M. on Monday, February 10, 1975, with the following present: William R. Vance,,County Judge, presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; W. A. Stasny, Commissioner of Precinct 4; Frank Boriskie, County Clerk. The minutes of the previously 'held meetings were examined and approved without change.- The Court received, approved and orderd filed as submitted the folowing reports for January, 1975:, B. V. Precinct 7, Place 2: Fines........................... ~ 45.00 Sheriff's Fees. ~ Constable, Precinct 7. ~ ~ Criminal Justice Fees ( 3 7.50 Total 52.50 The Court received bids from the City National Bank of Bryan,, First Bank And Trust of Bryan,-First National Bank of Bryan and the University National Bank of College Station, to act as Depository for Brazos County for the 1975-76 Biennium. After opening all bids the Court unanimously agreed to defer further consideration of such bids until Monday, February 24, 1975, at 10:00 A. M. The Court next considered the adoption of a Resolution opposing '.the proposed County Court At Law for Brazos County. Commissioner Sims moved that such Resolution be adopted by the Court, with Comm- issioner Wilcox seconding the motion. After a discussion, Commissioner Sims withdrew the motion to adopt the Resolution, pending the results of the questionaire distributed to members of the Bar Association for their feelings on additonal Courts in Brazos County. Commissioner Wilcox withdrew his second to the motion. B. V. Elkins, County Treasurer appeared before the Court -requesting.a clerk for his office on a half time basis. After some discussion, Commissioner Cooley moved that the Treasurer be allowed to hire such employee at a salary of $2.00 per hour. Motion was seconded by Commissioner Sims and carried unanimously. The nekt item for consideration was the second year application of the Troubled Youth Program. After considerable discussion Comm- issioner,Sims moved that such application be approved at a cost to Brazos County not to exceed $4,268.00. Motion was seconded by Comm- issioner Cooley and carried unanimously. The Troubled Youth Program had a second request, that Brazos County advance their share of the funding for operating expense for the program until the final approval of the application by the Criminal Justice Council. Commissioner Sims moved that such advance be made. Commissioner Cooley seconded the motion which carried un- animously. G I S I _ The Court next considered the appointment of four (4) additional members to the Brazos-County Bicentennial Committee. On motion by Commissioner Stasny, seconded by Commissioner Cooley, the Court voted unanimously to appoint the following four people: Mr. Donald Borgeson Mrs. Sherry Bradshaw 405 Olive, Bryan 1601 Holleman, Apt. R-1, Col. Sta. Mrs. Doris Watson Ms..Emily Pickett 1307 Angelina Court, Col. Sta. 1314-A Barak Lane, Bryan The Court next considered bids for three (3) five drawer legal file cabinets for the District Clerk's Office. On motion by Commiss- ioner Cooley, seconded by Commissioner Stasny, the Court voted unan- imously to accept the low bid of Hart Office Centers in the amount of $792.00. The other bid being from Hill Printing And Stationery Co. in the amount of $948.00. Consideration was next given to bids for office furniture and a file cabinet for various offices in the Courthouse. On motion by Commissioner Stasny, seconded by Commissioner Cooley, the Court voted unanimously to accept the low bid of News Office Supply in the amount of $460.00 for two (2) metal secretarial desks (one for the District Clerk's Office and one for the Office of the Justice of the Peace, Precinct 4, place 2) and $110.00 fora four drawer file cabinet for the Office of Justice of the Peace, Precinct 4, Place 1. Other bids received were from Advanced Business Equipment, Inc., Kraft Furniture Co.. A bid was received from Engineering And Office Supply, too late to be opened. The Court gave further consideration to bids for typewriters for the Courthouse. On motion by Commissioner Cooley, seconded by Comm- issioner Sims, the Court voted unanimously to accept the low bid of IBM in the total amount of $1,107.00 for two (2) model D typewriters with a 160 carriage. SAE•E15y 14 T l v N AGE 6 n . I The next item for consideration was bids for two (2) new auto- mobiles for the Sheriff's Department. On motion by Commissioner j Stasny, seconded by Commissioners,Cooley, the Court voted unanimously to accept the low bid of Corbusier Chevrolet Co. in the amount of $9,318.00, less trade in of $950.00 for a 1972 Pontiac and $1,500.00 j trade in on a 1973 Pontiac for a total price to the County of $6,868.00:,-", other bids received were from Beal Ford in the amount of $7,943.64, Allen Oldsmobile Cadillac, Inc. in the amount of $8,066.62. A "no bid" was received from Halsell Motor Co., Inc. along with a letter requesting a two week advance notice of bids. On motion by Commissioner Stasny, seconded by Commissioner Wilcox, the Court voted unanimously to pay the expenses of Foster Care in the amount of $1,172.40 with a.reimbursement from the State Department of Public Welfare in the amount of $1,528.77. On motion by Commissioner Cooley, seconded by Commissioner Stasny, the Court voted unanimously to pay the annual dues of Brazos County to the County Judges And Commissioners Associaton of Texas in the amount of $100.00 The County Judge informed the Court of three (3) vacancies on the Brazos County,Child Welfare Board, and that a letter had been received from Mrs. Thelma vanOverbeek, Chairman suggesting the following persons be appointed:- Rev. Hubert Beck, Mr. Jesse Vivero, and Dr. Larry Keeley. On motion by Commissioner Stasny, seconded by Commissioner Wilcox, the Court voted unanimously to appoint Mr. Jesse Vivero for a one year term ending December 31, 1975 to fill the vac- ancy created by the death of Betty Taylor and Rev. Hubert Beck and Dr-: Larry Keeley for three year terms each, ending December 31, 1977. 1 w. r` S1 The next matter for consideration was the proposal by South/West Planning Associates for services in the preparation of the County's Community Development pre-application as required by HUD. On motion by Commissioner Cooley, seconded by Commissioner Sims, the Court voted unanimously to accept such proposal. A copy of such proposal is attached to and made a part of these minutes. District Attorney, W. T. McDonald, Jr., president of the Bar Association of Brazos County presented the Court with the tabulation of the survey of the Bar Associaton on the creation of additional Courts in Brazos County. After consideration of the survey, Commissioner Sims moved that Brazos County adopt a Resolution opposing the proposed County Court At Law. Motion was seconded by Commissioner Wilcox and carried unanimously. A copy of such Resolution is attached to and made a part of these minutes. The Court having hereto for requested that the County Attorney advise the Court whether or not authority exisits for the payment of a car allowance to the District Judger the County Attorney reported that in his opinion, supported by prior opinion of the Attorney General H 96 and H 152, no authority exists under present law for such car allowance when not related to the number of miles actually trav6l•dd Commissioner Wilcox therefore moved that the County Auditor be instructed to discontinue such payment. Motion was seconded by Commissioner Cooley, and carried unanimously. The Tax Assessor Collector next presented for approval, Certificates of Cancellation numbers 8130 and 8131. County Clerk • ~ f I 1 , } -77 -F,r ~ . ~ ~ 4` ,t : h r , C jr.... wr• . • 7 •-'.7 _ i.. :mgr. n.~.~~.~_._--~.-.._. , I RESOLUTION T.1LIT+n ~ A n .•1...f%- , -r r n _ • •••••+•..aav vvuaua+u.~l i.Val~r$ v~/uL 1.. 1101 LCCII advlSed Lh.&L 1C9lb1d L.1ULL has been introduced which would create a County Court At Law of Brazos County and would terminate the existing Civil and Criminal jurisdiction of the County Court of Brazos County, and WHEREAS such legislation provides that such County Court At Law would have jurisdiction over juvenile matters in spite of the fact that present law vests exclusive jurisdition of juvenile matters in the District Court of Brazos County, and WHEREAS the creation of a County Court At Law is usually requested by County Officials for the purpose of (1) providing a Court in which the Judge is required to be a practicing Attorney or (2)handling a case load which is too great for the constitutional County Judge to handle in addition to his administrative duties as presiding officer of the Commissioners' Court, and WHEREAS the Commissioners' Court has determined that neither of the problems stated in the foregoing paragraph exist in Brazos County at the present time, and WHEREAS the Commissioners' Court has agreed with the present County Judge to pay a salary comensurate with full time service effective January 1, 1976, in order to insure that both the administrative duties and judicial duties of the present County Judge can be properly discharged through full time service, and WHEREAS the Commissioners Court has determined that the creation of a County Court At Law would result in an increase in the budget of approximately $75,000.00 for the first year and $60,000.00 per year for each year thereafter, to provide for salaries, clerical help, court reporting services and office space and equipment, which expenditures the Commissioners' Court feel are both unnecessary and unwarranted in light of the present caseload which would be handled by such a County Court at law, and WHEREAS the Commissioners' Court is desirous of advising the tax i paying public and our elected representatives of the foregoing facts and of'its opposition to the enactment'of such legislation, now, therefore i . i BE IT RESOLVED by the Commissioners' Court as follows: • i (1) That the Commissioners' Court is opposed to the enactment of Senate Bill No. 87 by the Legislature as•an unnecessary and unwarranted creation of a County Court At Law and expenditures of funds, and i (2) That the Commissioners' Court calls upon all inter- ested tay paying citizens of Brazos County to oppose ti this legislation, and (3) That a copy of this resolution be forwarded to our ~ elected officials with a request that such legislation not be enacted at this time. Thank you for the opportunity to visit with the Court in regard to Brazos County's participation in the Community Development Program. We appreciate this chance to work with you for the improvement and growth of Brazos County. Approach It is an understandable and common goal of County officials that a capable, experienced staff be developed so that effective and directed administration of programs can be realized. This is no less the case with your Community Development Program. We recommend, therefore, and are prepared to provide services which will actually supplement staff and commissioners court action. In this relationship we will provide both general and specific services as they are needed, to prepare the County's Community Development pre-application. We also understand that this pre-application serves as the preliminary step utilized by HUD in determining funding priorities for discretionary grant applicants. Scope of Consultant Participation It is our intention trr'provide Brazos County with professional services necessary to prepare the County's Community Development pre-application based on available information and forms in such a manner as to be acceptable to HUD, Dallas area office. We will be working with County staff and commissioners in order to provide HUD with required documents. Wimbish, Vice President, who is State-certified as a qualified Planner-in- I Charge for HUD-assisted planning and management programs will be assisted by i Cindy Reinhardt, Program Director of South/West Planning Associates. Mr. Wimbish will be responsible for overall coordination and application of the firm's personnel i. and resources in this project. Ms. Reinhardt brings to this project-her invaluable { experience in HUD's various community development programs. (See attached brochure). I i Cost Estimate, Schedule of Work, and Billing Procedure I t I i We propose to bill Brazos County for work accomplished according to the attached standard fee schedule. Based on our past experience and the existing Federal I requirements as of February 5, 1975, the cost to the County for our firm performing { all of the services outlined above for the pre-application will not exceed $500.00 up to the point of submitting the required pre-application to HUD no later than March 1, 1975. CONSULTATION & SALARY: For services rendered outside our offices, the following daily fees shall apply: Staff Classification, Daily Fees Principal $180.00 i Staff Associates $140.00 Para Professionals $100.00 These daily fees apply only to time in the field away from our offices. Working time in excess of 8 hours per day or 40 hours per week, such overtime will be billed of 115% of the above rates. OUTSIDE SERVICES Invoice costs of services and expenses charged to SOUTHWEST PLANNING ASSOCIATES by outside consultants, professional or technical firms engaged in connection with the order, plus 10% overheod,costs. D. REPRODUCTION AND PRINTING SERVICES The invoice costs of reproduction and printing services done for SOUTH/MEST PLANNING ASSOCIATES clients plus handling charge. E.' MISCELLANEOUS EXPENSES The invoice cost of materials, supplies and services, including communication expenses, procured by SOUTHWEST PLANNING ASSOCIATES from outside sources. All out-of-pocket expenses not included in items A, B, C, or D will be included in this category. F. METHOD OF BILLING Unless otherwise provided, billings will be made monthly as the work progresses. All invoices are payable when submitted. SOUTHWEST PLANNING ASSOCIATES reserves the right to charge interest at 10% per year on balances unpaid after 30 days, plus reasonable attorney fees in the event some are incurred in making collections. ~v®
