COMMISSIONERS' COURT
SPECIAL MEETING
JUNE 23, 1975
A meeting of the Commissioners' Court of Brazos County, Texas,
was held in the Commissioners' Courtroom in the Courthouse in Bryan,
Brazos County, Texas, beginning at 10:00 A. M. on Monday, June 23,
1975, with the following present:
William R. Vance, County Judge, presiding;
Bill Cooley, Commissioner of Precinct 1;
Walter Wilcox, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
W. A. Stasny, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.
The County Judge opened the meeting with the Public Hearing
on the Revenue Sharing Planned Use Report for 1976. There being
no public discussion on the report the Court agreed to Certify such
report in the amount of $222,196.00 to be used for multipurpose
and general government use. A copy of such report is attached to
and made a part of these minutes.
The Court next discussed the proposed Budget for the Brazos
County Bicentennial Celebration in the total sum of $10,643.75, of
which the County's share would be $4,543.75 of which $543.75 has
already been funded. On motion by Commissioner Wilcox, seconded
by Commissioner Stasny, the Court voted unanimously to approve the
Bicentennial Budget and authorized the payment of $4,000.00 to the
Bicentennial Committee out of the General Fund. A copy of said Budget
is attached to these minutes.
On motion by Commissioner Sims, seconded by Commissioner Stasny,
the Court adopted the following order authorizing the issuance of a
Time Warrant in the amount of $24,000.00, payable in annual install-
ments, to wit:
IT IS ORDERED, ADJUDGED AND DECREED that the Court approve
the issuance of a Time Warrant in the sum of $24,000.00 for y
the purpose of purchasing and paying for a motor grader for
Precinct 2 of Brazos County, Texas. The Warrant will be paid
in three annual installments, the first installment being due
on the 5th day January, 1976, and one installment to be due

on_, the 5th day of January thereafter until the full amount
of said Warrant shall have been paid; the'Warrant will bear
interest at a rate not to exceed 2% per annum, interest to be
payable annually on each principal installment paying date.
IT IS FURTHER ORDERED, ADJUDGED AND DECREED that there shall
be an annual levy and collection of taxation of sufficient
amount to pay all interest on said Warrant as they shall be-
come due and payable. Such Warrant shall be sold to the low-._••

est andibest bidder, The First National Bank of Bryan, by
virtue of the County Depository Bids received February 10, 1975,
and shall be paid out of the Road and Bridge Fund. (Precinct 2).

Next to be considered were applications for soil conservation
work in Preicnct 3, submitted by:

On motion by Commissioner Sims, seconded by Commissioner Wilcox, the
Court voted unanimously to approve the applications and authorized
the Commissioner to do the necessary work.
The Court proceeded to discuss thelproposals submitted by

different organizations for the management of the Saddle Club Prop- i

1erty. On motion by Commissioner Sims, seconded by Commissioner
Cooley, the Court voted unanimously to accept the.proposal of the
FFA Club and authorized the County Judge to enter into a management
agreement with the understanding that the Commissioners' Court would
be the governing board of the project.I

The County Judge reported on negotiations with Humana, Inc. for
the purchase of Block 7, City of Bryan, that an agreement had been 41
reached whereby the County would purchase the property for a total
cash sum of $325,000.00. Commissioner Sims moved that the property
be purchased for such amount, $265,000.00 to be paid out of the

Revenue Sharing Fund and $60,000.00 to be paid out of the Retired

Road Bonds Fund, and that the County Judge be authorized to execute (4

the necessary documents to finalized the transaction. Commissioner

Wilcox seconded the motion which unanimously carried. {

The Court next discussed a Septic Tank Ordinance for Brazos
County. After some discussion, the Court agreed that they would
need more time to study the ordinance before taking any action.
The Court next considered a request by the Probation Department
to be allowed to make application to the Criminal Justice Council for
a grant for that department. After a discussion, Commissioner Sims
moved that the Project Notification be submitted to the Brazos Valley
Development Council to be included in their work program. Motion
was seconded by Commissioner Wilcox and unanimously carried.
On 'motion by Commissioner Cooley, seconded by Commissioner Sims
the Court unanimously voted to approve Budget changes for the Troubled
Youth Program Fund and the Criminal Justice Prosecutor Fund as pre-
sented by the County Auditor. A copy of such changes is attached to
and made a part of these minutes.
The Court next considered City-County Agreements for Civil
Defense Services and Public Health Services. After some discussion,
Commissioner Wilcox moved that the County Judge be authorized to enter
into such agreements effective only if accepted by both cities in the
present form. Motion was seconded by Commissioner Stasny and unan-
imously carried. A copy of such agreements is attached to these min-
utes.
The Court next considered bids to repair the ceiling on the
third floor of the Courthouse. On motion by Commissioner Wilcox,
seconded by Commissioner Stasny, the Court unanimously voted to accept
the low bid of Lenz Brothers in the amount of $450.00. Other bids
received were from 0 Plastering in the amount of $7'20.00 and Bee
Plastering in the amount of $2,800.00.
On motion by Commissioner Cooley, seconded by Commissioner Sims,
the Court unanimously authorized the purchase of a float trailer from
the State Highway Department in the amount of $800.00 by Precinct 2.

District Attorney, Tom McDonald requested a salary increase,,
for the secretary in that office from $5,400.00 annually to $5,940.00"
annually. On motion by Commissioner Wilcox, seconded by Commissioner
Cooley; the Court unanimously voted to approve the salary increase
effective June 30, 1975.
All members being present, the Court proceeded to approve the
following claims as submitted by the County Auditor for payment:
General Fund - Claims 1243 through 1248
Claims 1251 trhough 1287
On motion by Commissioner Sims, seconded by Commissioner Cooley,
the Court unanimously voted to approve the foregoing claims.
There being no further business, the Court adjourned.
The foregoing minutes were examined-in open Court and approved on
the 14t day of J ly 1975.

has already been funded or pledged•and Brazos
County has provided meeting space for the Bicen-
tennial Committee, desk space in the main lobby
of the Courthouse as well as secretarial help and
general use of all applicable equ'ipment and
facilities.

WHEREAS, the City of Bryan, City,of College Station, and Brazos County,
have created an adminLstrative agency named the Brazos County Health Unit for
the public purpose and objective of administering and enforcing all federal and
state health laws and city health ordinances in the respective jurisdictions of each
of the participating governmental entities; and
WHEREAS, Article 4413 (32c) authorizes intergovernmental contracting at

the local level including contracts between counties and cities; and
, WHEREAS, the City of Bryan, City of College Station, and Brazos County
intend to share in the cost on a percentage basis with the County to collect and
disburse the funds;
NOW, THEREFORE, THE UNDERSIGNED MUTUALLY AGREE AS FOLLOWS:
1.
That the matters set forth in the preamble are true and `correct and are
made a part of this agreement.
2.
In consideration of the benefits to be received by the City of Bryan, City o.f
College Station, and Brazos County, by reason of the joint venture, the parties
herein agree to pay, and Brazos County agrees to collect and disburse funds for
the operation of the Brazos County Health Unit, fiscal year July 1, 1975-June 30,
1976, 'on the following prorata basis:

- This contract is for a period of one year and all payments shall be made from
current revenues of each of the parties. Payments shall be made to Drazos County
by each of the two cities on a rrionthly basis with each monthly payment representing
one-twelfth of the total share for each of the two cities. Since the amounts set forth
in Section 2 and the monthly- amowits of one-twelfth of the total share provided in
Section 3 are estimates, the final monthly payment shall be adjusted to provide for

the local level including contracts between counties and cities; and
WHEREAS, the City of Bryan, City of College Station, and Brazos County
intend to share in the cost on a percentage basis with the County to collect and
