REGULAR MEETING
SEPTEMBER, 8, 1975
A regular meeting of the Commissioners' Court of Brazos
County, Texas, was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 10:00
A. M. on Monday, September 8, 1975, with the following present:
William R. Vance, County Judge, presiding;
Bill J. Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
W. A. Stasny, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.
The minutes of the previously held meetings were examined
and approved without change.
The Court received, approved and ordered filed as submitted
the following reports for August:

W. T. Sistrunk, County Extension Agent;
Curtis Taylor, Jr., County Extension Agent;
Douglas Presley, County Extension Agent;
Mable Walker, County Extension Agent;
Linda McCormack, County Extension Agent.
The Court received, considered and approved the following
reports from County and Precinct Officers showing official fees
of office collected and remitted to the County Treasurer according
to duplicate copies of the Treasurer's official receipts attached„

The first item to come before the Court was the Public Hearing
on the Community Development Program for Brazos County. The County
Judge noted that public notice had been given as required under the
applicable sections of the statutes under which we are applying. He
announced the Public Hearing open for the purpose of allowing all
interested persons to voice their desires and asked for information
with respect to the County's participation in the program. Judge
Vance reasoned that the attendance was not as great as it might other-
wise be probably because the Park Project, on which the County plans
to use the majority of the grant,'has been rather thoroughly heard
publicly, and asked at this time if there was anyone who wished to
be heard. The record shows that no one came forward to speak at this
time. Judge Vance next asked the County's consultant, Mr. Ray Abbott,
o•f South/West Planning Associates, if there was anything that he
wished to state for the record. He made the following points so that
the minutes and records of the hearing would correctly show that
adequate opportunity had been given for information to and participa-
tion by,the public.
Mr. Abbot explained that Brazos County's preapplication had
been apporved by HUD in the amount of $20,000.00. The following
points were also made:
That the preapplication specified two projects for funding, the
park project and selected architectural modifications to the Courthouse;
That the Community Development Grant was 100% funded by HUD; That
the County's application will contain a Community Development strategy
and a Housing Assistance Plan; That the County is on schedule to make
deadline of September 30th for submitting its application and is hold-
ing two required public hearings, one today and one on September 15th
to give the citizens and opportunity to be informed and to participate
as they might see fit in the development of the application; That
news releases have been distributed and general information handouts
have been prepared and distributed (according to the County's Citizen
Participation Plan) showing the other fundable projects included in
this federal program (to give the general public an opportunity to'
make any comments appropriate to them); and That the project activities

will comply with-the,applicable*provisions'of some 30 to 35 pieces
of Federal legislation, such as Davis-Bacon Act, Civil Rights, Equal
Opportunity and applicable environmental laws. Information on any
of these pieces of legislation can be discussed at this mebting or r.
can be obtained through the County Judge's Office.
At this time the County Judge asked for any questions for the
Consultant or concering the application at which time Howard Price
asked when the County might haive the park ready for public use'and
if there was a traget date set by the County. To this the County
Judge answered "NO", that the County was waiting for Community Develop-
ment funds to be matched with County funds and making application to
the Bureau of Outdoor Recreation for 50% matching funds and it would
depend on the time of that application. Commissioners Wilcox and
Sims stated that work would begin tommorrow on the right-of-way that
would give the public access to the park property.
Mr. Abbott,asked that before the public hearing was closed it
be announced that there would be another-public hearing next Monday
at 10:00 A. M. for the purpose of reviewing the environmental assess-
,'ment of the program activities, reviewing the application itself and
obtaining public participation and to take action on approving the
Community Development application for processing through the Brazos
Valley Development Council, the State and DHUD. At this point the
County Judge asked for further comments,and receiving none, announced
the public hearing closed. Item number three on the agenda that called
for the appointment of a County Chief Executive officer to serve as
the authorized representative of the County to act in connection with
the Community Development application and provide such information as
may be required. On the motion of Commissioner Wilcox, seconded by
Commissioner Sims, the Court unanimously voted to appoint County Judge
William R. Vance as the County's Chief Executive Officer.
The next item for consideration was an agreement between the
County and the Bryan Independent School District for the management
and operation of the Saddle Club Property. Noting that the FFA Dept.
had previously been designated by the Court to manage and operate the
facilities, and that the Bryan Independent School District had

accepted and approved the agreement, Commissioner Cooley moved that
Brazos County finalize the agreement. Motion was seconded by Comm-
issioner Sims and carried unanimously. A copy of such agreement is
attached to and made a part of these minutes.
Next to be discussed was the abandonment of certain unused
rights-of-way in Lone Oak'Acres subdivision. After some discussion,
Commissioner Cooley moved that the County abandon to the adjoining
property owners the unused portions of Belaire, Nelson, Fairlane and
Shirley Drive. Motion was seconded by Commissioner Stasny and carried
unanimously.
A proposal to tear down the frame house at 104 South Washington
was next considered. On the recommendation of the County Judge and
motion by Commissioner Sims, seconded by Commissioner Stasny, the
Court voted unanimously to accept the proposal of Mr. Rex Jackson.
The project to be completed and the site cleared by December 1, 1975.
The Court proceeded to consider applications for soil conser-
vation aid for the following persons:
W. R. Klemm, Rt. 3, Box 179, requested approximately 1~
hours motor grader work to be done in the vicinity of
Grassbur Road in Precinct 3;
Alta McCullough, 600 East 32nd St., requested approximately
8 hours of grader work to be done in the vicinity of Highway
30 east in Precinct 3;
Arthur C. Dean, 304 Grove St., requested approximately 1
hour motor grader work to be done in the vicinity of Beckham
Cemetary Road in Precinct 2;
On motion by Commissioner Sims, seconded by Commissioner Stasny, the
Court unanimously voted to approve the above applications and authorized
the Commissioners to do the necessary work.
The Court next considered bids for a boiler and installation
at the Old Bryan Hospital. On motion by Commissioners Sims, seconded
by Commissioner Wilcox, the Court unanimously voted to accept the
low bid of Kutzschbach Company in the amount of $2,865.00. Installation
to be done at cost plust 10% of all materials and $11.64 per hour for
labor. The other bid received was from Powers Plumbing Company.
The Court proceeded to discuss the Plat of BRAHAMAN MEADOWS as
resubmitted by Doug Thurmond. After much discussion, Commissioner

Cooley moved that•the Plat'be denied due to'the refusal of the dev-
eloper to furnish,'a right-of-way •through to the adjoining property
line. Motion was seconded by Commissioner Sims, with Commissioners
Cooley and Sims and the County Judge voting AYE,. Commissioners
Wilcox and Stasny voted NO. The County Judge announced the motion
carried and the Plat of BRAHAMAN MEADOWS denied.
Next to be considered was a roller shelf unit for the County
Clerk's Office. On motion by Commissioner Cooley, seconded by Comm-
issioner Wilcox, the Court voted unanimously to accept the low bid '
of-News Office Supply in the amount of $1,212.80. The other bid
received was from Hart Office Centers in the amount of $1,313.70.
The County Judge laid before the•Court the resignation of Linda
McCormack, County Extension Agent, effective September 30, 1975.
All members being present, the Court proceeded to approve the
following claims for payment as,presented by the County Auditor:

On motion by Commissioner Sims, seconded by Commissioner Stasny, the
Court voted unanimously to pay the above claims as submitted.
On motion by Commissioner Sims, seconded by Commissioner'Stasny,
the Court unanimously voted to approve the Public Weighers Bond of
Henry Gritter in the amount of $2,500.00 with the Hanover Insurance
Company as Surety.
There being no further business, the Court adjourned.

COUNTY OF BRAZOS
WHEREAS, Brazos County; Texas-is the owner•of approximately
' 8.8 acres in"the 'S. F.'Austfn' Leauge No:, 10, Brazos County, Texas,
together with the improvements'thereon, commonly called the "Saddle
Club Property"; and
WHEREAS, the County has agreed to enter into a management,
agreement with reference to such property with the Bryan Independent
School District for operation of the said property by and-through Ei
the F.F.A. Chapter of the said Bryan Public Schools; and
it
WHEREAS, the parties are desirous of evidencing said agree-
ment in writing so that the duties and privileges of each party shall'.
be clearly designated;
NOW, THEREFORE, know all men by these presents that for
and in consideration of the premises and the mutual agreement herein
made, Brazos County, Texas, (hereinafter called "Brazos County or
County") and Bryan Independent School District, (hereinafter called
"District") have agreed and do hereby agree as follows:
I
That Brazos County has designated and does hereby designate
the District to operate and manage the Saddle Club Property upon the
terms and conditions hereinafter set forth. Such management and op-
eration to be accomplished by the District by and through the F.F.A.
Chapter of Bryan High School.
II
That the County has agreed and does hereby agree to furnish
funds in an amount to be determined hereafter by mutual.agreement for
the initial remodeling and repair of the improvements. The work to
be accomplished shall be done under the direction of the District in-
consultation with a member of the Commissioners' Court to be designated
by the Commissioners' Court.

III
It is the intention of the parties that the facilities be
available for public use on tirst come, tirst serve basis. The
District therefore agrees to maintain a calander for scheduling and
reservations of the facilities in a place readily accessable to the
public during normal working hours.
IV
The District shall develop a schedule of fees to be charged
for the use of the facility, which schedule shall be submitted to and
approved by the Commissioners' Court prior to its becoming effective.
The schedule-of fees shall not be changed o= ammended without prior
approval of the Commissioners' Court.
V
The District shall be responsible for all maintenance and
repair to the improvements which shall be necessary from time to
time and the facilities shall be returned to the County in good
condition at the expiration of this agreement, reasonable wear and
tear excepted. The District shall cause-all users of the facility
to assume responsibility for repairs other than reasonable wear and
tear.
VI
Permanent improvements shall not be made by the District
without the express consent of the County and any such improvements
shall become the property of the County at the expiration of the
final term of the agreement.
VII
The County shall maintain a casualty insurance policy in ,
an amount to be determined by it, covering the improvements. The
County shall endeavor to have the District named as a co-insured on '
its public liability insurance policy in so far as the facility is
concerned.
The terms of'. this - agreement 'shall be for one (1) year
beginning September 1,.1975,,'and ending August 31, 1976, and shall
'automatically ieriew' for'successive 'dne (1), year' terms thereafter
unless terminated by either party thereto.
