COMMISSIONERS' COURT
REGULAR MEETING
OCTOBER 13, 1975
A regular meeting of the Commissioners' Court of Brazos
County, Texas, was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
A. M. on Monday, October 13, 1975, with the following present:
William R. Vance, County Judge, presiding;
Bill J. Cooley, Commissioner of Precinct 1;
Randy Sims, Commissioner of Precinct 3;
W. A. Stasny, Commissioner cr Prccinct 4;,
Frank Boriskie, County Clerk.
The minutes of the previously held meetings were examined
and approved without change.
The Court received, approved and ordered filed as submitted
the following .reports for September, 1975:
B. V. Elkins, County Welfare Officer;
W. T. Sistrunk, County Extension Agent;
Curtis Taylor, Jr., County Extension Agent;
Douglas Presley, County Extension Agent;
Mable Walker, County Extension Agent;
Linda McCormack, County Extension Agent.
The Court received, considered and approved the following
reports from County and Precinct Officers showing official fees
of office collected and remitted to the County Treasurer according
to duplicate copies of the Treasurer's Official receipts attached
thereto:

The Court first considered the Affirmative Action Plan for
Brazos County relating exclusively to projects funded by the
Community Development Program. After having the plan explained
by Mr. Ray Abbott with South/West Planning Associates, the County's
consultant, the Court requested more time to study the plan be-
fore approving it.
The County Judge announced that the proposed Budget for Brazos
County had been completed and asked that a public hearing date
be officially set, whereupon'the Court set Monday, October 20, 1975,
at 10:00-A. M. as the date and hour for the public hearing. The
following notice was published in the manner prescribed by law:
NOICE OF HEARING ON BRAZOS COUNTY BUDGET FOR 1976
Public notice is hereby given that pursuant to action of the
Commissioners' Court of Brazos County, Texas, open public
hearing will be held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas at 10:00 A. M. on
Monday, October 20, 1975, for consideration of the 1976
Budget for Brazos County, Texas, filed with the County Clerk
on October 3, 1975, and now remaining on file in the office
of the County Clerk of said County, all in accordance with
law.
Taxpayers and others interested are invited and urged to
accquaint themselves with said Budget during the time it
remains on file with the Clerk before the hearing.
At the conclusion of the hearing, final action will be taken
by the Commissioners' Court of Brazos County, Texas, for
the adoption of the Budget for 1976, as finally agreed upon.

The Court next considered the invoice of South/West Associates
in the amount of $1,441.47 for professional services in connection
with the Community Development Program. On motion by Commissioner
Sims, seconded by Commissioner Stasny, the Court voted unanimously
to pay such invoice.
Next to be considered were applications for soil conservation
work as follows:

Francis P. Rotello, P. 0. Box 249, Navasota, requested app-
roximately 9 hours grader work to be done on old highway 6
in Precinct 1.
J. R. Baur, 1100 Westover, College Station, requested approx-
imately one hour grader work to be done on Koppe Bridge Road,
in Precinct 1.
Glenn Hyden, P. 0. Box 9902, College Station, requested approx-
imately two hours grader work to be done along Roans Chapel
Road in precinct 1.
On motion by Commissioner Cooley, seconded by Commissioner Sims,
,the Court unanimously voted to approve the applications and author-
ized the Commissioners,to do the necessary work.
The County Treasurer advised the Court that the Probation Fund
Account balance was inadequate to pay the expenses of that office
for the remainder of the year. After a discussion of the needed
funds, Commissioner Sims moved that the County Auditor be author-
ized to transfer the amount of $3,500.00 from the General Fund
Account to the Probation Fund Account to meet'the expenses. Motion
was seconded by Commissioner Cooley and carried unanimously.
Mr. W. D. Burley, District Clerk requested permission to allow
the employees in his office to work more than 40 hours per week
for the next two months. After a discussion and on motion by Comm-
issioner Cooley, seconded by Commissioner Stasny the Court unanim-
ously voted to allow the overtime hours.
The Court next discussed a right-of-way dedication contract be-
tween Ford D. Allbritton, City of Bryan, Brazos County and Brazos
County Municipal Utility District No. 1 on the Villa Maria Extensio
West. After a discussion, Commissioner Cooley moved that the Couni

Judge be authorized to execute'the contract on behalf of Brazos
County. Motion was seconded by Commissioner Sims and carried un-
animously. A copy of such contract is attached to and made a part
of these minutes.
All members being-present, the Court proceeded to approve the
following claims for payment as presented by the County Auditor:
General Fund - Claims - 1833 through 1987
Miscellaneous - Claims - 167 through 221
Shop - Claims - 88 through 101
Precinct 1 - Claims - 177 through 202
Precinct 3 - Claims - 176 through 204 excluding 198
Precinct 4 - Claims - 121 through 140
On motion by Commissioner Stasny, seconded by Commissioner Cooley,
the Court unanimously voted to pay the above claims as submitted.
There being no further business, the Court adjourned.

RIGHT-OF-WAY DEDICATION CONTRACT

This Contract and Agreement, herein referred to as "Contract", is this
day made and entered into by and between Ford D. Albritton, Jr., of Brazos
County, Texas, hereinafter referred-to as the "Grantor"; and the City of Bryan,
Texas, a municipal corporation organized pursuant to Article 11, Section 5 of
the Constitution of the State of Texas, hereinafter referred to as the "City",
and the County of Brazos, Texas, a county government organized pursuant to
Article 9, Section 1 of the Constitution of the State of Texas, hereinafter
referred to as the "County", and Brazos County Municipal Utility District No. 1,
created and operating under the provisions of Article XVI, Section 59 of the
Constitution of the State of Texas, hereinafter referred to as "District".
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
That "Grantor" for and in consideration of the terms and conditions
hereinafter set forth does grant, bargain and convey to the "Public", which is
defined as the "County" until such property is annexed by the "City", in which
event "Public" will be the "City", a permanent right-of-way and easement for
the purpose of constructing, using, and maintaining a public street with drainage
facilities as may be required and the right to construct, operate, and maintain
water, sewer or other public utilities in or upon said right-of-way, the said
right-of-way and easement being described in Exhibit "A" attached hereto,
subject to the following additional terms and conditions:
1. The agreed value of the property being dedicated to the "Public"
herein is $40, 050. 00, and the "County" and "City" in consideration
for the dedication of the easement, herein grant a credit, not
to exceed $40, 050. 00, to the "Grantor" herein, against any
future paving assessment, if any, arising out of the improvement

property by the or the "County However, if the "Grantor"- should 'subsequent ly'develop his property as
a developer and initiatc proceedings for the street improvement on the
described property, "Grantor" will be required to participate in the,
cost as any other developer.
2.' The "City" incurs no obligation to annex or to improve the property
described in Exhibit "A" at anytime. The only obligation of the "City"~
and "County" incurred by reason of the "Contract" is the duty to
apply the credit as heretofore described.
3. The acquisition of the right-of-way by the "Public" for the purposes
stated herein is considered satisfactory performance by "District"
of the condition of the Contract between "City" and "District" wherein
"District" agreed to bear the expense of an easement from Finfeather
Road to F. M. 2818 for the purpose of installing, maintaining, and j
operating a twelve-inch water supply line. Title to the easement
for this water supply line shall immediately vest in the "C'ity".
l The covenants and agreements herein contained shall inure to the benefit of

and be binding upon the parties hereto, their respective heirs, legal representatives,
' successors and assigns.
IN TESTIMONY OF WHICH, this instrument, in quadruplicate originals,
all of full force and effect, has been executed on behalf of the CITY OF' BRYAN on'
this the day of 1975 and-the COUNTY OF BRAZOS on this the
day of 1975; and has been executed by FORD D. ALBRITTON,
JR. on this the day of 1975; and has been executed by
BRAZOS COUNTY MUNICIPAL UTILITY DISTRICT NO. 1 on this the day of
1975'.
