M. on Monday, March 10, 1975,' with the following present: William R. Vance, County Judge, presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; W. A. Stasny, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The minutes of the previously held meetings were examined and approved without change. The Court received, approved and orderd filed as submitted the folowing reports for April, 1975: B. V. Criminal Justice Fees (26~)........ 65.00 Total 500.00 The County Judge announced that his term as member of the Board of Directors of the Brazos Valley Development Council expires March 31, 1975, and asked that he be re-appointed. He also:announced that at an earlier meeting in his office, the leaders of the minority groups in this area had elected Mrs. Vera Martinez as their represent- ative to the Brazos Valley Development Council, and asked for her appointment by the Court. On motion by Commissioner Sims, seconded by Commissioner- Stasny,'the Court voted unanimously to appoint Judge Vance and Mrs. Vera Martinez for a three year term. The Court next considered a report by the Farmers Home Admin- istration as to the advisability requesting that Brazos County be declared a natural. disaster area as to cotton farming. After hearing from Mr. Herbert Wilson with the Farmers Home Administration, Comm- issioner, Sims moved that the Courts recommendation be forwarded to Governor Briscoe. Motion was seconded by Commissioner Wilcox and carried unanimously. Mr. Martin Riley next presented the vacating plat of LAKEWOOD ESTATES. After a discussion Commissioner Stasny moved that the vacating plat be approved. Motion was seconded by Commissioner Cooley and carried unanimously. The Court further discussed the preliminary plat of the RESUBDIVISION of LAKEWOOD ESTATES and made a number of suggestions. It was generally agreed that the Court would accept the preliminary plat with the recomendations noted. 4 ' G The Court next considered a request by the Bicentennial Committee for temporary funding in an approximate amount of $224.00. Mr. Claude Davis explained that there were two specific items desired at this time, a postmarking die hub and the printing of.a news letter to all of the members of the Committee. After being advised by Mr. Davis that it would be another three to six months before the Committee could sumit a proposed budget for the Court's consideration, Commissioner Sims moved that the County furnish the items requested. Motion was seconded by Commissioner Stasny and carried unanimously. e' - i , Next to be considered was a Resolution calling a referendum election in Brazos County, concerning the creation of a County Court At Law for Brazos County. A written ORDER CALLING ELECTION was duly introduced and read aloud. Commissioner Cooley moved that the order be adopted and that the PROPOSITION read "FOR OR AGAINST THE CREATION OF A COUNTY COURT AT LAW FOR BRAZOS COUNTY. The motion was seconded by Commissioner Wilcox and carried unanimously. A copy of such Order is attached to and made a part of these minutes. On motion by Commissioner Sims, seconded by Commissioner Stasny, the Court voted unanimously to appoint the following persons as election judges and election judge alternates to serve for the current year: VOTING PRECINCTS 1. Bryan High School , ' On motion by Connissinnor Tlilcox,,oecondod by Commisaionor Sims the Court voted unanimously to pay the County's share of the Brazos Valley Development Council's 1975-76 budget in the amount of $5,784.00. The Court next considered a contract with Texas Voting Systems for services and supplies for the upcoming-Cons titutional Amendments election to be held April 22, 1975. On motion by Commissioner Sims, seconded by Commissioner Wilcox, the Court voted unanimously to authorize the County Judge to enter into such,c ontract for a completed project cost of $3,800.00. A copy of such cont ract is attached to and made a part,of these minutes. After a discussion, Commissioner Sims moved that the County Judge be authorized to enter into a three year contract with such firm. Commissioners Wilcox, Sims and Cooley voted AYE, Commissioner Stasny voted N0, whereupon it was announced that the motion carried. Raymond B. Buchanan, Tax Assessor-Collector appeared before the Court to request permission to allow the employees in his office to work more than forty hours per week for the remainder of March. On motion by Commissioner Cooley, seconded by Commissioner Stasny, the Court voted unanimously to grant the overtime work. On motion by Commissioner Wilcox, seconded by Commissioner Cooley the Court voted unanimously to approve claim numbers 524 through 634 presented by the County Auditor for payment. There being no further business to come before the Court at this time the Court recessed until Tuesday, March 11, 1975 at 10:00 A. M. at which time to reconvene for the purpose of approving the claims to be paid out of the Road and Bridge Fund. March 11, 1975 The Court reconvened at 10:00 A. M. on Tuesday, March 11, 1975, with all members present, All members being present, the Court proceeded to approve the following cliams presented by the County Auditor for payment out of the Road and Bridge Fund: Precinct 1 - Claims 62 through 77 Precinct 2 - Claims 70 through 83 Precinct 3 - Claims 36 thourgh 47 Precinct 4 - Claims 7 through 19 County Shop - Claims 1 through 5 ,On motion by Commissioner Sims, seconded by Commissioner Stasny, the Court voted unanimously to approve for payment the foregoing claims. An election shall be held in Brazos County on the 22nd day of April, 1975, in conjuction with the Constitutional Amendment election to be held on said date; the polls shall be open for voting from 8 a.m. to 7 p.m. at polling places in all of the duly constituted election precincts heretofore established and described by natural or artificial boundaries or survey lines by orders adopted by the Commissioners' Court and on file in'its minutes; and to be held by the same officers appointed to conduct the election at each such polling place. Each presiding judge shall appoint two election clerks to serve at the polling place under his jurisdiction. Frank Boriskie is hereby appointed as the clerk for absentee voting; and the: Office of the County Clerk County Courthouse Bryan, Texas 77801 is designated as the place for absentee voting for said referendum 177 VOL9P CS. 179 election. During the lawful absentee-voting•period, said clerks shall keep said•pla-ce for absentee'voting open for absentee-voting E from 8:00 a. m.,to 5:00 p. m.'on each day except Saturdays, Sundays, I, and official' state holidays. 'It is hereby found that the NOTICE OF MEETING relating to this meeting and heretofore posted by the County Clerk of Brazos County, and the posting thereof, are hereby authorized, approved, adopted, ratified, and confirmed. vod N PACE h . i I A/_PAGE RESOLUTION WHEREAS, it has been made known'to the Commissioners''' Court of Brazos County, Texas, by'representatives of the Farmers Home Administration-'as well as other-residents of Brazos County that approximately thirty-five farmers of the county have been effected by excessive rainfall,during the months of August, September October,and November of 1974; and, WHEREAS, it has been estimated that approximately 40% of the cotton of Brazos County was lost due to excessive rainfall and that the cotton harvested was of lower quality than without such excessive rainfall; and, WHEREAS, the Brazos County Committee of the Farmers - Home Administration and the Brazos County Emergency Board of the Agricultural Stabilization And Conservation Service are on record as determining such loss, as evidenced by bopies of the minutes of such committees attached herero; and, .WHEREAS, the Commissioners' Court has been petitioned- to request that the Honorable Dolph Briscoe, Governor of the State Of Texas, as an emergency loan area under provisions of Federal Law; now, THEREFORE, be it resolved by-the Commissioners' Court of Brazos County, Texas, as follows: 1. That it has been found and determined that Brazos County did suffer excessive rainfall during the last five months of 1974. 2. Such excessive rainfall did adversely effect all cotton farmers in Brazos County. 3. That it would be desirable for Brazos County to be designated an emergency loan area under the applicable provisions of the laws of the United States, admin- istered by the United States Department of Agriculture. 4. That this resolution be forwarded to the Honorable Dolph Briscoe, Governor of the State Of Texas as a request that Brazos County, Texas, be so designated. Remarks k The rains started in early September with about 20%, of cotton crop harvested. Of the f remaining crop ono-lialf was lost or 40 In addition to this loss the remaining part that was salvaged was of lower quality and further increased the loss. 40,q, of the 1974 cotton crop in this area that was a total loss. Yield on this acerage was estimated at a bale per acre. This report is based on information obtained from local leading farmers, creditors, local Sinners, professional agriculturist and local ASCS records. All of this information was considered by the USDA Emergency Board. LLi Q. COUNTY SUPERVISOR'S COMMENTS: V® t' The farmers in Brazos County have suffered a heavy production loss'as a,result of the rains in the fall of 1974. Zubik, Agricultrual Loan Officer SUBJECT: Crop Financing BRYAN, TEXAS Crop financing in Brazos County has become very alarming to our Bank and myself due primarily to this past year's weather conditions and prices at harvest. Continued high increases in farm expenses versus low yields and prices in the year of 1974, and no brighter outlook for 1975, has concerned us as a financing institution for crop loans in the years to come. Being a State Chartered Bank in the State of Texas and governed by the State Banking Commission of this State, we are forced to turn away farm credit customers where two (2) or more years of carry-over loans exist. We are now reaching this critical state of turning away credit with several of our customers if 1975 does not bring about enough income for such pay-outs. It is my opinion that the Farmers Home Adminstration and other such government agencies recognize the ever growing problems facing farm production in Brazos County and become prepared to solve such financing problems for local farmers if farming in Brazos County is to survive In such times of low prices and high expenses. It is, also, my opinion that this year's farm problems have occured in an average cotton production year where very few early cotton contracts were offered and very little cotton sold, therefore, forcing the cotton producer into the Govern- ment Loan Program where not enough income was generated to pay-off the crop loans. Therefore, I believe that the Farmers Home Administration and other such govern- ment agencies that have the authority to request additional funds for crop financ- ing under these critical times, do whatever necessary to offer any additional programs or funds to such needy farmer businessmen in Brazos County. Our experience in renewing the loans of the membership of this Association of the Brazos County area discloses the credit status of our farmers to be in a very perilous condition. The crop harvest this past Fall was very poor, due to the continued rainfall at that time. After the harvest was completed the markets declined to the point that it was not profitable to sell cotton, and most of the cotton that was harvested is still unsold. Obviously conditions like this can cause a critical need for additional credit for agriculture, in order to operate the current crop. , In viewing the situation and condition of all agriculture operations ~ .1 it is our opinion'that in'Brazos County alone we could refer 30 loans to Farmers-Home, for their operatiion this next year. U PAGE $ (2) That it will, at any time same, may become necessary, pass and enter of record such orders as may be proper and necessary to legal- ize and facilitate the payment o; all sums due the Appraisal Firm. (d) By mutual agreement between the County and the Appraisal Firm each will lend every assistance to the other in the effective perfor- mance of this contract. (4) It is distinctly understood and agreed between the parties, and language contained herein which might be construed to the contrary notwithstanding that if any word, phrase, sentence, paragraph or provision of this contract shall be for any reason declared or adjudicated to be in- valid such decision or adjudication shall not affect the validity of the re- maining portions hereof. (5) All parties to this contract agree that in the event Appraisal Firm perfc,rrns any or. all of its services herein contracted by use of elect- ronic data processing equipment, all punch cards, tapes, programs, or other software of any kind or nature is and shall remain the property of Appraisal Firm and will not be delivered to the taxing jurisdiction at any time during the term of this contract or at the termination thereof. The execution of this contract is authorized by proper resolution duly adopted by the Commissioners' Court of the County and duly entered upon the minutes of such Commissioners' Court.
