REGULAR MEETING
• JANUARY 10, 1977
A regular meeting of the Commissioners' Court of Brazos County,
Texas, was held in the Commissioners' Courtroom in the Courthouse in
Bryan, Brazos County, Texas, beginning at 10:00 A. M. on Moni'•.ay,
January 10, 1977, with the following members of the Court present:

The minutes of the previously held meetings were examined and
approved without change.
i The Court received, approved and ordered filed as submitted the
following reports for December, 1976:

The Court first considered the matter of setting the salaries
of all county employees for the year 1977. The County Judge laid be-

for the Court the following recommendations and requests that he had
received:
Salary of the Judge of the County Court At Law be increased;
Salary of the Assistant District Attorney be increased to $15,000;
Justices of the Peace, Precinct 4, Place 1; Precinct 7, Place 1;
Precinct 7, Place 2, be designated as full time positions;
Justice of the'Peace, Precinct 4, Place 2, be designated as a
part time positidn, effective February 1, 1977;
Clerk for Justice of Peace, Precinct 4, Place 1, be designated
as a full time position;
Clerks for Justices of the Peace, Precinct 7, Places 1 and 2
be designated as 3/4 time positions.
Salary of the County Auditor to be set the same as other officials
as ordered by the District Judge; '
The County Judge moved that the following amendments be made to
the budgeted salaries:
Justices of the Peace $39,420. This to include three full
time Justices of the Peace at $12,500, and 2 part time
Justices of the Peace at $960 annually.
Justices of the Peace Court Clerks $15,600, this to include
two 3/4 time clerks and one full time clerk.
Deputies to the District Clerk $33,550
Secretaries to District Attorney $13,707, this to bring one
secretary up to the full five percent increase.
County Treasurer Clerk $$3,640 this to provide for help on
3/4 time through April, 1977.
Deputies to County Clerk $46,222, this to increase the one
deputy from 3/4 time to full time.
Motion was seconded by Commissioner Cooley and carried unanimously.
Commissioner Wilcox moved that the salary for the County Judge
and the Judge of the County Court At Law be set at $18,000. Commis-
sioner Stasny seconded the motion with Commissioners Wilcox, Stasny
and the County Judge voting AYE.1 Commissioner Cargill and Cooley
voted NO, whereupon the County Judge announced the motion carried.
Commissioner Wilcox moved that the salary of the Assistant to
the District Attorney be set at $15,000. The motion was seconded by
Commissioner Stasny and carried unanimously.

The Court next heard presentations by the County Attorney and
the Tax Assessor, Collector regarding the budgeted salaries for their
respective offices. After much discussion, Commissioner Cooley moved
that a travel allowance be established for the Tax Assessor, Collector
in the amount of $150.00 per month. The motion died for lack of a
second.
Commissioner Wilcox moved to set all salaries as provided by
the Budget for the year 1977, to include those salaries amended by
the Court this date.
The Court next considered the matter of travel allowances for
certain County employees. County Attorney, Roland Searcy requested
that his travel allowance be increased to $100.00 per month due to
the added travel envolved in handling cases in the Justice of the
Peace Courts in College Station. Probation Officer, John Godfrey
requested an increase of $25.00 per month for travel for the five
Assistant Probation Officers in his department. After discussion
the County Judge moved that all travel allowances be set as budgeted.
Motion was seconded by Commissioner Cooley and carried unanimously.
Commissioner Wilcox moved that all out of county travel be
set at the same rate as the State of Texas. Motion was seconded by
Commissioner Cargill and carried unanimously.
Mr. Glenn Hyden, developer of the Glen Oaks Mobile Home Park
was present to file for an exception to the Brazos County Sanitary
Sewer Regulations. Mr. Hyden pointed out that his development was
underway at the time of the passing of the Regulations and would
request some consideration under these circumsantces. After re-
viewing the plat showing the development as completed and proposed
the County Judge moved that Mr. Hyden be given a temporary Septic
Tank Permit for a period of one year with the understanding that
the applicant will work with the Brazos County Health Department
during the installation and that the permit will be reviewed after
the one year period to determireif tie system is working satisfactorly.
The motion was seconded by Commissioner. Cooley and carried unanimously.

Next to be considered was the manner in which County Officers
shall be compensated for the performance of their official duties.
Commissioner Wilcox moved that all officers of Brazos County, Texas,
be compensated for duties performed on a salary basis for the calender
year 1977. The motion was seconded by Commissioner Cooley and carried
unanimously.
On motion by Commissioner Wilcox, seconded by Commissioner Cargill
the Court unanimously voted to approve the Official Bond of each of
the following County Officials sworn into office on January 1, 1977,
and ordered them recorded in the Offical Bond Record of Brazos County,
Texas:

The Court next authorized advertisement for the bids for the
County Depository for the 1977-78 biennium by the publication of the
following notice:
NOTICE TO BIDDERS FOR COUNTY DEPOSITORY
Notice is hereby given that the Brazos County Commissioners'
Court will receive bids up to ten o'clock A. M. on Monday,
February 14, 1977, for a depository for the biennium of 1977-78
for official County funds, including those of the common school
districts.
All funds must be protected by bonds and pledges of cash
or securities, as well as by provisions of the Federal Deposit
Insurance Corp.
All bids must be accompanied by a certified check payable
to the Commissioners' Court of Brazos County, Texas, for not
less than one-half of the one percent of the County revenue
for the year 1976, which shall be forfeited if the successful
bidder does not enter into the necessary bonds and pledges
of cash or securities.
Bids will be publicly opened and considered at the time
specified and Brazos County reserves the right to reject any
or all bids.

Commissioners' Court - Regular Meeting#' 'January 10, 1977.....
On motion by Commissioner C'oule,,, seconded by Commissioner
Wilcox, the Court unanimously voted to re-appoint Jake Cangelose as
Deputy Civil Defense Coordinator for the 1977-78 biennium.
The Court next received from the District Clerk the names of
all persons serving on the Grand Jury during the past twelve months
and proceeded to draw names for the Salary Grievance Committee as
follows:

On motion by Commissioner Stasny, seconded by Commissioner
Cooley, the Court unanimously voted to set the following holidays
for Brazos County for the year 1977:

The Court next considered a letter from the Texas Historical
Commission asking for the appointment of a Historical Survey Comm-
ittee for Brazos County. On recomendation of the Chairman of the
Brazos County Historical Society Committee, Commissioner Cooley moved
that the following persons be named to serve as the Committee for
Brazos County:

The motion was seconded by Commissioner Stasny and carried unanimously.
The Court next considered a Nutual Aid Agreement batween the
Cities of College Station, 3ryan and Brazos County for Civil Defense.
After having the agreement explained by the County Judge, Commissioner
Wilcox moved that Brazos County enter into such agreement with the
two cities. Motion was seconded by Commissioner Cooley and carried
unanimously. A copy of the agreement is attached to and made a part
of these minutes.

Commissioners' Court - Regular Meeting, January 10, 1977.....
On the recommendation of Larry L. Keeley, Chairman of the
Child Welfare Board, and on motion by the County Judge, seconded by
Commissioner Stasny, the Court unanimously voted to appoint Sarah
Ryan, Dr. Jesse Parr, Mr. Claude Scurry and Ms. Esther Flores to
the Child Welfare Board. The appointment of Sarah Ryan, Dr. Jesse
Parr and Mrs. Claude Scurry will be for a three year term ending
December 31, 1979. The appointment of Esther Flores to be for a
two year term ending December 31, 1978.
On motion by Commissioner Stasny, seconded by Commissioner
Cooley, the Court unanimously voted to re-appoint Dr. George McIlhaney,
M. D. as the County Health officer for a two year term ending
December 31, 1978.
The County Judge next reported that he had visited with a
representative of the Department of Public Welfare concerning a
Child Support Service for Brazos County. Judge Vance stated that
this service could be handled by the same individual appointed to
serve as Juvenile Prosecutor on a cost share basis, Judge Vance
stated that a contract with the Department of PubliOc Welfare would
be drawn up and presented to the Court at a later time for their
consideration.
The Court next considered the statement of George Webb Agency
for the renewal of the County's Liability Insurance for 1977. The
County Judge stated that there were three factors to be considered
at this time:
1) To renew the existing policy with the current agent;
2) To advertise for proposals from other agents;
3) To require the agent to divide the proceeds from the premium
with the other indpendent agents in the County.
After much discussion Commissioner Cooley moved that the County ad-
vertise for proposals for Liability Insurance for 1977, with proposals
to be opened and considered on Wednesday, January 26, 1977, at 2:00
P. M. in the Commissioners' Courtroom. Motion was seconded by Com-
missioner Cargill and carried unanimously.

The Court next considered two requests for payment from the
Bryan Construction Co. for work completed at the Brazos County Park
site covering the month of November, 1976,in the amount of $990.00,
and the month of December 1976,in the amount of $3,710.70 for a total,
amount of $4,700.70. On motion by Commissioner Wilcox, seconded by
Commissioner Stasny the Court unanimously voted to pay the two state-
ments with monies to be paid out of the General Fund to be reimbursed
by monies from the Community Development Block Grant and the Bureau
of Outdoor Recreation Grant for such purposes.
On motion by Commissioner Cooley, seconded by Commissioner
Stasny, the Court unanimously voted'to pay the statement of South/
West Planning Associates in the amount of $226.13 for services in
connection with the second year application for Community Develop-
ment Grant. Such statement to be paid out of the General Fund to
be reimbursed out of the second year Community Development Block
Grant.
The Court next considered a preliminay plat of MEMORIAL HOLLOW
in Precinct 1. After careful inspection of the plat Commissioner
Cooley moved that the preliminary plat be approved subject to the
following conditidns:
1)
Developer tap
Arrington Road.
2)
Provide for a
60 foot right-of-way for
Arrington Road.
3)
Provide for a
16 foot utility easement
on Arrington Road.
4)
Porvide for a
16 foot utility easement
on'State Highway 6.
5)
Designate a 50
foot set back building
line on Highway 6.
Motion was seconded by Commissioner Wilcox and carried unanimously.
The Court next discussed the proposed subdivision of Wheeler
Ridge in Precinct 3 but no action Was taken at this time.
The County Judge next advised the Court of the results'of his

the property on College Avenue to be u§ed by Brazos County for a
Juvenile Shelter. After consideration of all factors involved Com-
missioner Cooley moved that the County Judge be authorized to offer
the seller the following proposal for the purchase of the property: ;

Motion was seconded by Commissioner Wilcox and carried unanimously.
The County Judge advised the Court `that money was available for the
renovation of the property, administration of the program and equip-
ment through the the Criminal Justice Council if the County wished
to make application for such grant.

On motion by Commissioner Cooley, seconded by Commissioner
Wilcox, the Court unanimously voted to make the following amendments
to the 1977 Budget:

On motion by Commissioner Wilcox, seconded by Commissioner
Cargill, the Court unanimously voted to authorize the publication
for bids for the following departments with bids to be opened and

Commissioners Court - Regular Meeting, January 10, 1977.....
On motion by Commissioner Cooley, seconded by Commissioner
Wilcox, the Court- unanimously voted to approve a Change Order for
work at the Courthouse Annex in the amount of $1,113.60.
The Court, having received and opened bids for the relocation
the auxiliary power plant from the Old Bryan Hospital Building to
the Courthouse, proceeded to award the contract. On motion by
Commissioner Cooley, seconded by Commissioner Wilcox, the Court un-
animously voted to award the contract for such services to Collier
Electric Company in the amount of $5,847.00 with work to be completed
within 20 days after notice to proceed.
The Court next discussed volunteer fire protection for Brazos
County and it was the consensus of the Court that there should be
one main Corporation for the whole of Brazos County with sub-organ-
izations for the various locations that desired to establish a vol-
unteer fire department.
All members being present the Court proceeded to•approve the

JOINT RESOLUTION AND MUTUAL AID AGREEMENT
WHEREAS, foreign powers have the capability of attacking the
United States with nuclear weapons; and
WHEREAS, the cities of College Station, Bryan, and Brazos County
are vulnerable to natural disasters,,accidental disasters and major
domestic emergencies; and,
WHEREAS, recognizing the Civil Emergency preparedness is a function
of Government, the cities of Bryan, College Station and Brazos County
hereby agree upon a joint program of Civil Preparedness with objectives
being to coordinate all resources, provide aid and assistance to a political
subdivision upon request for the purpose of saving the maximum number of
lives, protection of property, maintain law and order, preserve civil
government and recover from a major disaster or enemy attack; now therefore,
BE IT RESOLVED BY THE CITIES OF BRYAN, COLLEGE STATION AND THE
COUNTY OF BRAZOS, as authorized by County Court Order dated April 13,
1959, College Station City Ordinance No. 326, Bryan Ordinance dated July
10, 1959; that,
1. The designation of an Emergency Disaster Council consisting
of the Mayor of Bryan, the Mayor of College Station and the
County Judge of Brazos County who shall serve as Council
Chairman.
2. The designation of a Disaster Directors Staff consisting of
duly appointed Civil Defense Directors from each of the political
subdivision.
3. The establishment of a county Civil Defense and Emergency,
Services Office and the appointment of a County Civil Defense
Director who shall serve as chairmen of the County Directors
Staff and is responsible for the coordination of Emergency
Planning, training disaster services and other duties as author-
ized and or deligated by the officials of Bryan, College Station,
and Brazos County.

BE IT FURTHER RESOLVED that,
1. Funding, administration and or operations of the county Emergency
Services Office shall be as authorized by the Emergency Disaster
Council or their designated representatives.

2. The Emergency Disaster Services Council and/or the Disaster
Directors Staff will meet upon call of the Chairman of the
Disaster Council or the Chairman of the Disaster Directors
Staff.
3. That officials of the cities and County Governmental Agencies
are authorized to prepare and maintain Emergency plans, operat-
ing procedures and written directives which are necessary for
implemetation of Emergency Functions as outlined in the Joint
Emergency Plans..
The above and foregoing resolution and Joint Mutual Aid Agreement
was approve and passed by:
