bid by William Benford, On motion by Commissioenr Cooley, seconded by Commissioner Cargill the court unanimously voted to reject all bids received. Mr. Jack Cumpton, Architect presented the court with final plans and drawings for the Multi-Use Facility. Mr. Cumpton presented the following time schedule for discussion: May 1, 1977 - Submission of final Plans to EDA for approval June 14, 1977 - Advertise for bids for construction. July 14, 1977 - Award of contract for construction. August 11, 1977 - Begin construction of facility August 1, 1978 - Completion of construction of facility. After further explaination a t of the items requested, Commissioner Stasny moved that authorization 1 be given to purchase the uniforms and to amend the budget accor- dingly. Motion was seconded by Commissioner Cargill and carried, unanimously. i ' The County Judge laid before the Court a letter from the South west Texas State University, Texas Justice of the Peace Training j ' Center advising the Court of the completion of a twenty-four hour i } course in the responsibilities of the office of Justice of the i Peace by Judge Joe D. Novasad. On motion by Commissioner Wilcox, seconded by Commissioner Cargill the court unanimously voted to pay the statement of J.R. Loy in the amount of $24,774.57 for work completed at the i Brazos County Livestock Pavilion with monies to be paid out of j • the Revenue Sharing Fund. I The Court next considered a request by the County Treasurer for'authorization for the clerk in that office to work on a 'I three-fourths time basis through- July 31, 1977, due to the ' j illness of the County Treasurer. On motion duly made and se- conded, the court unanimously approved the additional time. Next to be considered were applications for soil conservation i work as follows: Pete Palasota, Jr., 2708 Pinehurst Circle, Bryan, request three hours grader work to be done off Elmo Weedon Road in it Precinct 3. R.A. Vitulli, Box 264, Bryan, requested three hours grader work to be done off FM 2038 in Precinct 3. Edward C. Neal, Jr., Maintenance Charles E. Sandle, Precinct 3 Arister Brooks, Precinct 3. Jesse Surgosa, Maintenance. On motion by Commissioner Stasny, seconded by Commissioner Wilcox the Court unanimously voted to approve the request as submitted. On motion by Commissioner Wilcox, seconded by Commissioner Cargill, the Court unanimously voted to designate the First National Bank, Bryan, Texas, as the County Depository for the 1977-1978 Biennium. The Court next considered a request by Daniel Jarvis Home Health Agency for tax exemption on Personal Property. After dis- cussion Commissioner Cooley moved to deny the request. Motion was seconded by Commissioner Wilcox and carried unanimously. Next to be considered was a request by the County HeAlth Unit for authorization to purchase two typewriters for use in their department. On motion duly made and seconded the Court voted to purchase two IBM-Selectric typewriters with Correction'feature- at a cost of $666.00 each.
