"A ~ : j;.',~'~ < ~ d' > a; ;r . „cr •c .:.t..~•, ,.,r ~ Y:~ a~'c, ~F.:, 4.2 VOL k* AGE V 1-t:-,First to be considered was a Vehicle Lease Agreement between Brazos County.and the Brazos Valley Development Council for a mod- ular ambulance to be used,for Emergency Medical Services in Brazos County and an agreement between Brazos County and Sherrill Ambulance whereby the County would lease the modular ambulance to Sherrill Ambulance for use in the operation of,an ambblance service which serves Brazos County. After some discussion the Court agreed that Brazos County should self insure the vehicle. On motion by Comm- issioner Stasny, seconded by Commissioner Cooley, the Court unan- imously voted to authorize the County Judge to execute the Agree- ment with the Brazos Valley Development Council and with Sherrill Ambulance. A copy of both agreements are attached to and made a part of these minutes. Next to be discussed was a joint use agreement with Exxon Pipe- line Company covering the altering of the Exxon pipeline to accom- odate the construction of Briarcrest Drive Extension at an estimated cost to Brazos County of $37,184.00. On,motion by Commissioner Cooley, seconded by Commissioner Wilcox, the Court unanimously voted to authorize the County Judge to enter into such an agreement. A copy of the agreement is attached to and made a part of these minutes. Marcal, Inc. presented a very preliminary plat of a 200 acre proposed subdivision to be developed in Precinct 1. After thoroughly examining the plat the Court granted permission to continue con- struction, but requested a more detailed preliminary plat be sub- mitted showing actual lots and their size. The Court next discussed the changing of the name of Urbanosky Road to Hilton Road in Precinct 4, it being pointed out that the Hilton family had donated the right-of-way. On motion by Commiss- ioner Cooley, seconded by Commissioner Stasny the Court unanimously voted to change the name of the road to Hilton Road. S: Barron„ Box 793,,Bryan, Texas requested approx- imately 8 hours of grader work to be done along Wallis Rd. 1/2 mile from Highway 21 East, in Precinct 3. Mr. L. B. McMurtry, Sr., Rt. 2, Box 116 R, Bryan, requested approximately 1~ hours grader work to be done on Wallis Rd. ~ mile from Highway 21 East, in Precinct 3. Jimmy Weedon, Rt. 3, Bryan, requested approximately ~ hour grader work to be done 7 miles east of Bryan in Precinct 3. On motion by Commissioner Cooley, seconded by Commissioner Wilcox the Court unanimously voted to approve the applications and author- ized the Commissioner to do the necessary work. The Court proceeded to discuss a wolf bounty in Brazos County. Commissioner Stasny reported that he would like to see a program implemented on a County-landowner basis. After much discussion Commissioner. Stasny moved that Brazos County initiate a program whereby Brazos County would pay $5.00 and the landowner where the wolf is killed would match this amount. Motion was seconded by Commissioner Wilcox with Commissioners Stasny and Wilcox voting AYE. Commissioners Cooley, Sims and the County Judge voted NO whereupon the County Judge announced the motion failed. The Court next considered bills for fire calls from the City of College Station in the amount of $3,391.25 and from the City of Bryan in the amount of $1,503.00. After much discussion con- cerning alarm number 102 on the College Station bill, Commissioner Cooley moved that both bills be paid as submitted. Motion was seconded by the County Judge, with Commissioner Cooley and the County Judge voting AYE. Commissioners Sims, Stasny and Wilcox voted NO, whereupon the County Judge announced the motion failed. Commissioner Wilcox moved that the bill from the City of Bryan be paid in full and that the bill from the City of College Station be paid in the amount of $2,987.75 excluding fire alarm number 102 in the amount of $403.50 from the total bill. Motion was seconded by Commissioner Stasny, with Commissioners Stasny, Wilcox and Sims voting AYE. Commissioner Cooley and the County Judge voted NO, whereby the County Judge announced the motion carried and ordered the bills paid. _ 21~ v®4~_PAG , . Barnes in,the amount of $150:00 for a 1967 International Loadster owned by Precinct 2. The other bid received was from John Bonifazi ' 11 1{ I ..in the amount of 125.00. The Court having earlier selected the firm of Ed.Slovacek to conduct an outside audit for Brazos County heard a verbal proposal for services to be performed. Mr. Slovacek outlined such services And estimated the time to perform such services at 720 hours at a cost of $13,000.00 to Brazos County. After hearing the proposal and a discussion the County Judge asked for a written proposal to be considered by the Court at the November 24th meeting. The Court proceeded to canvass the results of the Constitutional Revision'Election held Tuesday, November 4, 1975 and found the following total results as follows:, Proposition # 1 For 2,732 Against 5,269 Proposition # 2 For 3,228 Against 4,743 "Proposition # 3 For 2,904 Against 5,065 1 Proposition # 4 For 2,921, Against 5,068 Proposition # 5 For 2,609 Against '5,343 Proposition # 6 For. - 2 893 Against 5,064 Proposition # 7 For 2,802 , Against 5,147 Proposition # 8.. Brazos County acting herein by County Judge William R. Vance. I. BVDC agrees to lease to the County certain motor vehicles and described in a separate schedule attached hereto and made a part hereof. Saic motor vehicles and equipment are to be used by the County in connection with its Emergency Midical Service, herein referred to ;ks EMS. II. Legal title to the vehicles and equipment shall remain in the name of the BVDC for the duration of the current grant period expiring June 30, 197 and any extension of that period which may be approved and funded by the Department of Health, Education and Welfare or other Federal authorities. Upon the termination of the grant BVDC agrees to request that the Department of Health, Education and Welfare transfer title to the vehicles equipment to the County. III. The County upon acceptance of the vehicles and equipment agrees to tain, service, and provide personnel for the use of said vehicles and and to be responsible for any other incidental costs incurred in the opera of the vehicles and equipment during the effective period of this lease. IV. The County upon acceptance of the vehicles shall maintain at all times i a policy of automobile and public liability insurance issued by a company '6, authorized to transact business in the State of Texas. The County agrees to abide by the rules and regulations promulgated the Department of Health, Education and Welfare for recipients of Emergency Medical Service Grants, respecting the operation of such grant programs, and the specific requirements of the grant described herein. VI. It is agreed that form time to time other vehicles and equipment may be leased by BVDC to the County. In the event of such lease a separate schedule of vehicles and equipment covered by the lease may be annexed to agreement and made a part hereof subject to the same terms and conditions hereinbefore stated. Each lease shall begin upon acceptance by the County of the vehicle or equipment to be leased and continuing until terminated acco ing to the annexed schedule. WHEREAS, Brazos County is in possession of one certain ambulance described as follows: One (1) 1975 Chevrolet Custom Deluxe 30: The County possesses this ambulance under an agreement between Brazos County and the Brazos Valley Development Council executed 1975; and; WHEREAS, the County wishes to make this ambulance available to Sherrill Ambulance for use in its operation of an ambulance service which serves Brazos County and; WHEREAS, this ambulance will materially benefit Sherrill Ambulance in the operation of its ambulance service; Now therefore the parties have agreed as follows: I. The County agrees to allow Sherrill Ambulance to use the ambulance for a period concurrent with its permit to operate ambulances within the Cities of Bryan and College Station or until the expiration of the County's lease from the Brazos Valley Development Council, or until the Commissioners' Court shall determine that it is in the best interest of its citizens to make different arrangements for the ambulance, whichever is sooner; II. Sherrill Ambulance agrees to maintain at all times a policy of automobile and public liability insurance issued by a company. authorized to transact business in the State of Texas. Slerril Ambulance further agrees to have the Brazos Valley ,Development Council and Brazos County listed as co-insureds in any insurance policy purchased and issued'in accordance.with this agree- emnt. III. Sherrill Ambulance agrees that the ambulance will be used only for emergency responses within the normal meaning of that phrase, and will not be used to transfer patients, except in extraordinary 'circumstances. IV. ` Sherrill Ambulance agrees to operate the ambulance in a proffess- ional manner. V. r 'Sherrill Ambulance agrees-that any time the ambulance is used, either an Emergency .Medical. Technician (E.M.,T.), a Licensed Vocational (L.V.N.), a Registered Nurse (R.N.), or Medical Doctor (M.D.) shall ,be in the vehicle in a position to render aid to the patient being t transported. The Emergency Medical Technician shall be uniformed in a manner suitable to reflect professional dignity and training. VI. • I Sherrill Ambulance agrees to have personnel in the ambulance to ` satisfy Federal guidelines at the expiration of a grant period. VII. County in the condition it was delivered to Sherrill Ambulance, except for reasonable wear to the vehicle caused by its use. Sherrill Ambulance agrees to keep a record of all activities 'and maintenance of the ambulance, and its operators, which will be satisfactory to meet all Federal guidelines. Sherrill Ambulance agrees that the County may inspect the ambulance and all records relative to its;use and maintenance at all reasonable times and places. Executed this the day of 197r.
