HomeMy WebLinkAbout1975-08-11-1000AM-RegularCOMMISSIONERS' COURT REGULAR MEETING AUGUST 11, 1975 A regular meeting of the Commissioners' Court of Brazos County, Texas, was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 10:00 A. M. on Monday, August 3.1, 1975, with the following present: William R. Vance, County Judge, presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; W. A. Stasny, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The minutes of the previously held meetings were examined and approved without change. The Court received, approved and ordered filed as submitted the following reports for July: B. V. On motion by Commissioner Sims, seconded by Commissioner Stasny, the Court voted unanimously to accept the proposal in the amount of $2,500.00. A copy of such proposal is attached to and made a part of these minutes, showing all services to be rendered by South/West Planning Associates. The Court next heard a presentation by Dede Matthews and Phyllis Dozier with the Arts Council of Brazos Valley. The Court was advised that the Council had requested and received funding from the City of College Station in the amount of $6,070.00 and $5,000.00 from the City of Bryan and requested funding from the County in the amount of $6,070.00. -No action was taken on the re- quest at this time as the Court felt they would need more time to consider the request. All members being present, the Court proceeded to levy taxes for the year 1975, Commissioner Stasny moving that ad valorem taxes be levied against all property in Brazos County, Texas, according to the following schedule: General Fund $ .72 Road and Bridge .23 1967-68-69 Road Bonds .15 Total Tax Rate for 1975 $1.10 J The County Judge advised the Court that the County's share of surplus lateral road funds, available through the Board of County and District Road Indebtedness, as of August 31, would be the sum of $73,963.56. Commissioner Wilcox moved that Brazos County request that such sum be transferred to Brazos County for the construction and improvement of the County's lateral roads. The motion was seconded by Commissioner Stasny and carried unanimously. On motion by Comm- issioner Cooley, seconded by Commissioner Stasny, the Court voted • . 4 unanimously to appoint Dorsey McCrory'to fill the vacancy.. On motion by Commissioner Stasny, seconded by Commissioner N Cooley, the Court voted unanimously to approve the Plat of WELLBORN ,l OAKS, subject to the naming of the streets,'and payment of the filling fee. The Court next considered the Plat of WESTWOOD ESTATES, as !I~ i+ presented by the Braver Corp.. After much discussion the Court i rejected the plat due to the follow ng reasons: 1) Utility easements were not 16 feet as stated in the County Subdivision regulations. 2) No right-of-way shown across Tract C. • 3) The name of the road "West University Road" that had previously been named "Gabbard Lane or Gabbard Road" On motion by Commissioner Cooley, seconded by Commissioner Stasny, the Court voted unanimously to approve the following applica- tions for soil conservation aid and authorized the Commissioner to do the necessary work: Alton Risinger Bobby Holiday Rt. 3, Box 192 2701 Pinehurst Bryan, Texas 77801 Bryan, Texas 77801 Warren Shoemake 1706 Rosedale Bryan, Texas 77801 The Court next received bids for the sale of one portable building and one frame house located on the Bryan Hospital block.as follows: R. B. Buchanan $500.00 for portable building Marvin H. Ferguson 560.00 for portable building Bryan Hospital 501.00 for portable building West End Salvage 365.00 for portable building Michael Franklin 500.00 for portable building Kenny Mallard 200.00 for portable building After considering all bids received and having received no bids. on the house~Commissioner Cooley moved that all bids be rejected. On motion by Commiss- ioner Sims, seconded by Commissioner Cooley, the Court voted un- animously to accept the low bid of W. Kutzschback Co. in the amgunt of $868.00 for an unbreakable unit. Other bids receivpa wPrp frnm J. E. Powers Plumbing Co. in the amount of $966.43 for an unbreakable unit. Linda Patterson with the Child Welfare Department requested that the County provide support for Ron Williams in the amount of $3.00 per day until May, 1976, notwithstanding that he would be 18 years of age during the month of August, 1975,and stated that the County had been furnishing support for a period of time during which the minor had shown remarkable improvement in attitude and learning ability and that the provision of additional support would allow him to complete high school and in all probabilty he would continue into college. After a discussion the County Judge moved that the request be granted and that support be furnished for said minor. Motion was seconded by Commissioner Sims and carried un- animously. On motion by Commissioner Sims, seconded by Commissioner Wilcox the Court voted unanimously to amend the Budget to include the total budget figures for the Brazos County Civil Defense and the Brazos County Health Unit, a copy of which is attached to and made a part of these minutes. All members being present the Court proceed to approve the following claims as presented by the County Auditor for payment: Miscellaneous Funds Claims 103 through 132 General Fund Claims 1505 through 1653, excluding 1507 and 1646 County Shop Claims 62 through 74 Precinct 1 Claims 136 through 156, excluding 139, 141, 152 and 153 Precinct 2 Claims 196 through 214 Precinct 3 Claims 132 through 151 Precinct 4 Claims 79 through 103, excluding 102 On motion by Commissioner Stasny, seconded by Commissioner Wilcox, the Court voted unanimously to pay the above claims as submitted. Box 3995 Bryan, Texas 77801 Re: Letter of Agreement for Professional Services Community Development Program Brazos County Dear Judge Vance: Based on our presentation to the court last Monday (July 28) and as a continuation of our February 6th agreement, we are submitting this Letter of Agreement to proceed with the next step in obtaining funding from DHUD for the County's Community Development Program and subsequent funding from the Texas Parks and Wildlife Department for initial County Park facilities. APPROACH Our approach remains the some as stated in our earlier agreement of February 6th since it has been successful in achieving the objectives of the Court in this program. SCOPE OF CONSULTANT PARTICIPATION It is our intention to provide the Commissioners Court with the necessary professional services so as to prepare a full application, based on current regulations, in such a manner as to be acceptable for receiving funding under DHUD's Community Development Program. (2) Completion of all necessary forms and certifications for action by Commissioner's Court and County Staff related directly to completing the Community Development Program and Texas Parks and Wildlife Department applications. (3) Attendance at two (2) public hearings: one related to the Community Development application; one related to the •Environmental Assessment on proposed Community Development projects. (4) Prepcrationd a Housing Assistance Plan, as required by federal regulations- for Community Development Program. (5) Preparation of Environmental Review Record on proposed Community Development projects and of drafts of documents related to complying with federal regulations on environmental protection. (6) Completion of forms,to Request Release of Funds for Community Development. ` (7) Working with the staff of the Brazos Valley Development Council In obtaining state and regional A-95 review. OVERALL DIRECTION OF WORK These phases of the Count~s application process will be under the direction of Mr. Ray E. Abbott, AIP,•who is State-certified as a qualified Planner-in-Change for HUD-assisted planning and management progrgms. Mr. Bob Wimbish, currently an associate of South/West Planning Associates, will join Ms. Susan• Frisbie in assisting Mr. Abbott in this effort. All of these staff members have the necessary background and experience in community development and planning. (2) Texas Parks and Wildlife Department Applications: $925.00. SCHEDULING OF WORK South/West Planning Associates will work with the County to submit the Community Development application to DHUD no later than September 301 1975, and the Texas Parks and Wildlife Department application no later than the deadline required for funding consideration starting January i, 1976. We are prepared to begin work immediately. BILLING PROCEDURE We propose to bill Brazos County for work requested and accomplished, on a monthly basis, and according to the attached standard fee schedule. We trust this Letter of Agreement meets with the Commissioner's Courts' approval. If this Agreement is acceptable, please sign both copies and return one for our files. CONSULTATION & SALARY: For services rendered outside our offices, the following daily fees shall apply: Staff Classification Daily Fees Principal $180.00 Staff Associates $140.00 ' Para, Professionals $100.00 These daily fees apply only' to time in the field away from our offices. Working time in excess of 8 hours per day or 40 hours per week, such overtime will be billed at 115% of the above rates. For services rendered In our offices, the following hourly ,fees apply: Staff Classification Hourly Fees' Principal $22.50/hr. Staff Associates $17.50/hr•. Statistical Analyst $15.00/hr. Rcsearch Staff $15.00/hr. Technical Writers $15.00/hr. Draftsmen $ 12.50/hr. Clerical $ 9.00/hr. B. TRAVELAND TRANSPORTATION EXPENSES 1. Reimbursement for actual travel and subsistence expenses paid to or on behalf of employees. 2. 16 cents per mile for use of SOUTH/WEST PLANNING ASSOCIATES' vehicles. C. OUTSIDE SERVICES Invoice costs of services and expenses charged to SOUTH/WEST PLANNING ASSOCIATES by outside consultants, professional or technical firmi engaged in connection with the order,,plus 10% overhead cosh. D. REPRODUCTION AND PRINTING SERVICES The invoice costs of reproduction and printing services done for SOUTHWEST PLANNING ASSOCIATES clients plus handling charge. E. MISCELLANEOUS EXPENSES The invoice cost of materials, supplies and services, Including communication expenses, procured by SOUTHWEST PLANNING ASSOCIATES from outside sources. All out-of=pocket expenses not included in items A, B, C, or D will be included in this category. F. METHOD OF BILLING Unless otherwise provided, billings will be made monthly as the work pragresses. All invoices are payable when submitted. SOUTH/WEST PLANNING ASSOCIATES reserves the right to charge interest at 10% per year on balances unpaid after 30 days, plus reasonable attorney fees in the event some are incurred in making collections. _i • if it I I .
