REGULAR MEING
DECEMBER 13, 1976
•A regular meeting of the Commissioners' Court of Brazos,
County, Texas, was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
A. M. on Monday, December 13, 1976, with the following present:
William R. Vance, County Judge, presiding;
Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sins, Commissioner of Precinct 3;
Frank Boriskie, County Clerk.
The minutes of the previously held meetings were examined
and approve without change.
The Court received, approved and ordered filed as submitte
the following reports for November, 1976:

The Court, having received and opened bids on November 23,
1976, for the construction of a pavilion at the Brazos County Live-
stock Arena, proceeded to the award of the contract for construction
of the pavilion. Mr. Ed Burkhart of Spencer Buchanan and Associates,
Brazos County's Engnieer for the project, reported that his investi-
gation of the bid of J. R. Loy Builders indicated that all materials
to be used met the specifications and that the contract•°was.in order.-
Mr. Burkhart stated that final approval of the performance bond by
the Bonding Company had not been received but had been assured ,
verbally that it would be forthcoming. Commissioner Wilcox moved to
award the contract for the construction of the pavilion at the Live-
stock Arena in the amount of $81,947 to J. R. Loy Builders of Madisbnvil,le
with completion date to be March 3, 1977, .subject to the final approval
of the performance bond. Motion was seconded by Commissioner Cooley
and carried unanimously.
The Court proceeded to approve the 1977-Budget for Brazos County,
Texas. The County Judge moved that the following amendments as
received by the County Judge at the Budget Hearing on November 30,
1976 be approved:
Salary, County Judge's Secretary budgeted at $ 7,900
Salary, County Clerk's Deputies budgeted at 44,602
Rental of Equipment, County Clerk 5,000
Salary, District Clerk's Deputies 32,387

The motion was seconded by Commissioner Wilcox and carried unanimously.
A further motion was made by Commissioner Wilcox to increase
the salaries of the Deputies in the Sheriff's Department by $11,,000
to allow for an additional deputy and-to increase the motor vehicle
allowance by $5,000 to allow for one additional vehicle. Motion was
seconded by Commissioner Sims and carried unanimously.
John Godfrey, Probation officer, requested an increase in the

Foster Care allocation to $200 per month and an increase in the allo-,
cation for conferences and meetings by $400. Commissioner Cooley
moved that the amount for Juvenile Expenses for the Probation Depart-
ment be increased by $4,800 and that the amount for conferences and
meetings be increased by $400 for the year 1977. Motion was seconded
by Commissioner Wilcox and carried unanimously.
Commissioner Cooley stated that he could not justify the $18,000
salary budgeted for the Judge of the County Court At Law and the
Administrative County Judge and moved,.that,both salaries be budgeted
at $16,000 to bring them in line with'other elected-officials and
the salary of the-County Attorney be budgeted at $16,480. Motion was
seconded by.Co mmissioner'Sims: W. T. McDonald spoke on behalf of
the County Attorney, requesting the approval of the budget sub-
mitted by the County Attorney at the Budget Hearing on November 30,
1976. Judge Bradley Smith stated that he felt it was 4n injustice to
set the salary of the Prosecutor higher than the Judge of the Court. Raymond Buchanan stated that he felt the salaries of all elected
officials should be the same. Commissioner Wilcox stated tha e

felt the salary of the County. Judge should be set at $18,000. The
County Judge statddthat it would be more logical to set the three_
salaries at $16,600. Commissione ,Cooley amended his motion to budget
the salaries of the three officials (County Judge, Judge County Court
At Law and County Attorney) at $16,600-The Motion was seconded by
Commissioner Sims, with Commissioners Sims and Cooley voting AYE.
The County Judge and Commissioner Wilcox voted NO. The County Judge
announced the motion failed. The Court agreed to resolve the question
by adjourning to the home of Commissioner Stasny after the lunch recess.
Commissioner Wilcox moved that the salary of the Court Reporter
of the County Court At Law be budgeted at $10,200. The motion was
seconded by Commissioner Sims and carried unanimously.
W. T. McDonald, Jr., District Attorney, requested the salary of
the Assistant District Attorney be budgeted at $16,000 and a 7 per
cent increase in salary for the secretaries of that office. No action
was taken on the request.
Raymond Buchanan, Tax Assessor-Collector, requested an increase
in the salary of the bookkeeper in that office, increase in the car
allowance for two appraisers to $150 per month, an additional deputy
to be budgeted at $6,500. The valuation services be increased to
7,500 and a $500 increase in the furniture allowance. Commissioner
Wilcox moved to budget the'salary of the bookkeeper at $8,600. The
motion died for lack of a second. Commissioner Cooley moved to in-
crease the car allowance for the two veteran appraisers to $150 each
per month, to increase the salaries of the deputies by $6,500 to
allow for an additional deputy, to increase the allocation for valuation
services to $7,500 and to increase the allocation for furniture by
$500. The motion was seconded by Commissioner Sims and carried un-
animously. The County Judge moved to increase the amount budgeted for
the salary of the bookkeeper in the 'fax Office to $9,000. Motion was
seconded by Commissioner Wilcox with Commissioner Wilcox and the County
Judge voting AYE:. Commissioner Cooley voted NO. Commissioner Sims
abstained from voting. The County Judge announced the motion carried.

Juvenile Probation Officer be increased to $10,000. The'County Judge
moved to increase the budgeted amount of the Juvenile Probation Officer
to $10,000. Motion was seconded by Commissioner Wilcox and carried
unanimously.
J. W. Hamilton, Sheriff, requested a slary increase for the
secretaries in the Sheriff's Department. Commissioner Wilcox moved
to budget the salaries for the secretaries and matron at $3.00 per
hour. Motion was seconded by Commissioner Sims and carried unanimously.
Commissioner Wilcox moved to budget a salary for a part time
Juvenile Prosecutor at $7,000, salary for secretary for that office
at $5,200 and supplies at $500. Motion was seconded by Commissioner
Cooley and carried unanimously.
The County Judge announced that final adoption of the budget
could not be considered until the question of the salaries of the
County Judge, County Attorney and Judge County Court At Law could
be resolved and recommended that they proceed with other items on
the agenda until after the lunch recess.
The Court proceeded to review the Environmental-Review record for
the second year activities of the Community Development Program.
The County Judge turned the meeting over to Mr. Ray Abbott, the
County's Consultant on the Community Development Program, who announc-
ed that the Environmental Review and Assessment of Phase II improve-
ments to the Park Project had been made and notice had been given of
the record to inform the public for their participation. At this
time the County Judge asked for comments from the audience on the
environmental impact due to the construction of Phase II of the Brazos
County Park. Receiving no comments Commissioner Sims moved that the
County find the construction of Phase II of the Brazos County Park
to have no significant affect on the quality of human environment
and request the release of funds for the construction of the project.
Motion was seconded by Commissioner Wilcox and carried unanimously.
Next to be considered was a Preliminary Plat of Valley Ridge
Subdivision in Precinct 1. After careful inspection of the plat
Commissioner Cooley moved to approve the Preliminary Plat subject to

the following corrections: ,
1) All acreage must be numbered as tracts.
2) The construction of a roa~to tap the adjoining property.
3) Removal of the statement "All acreage and dimensions shown
for each tract are approximations".
4) Insertion of "calls" in boundry lines of lots.
5) More detailed Clerk's Certificate.
Motion was seconded by Commissioner Wilcox and carried,unanimously.
The Court next considered a-rate increase by Blue Cross and
Blue Shield of Texas for Hospitalization Insurance ifor Brazos County.
After hearing a report on the County's usage experience, Commissioner
Sims moved to approve the rate adjustment and to initiate the add-'
itional coverage as outlined in Plan I of the attached proposal.
Motion was seconded by Commissioner Cooley and carried unanimously.
Next to be considered were the following bids for the relocation
of an auxiliary generator from the Bryan Hospital Building to the
Courthouse:
Frank Seale, bid $3,912 but did not meet the specifications.
Collier Electric bid $5,847.
Harvile Electric bid $6,397.
After reviewing the bids received the Court referred all bids to
the County's electrician for study and recommendation.
The Court recessed at this time for lunch to reconvene at 1:30
at the home of Commissioner Stasny.
All Commissioners and the County Judge being present, Commissioner
Stasny was informed of the prior action of the Court in.connection
with the amount budgeted for salaries of the County Judge, Judge
County Court At Law and the County Attorney. After discussion, Comm-
issioner Cooley moved to budget the salaries of the officials as
follows:

The motion was seconded by Commissioner Sims with Commissioners Stasny,
Sims, Cooley and Wilcox voting AYE. The County Judge voted NO. The
County Judge announced the motion carried.
Commissioner Cooley moved to budget the travel for the Constable
of Precinct 7 at $150 monthly. The motion was seconded by Commiss-
ioner Wilcox and carried unanimously.
Commissioner Cooley moved to adopt the 1977 budget as amended.
to be used by Brazos County for the current year. Motion was seconded
by Commissioner Wilcox and carried unanimously.
Next to be considered was-the final plat of RAINBOW ACRES Sub-
division in Precinct 1. After careful review of the Plat presented,
Commissioner Cooley moved to approve the plat contingent on the
developer furnishing a 12" x 40' culvert to be installed at the

corner of Golden Mist and Rhones Chappel Roads and the developer
furnishing county approved signs for all intersections in the sub-
division. The motion was seconded by Commissioner Sims and carried
unanimously.
On motion by Commissioner Cooley, seconded by Commissioner Sims
the Court unanimously voted to pay the 1977 membership dues for Brazos
County to the Texas Assocation of Counties in the amount of $850.

On motion by Commissioner Cooley, seconded by Commissioner Wilcox,
the Court unanimously voted to pay the increase of $31.00 per month
for elevator maintenance, making a total of $203.00 per month for
elevator maintenance provided by the Brazos Elevator Co. 1
The Court next considered bids for a transceiver for the Civil
Defense. On motion by Commissioner Cooley, seconded by Commissioner
Wilcox, the Court unanimously voted to accept the only bid received
from Industrial Electronics, Inc. in the amount of $1,143.
On motion by Commissioner Cooley seconded by Commissioner Wilcox,
the Court unanimously voted to pay the statement of E. E. Merrell, Jr.
in the amount of $383.67 and Jordan and Woods in the amount of $25,816.63
for work'completed in connection with the remodeling of the Courthouse
Annex. Monies to be paid out of the Revenue Sharing Fund.
On motion by Commissioner Cooley, seconded by Commissioner Sims

the Court unanimously voted to, pay the statement of Jack W. Cumpton,
Architect in the amount of $12,012 for services rendered in connection
with the Multi-Use Facility at thei,Brazos County Park, with monies
to be paid out of the Revenue Sharing Fund.
The Court next discussed the source of water supply to the Brazos
County Park and requested Commissioner Wilcox to explore the possibility
of Wixon Water Supply furnishing the water. Mr. Cargill stated that
he would request the company to furnish Brazos County with a cost
estimate for the installation of water lines to the Park.
On motion by Commissioner Cooley, seconded by Commissioner Sims
the Court unanimously voted to approve the Bond of Raymond B. Buchanan.
Tax Assessor-Collector to the State of Texas, in the amount of $50,000.
and to Brazos County in the amount of $50,000 and ordered that both
bonds be filed by the County Clerk and recorded inthe Official Bond
Records for Brazos County, Texas.
Next to be considered were applications for soil conservation
work as follows:
W. R. Klemm, Rt. 3, Box 179, Byran, requested grader work to
on Grasburr Road in Precinct 3.
On motion by Commissioner Sims, seconded by Commissioner Cooley,
the Court unanimously voted to approve the application and authorized.'

All members being present the Court proceeded to approve Cert=
ificates of Correction number 397 through 400 and 16851 through 16894
as presented by the Tax Assessor-Collector. On motion by Commissioner
Sims, seconded by Commissioner Cooley, the Court unanimously voted to
approve the above number certificates.

Court unanimously voted to pay the above claims as submitted.

On motion by Commissioner Cooley, seconded by Commissioner Sims,
the Court unanimously voted to amend the 1976 Budget of the following
departments as recommended by the County Auditor:
County Clerk $1,718 for labor
District Clerk 13,830 for labor
County Auditor 10,653 for labor
County Treasurer 1,580 for labor
Probation Department 22,111 for labor
Fire Protection 42,829 for fire protection.
There being no further business, the Court adjourned.
The foregoing minutes were examined and approved in open Court
on this 4th day of January,.,1977.
