A regular meeting of the'Commissioners' Court'of Brazos County, Texas,'
was held in•the Commissioners' Courtroom-in the Courthouse ,in Bryan Brazos County,
' Texas, beginning at 10:00 A. M. on Monday, March 11, 1974 with the following
present:

Mr. E. E. Merrell next presented the Court with the bid of Young ;.r
Brothers, Inc., Contractors, the Court having advertised for bids in March as
required by law, but having received only one bid. The bid of Young Brothers,
Inc., Contractors in the amount of $14,649.45 was accepted on motion by
Commissioner Sims and seconded by Commissioner Cooley, which motion carried
unanimously and payment was authorized out of the-Revenue Sharing Fund. The
County Judge was further authorized to execute the documents-necessary to accept
the bid and carry out the proposal.
The Court next considered the request of the Beacon Baptist Church
of Bryan for exemption from ad valorem taxation on the Church parsonage at
3607 Oak Hill in Bryan. On motion by Commissioner Stasny, seconded by Commissioner
Sims, the Court unanimously voted to grant such exemption for as long as the
property is used for the purpose stated.
On motion by Commissioner Stasny; seconded by Commissioner Wilcox,
the Court unanimously voted to appoint Dr. 0. C. Cooper to the Mental Health
and Mental Retardation Board of Trustees to fill the vacancy created by the
resignation of Norman Beal.
On motion by Commissioner Stasny, seonced by Commissioner Wilcox,
the Court unanimously approved the appointment of Judge W. C. Davis and
Commissioner Bill Cooley to the Board of Directors of the Brazos Valley Develop-
ment Council for a three year period. Commissioner Cooley obstained from voting.
The Court next considered the request of the Twin-City Mission, Inc.
for exemption from ad valorem taxation on 1 1/3 acres at 1208 San Jacinto St.
and 9~ acres at the south end of South Randolph Street. On motion by Commissioner
Stasny, seconded by Commissioner Wilcox the Court unanimously voted to grant
such exemption for as long as-such property is owned by the Twin-City Mission,
Inc.
The Court next considered the statement of Davis and Stacy in the
amount of $653.70 for legal representation in a Condemnation Suit. Motion was
made by Commissioner Sims to pay such statement out of the Road and Bridge
Fund and request re-imbursment from the City of College Station for their
protion of the fee. The motion was seconded by Commissioner Wilcox and carried
unanimously.
On motion by Commissioner Cooley, seconded by Commissioner Stasny the
Court unanimously voted to reappoint Dr. Nena Harris, Mrs. Mary Jernigan and Mrs.
Thelma van Overbeek to the Child Welfare Board for 4 term of 2 years.
On motion by Commissioner Wilcox, seconded by Commissioner Stasny the
Court unanimously voted to pay the expenses of Foster Care for the month of
February, 1914 in the amount of $911.08.
On motion by Commissioner Cooley, seconded by Commissioner Stasny the
Court unanimously voted to pay the sum of $2,125.00 td the City of College Station
for fire calls for January and February.
On motion by Commissioner Stasny, seconded by Commissioner Sims'the
Court unanimously voted the pay the invoice of-Texas Voting Systems, Inc. in the
amount of $8,400.00 for 50 additfonal votingrunits with payment to be made out of
the Revenue Sharing Fund.

The•Court next considered the Specifications regulating the filing'.
for record'of subdivision plats and establishing construction standards and
other requirements pertinent thereto for all subdivisions situation outside
the boundaries of any incorporated town or city in Brazos County, Texas.
After discussing such requirements, motion was made by Commissioner Cooley and
seconded by Commissioner Sims to,adopt such specifications as submitted and
carried unanimously. A copy of such specifications are attached. to and made
a part of these'minutes.
The court next discussed the matter of ambulance service for. Brazos
a County,,the '••'County Judge reported that's
private-operator had been found who was `
willing to enter into business if consideration could be made in the way of
financing of vehicles and that the County's share of such vehicles would not'
exceed $5,000.00. On motion.by Commissioner Wilcox, seconded by Commissioner
Sims the Court unanimously voted to authorize the County Judge to enter into
the necessary agreement with the City of Bryan and College Station to carry
out the terms of the preliminary agreement and to pay Brazos County's portion
" out of the General Fund no to exceed $5,000.00.
The Court next considered bids for the pruchase of a tractor for
" Precinct 2. On motion by Commissioner Cooley, seconded by Commissioner Sims the "
Court unanimously voted to purchase a 57 draw horse power tractor from Inter-
national Harvester in the amount of $5,500.00. Other bids received were from
Cen-Tex Tractor Company and International Harvester.
On motion by Commissioner Sims, seconded by Commissioner Stasny the
Court unanimous) voted to
unanimously pay the annual dues to the County Judge and Commissioners. ,
Association of Texas in the amount of $100.00.
On motion by Commissione Stasny and duly seconded the Court unanimously
voted to pay all bills which have been properly filed and approved.

SUBDIVISIONS SITUATED OUTSIDE THE
BOUNDARIES OF ANY INCORPORATED TOWN
OR CITY IN BRAZOS COUNTY, T E X A S

COUNTY OF BRAZOS X B R A Z 0 S COUNTY, TEXAS
It is Ordered by the Commissioners' Court of Brazos County, Texas,
on this the 11th day of March, 1974, that the requirements
and policies for the construction of roads and streets in subdivisions
in Brazos County, Texas, adopted by resolution of March 11th, 1974,
under the provisions of Article 6626x, Vernon's Texas Civil Statutes, be
the following:
A - GENERAL
1. The owner or owners of any tract of land situated outside the
boundaries of any incorporated town or city in Brazos County, Texas,
under the provisions of Article 970a, Vernon's Texas Civil Statutes,
who, subsequent to the Acts 1957, 55th Let. P. 1302 ch. 436, has divided
or will divide the same in two or more parts for the purpose of laying
out any subdivision of any such tract of land, or for laying out suburban
lots or buildings lots, streets, parks or other portions intended for
public use, for the use of purchasers or owners of lots of any such
tract of land, must comply with the rules and regulations adopted herein.
At any time in the specifications that the term "County
Commissioner" is used, it shall refer to the County Commissioner of the
Precinct in which the subdivision is located.
2. The term "subdivision", as used in these regulations, further
shall mean the division of a parcel of land into two (2) or more lots

ment, or if a new street is involved, any subdivision of a parcel of

of land into lots or parcels of five '

deemed a•subdivision. The term includes re-subdivision, and when
appropriate to the context, shall relate to the process'of subdividing'

division as defined herein, should develop a preliminary plan in sketch
form and submit same to the County Commissioners' Court, Courthouse,
Bryan, Texas. The Commissioners' Court will review the preliminary
plan and if appropriate, will inform and discuss with the sibdivider
the results of the review.
b. (SECOND PHASE) Following the procedure outlined in Phase
1. above, if the subdivider decides to continue with his project, he
r
should prepare a Preliminary Plat for submission with an application
for conditional approval. If the review of this Preliminary Plat•by
the Commissioners Court is found to be in conformance with the require-
ments set forth herein, it will grant conditional approval, subject to
- t conditions agreed upon in writing.
:le, c. (THIRD PHRASE) - (FOR FINAL PLAT) The subdivider now can
stake out the tract on the ground in accordance with the conditional
approval given to the Preliminary Plat, and he posts a bend to guarantee
completion of improvements stipulated and submits same with a Final
t
Plat and such other for approval by the Commissioners' Court. The
Court then reviews the application material or documents, with an
application and grants its approval of'the Final Plat, or else informs
the subdivider of what is lacking to obtain approval for recording.
The subdivider then record's the approved Final Plat and other documents
with County Clerk and can proceed with his development plans and program,
and thereafter, his sales of lots and houses.
2. The Final Plat to be recorded with the County Clerk must

4 Plat shall be an original drawing on linen paper,

paper approved by the Commissioners' Court, with true dimensions
to correspond with the engineer's scale as described on said plat. The
Plat must be on one or more sheets measuring 24 inches wide and

inches long in size, with a 2-1/2 inch binding margin on the left of
said sheet, and an appropriate margin on each of the other three sides.
Where the area being subdivided will not fit in the aforesaid dimen- ,
sions, two or more sheets shall be used. If two or more sheets are used
a key map showing the entire area shall be drawn on the .''irst sheet', or
on a separate sheet.
c. The name of the proposed subdivision must not be the same r
in spelling to the name or names of any other subdivision in Brazos,

e. Layouts that will cause unsatisfactory drainage conditions,.
or that will unduly complicate maintenance of streets, will not be
accepted.
f. Lot and block numbers are to be arranged in a systematic
order and shown on the plat in distinct and legible figures.
g. Location of lots, streets, parks, easements and other
geatures must be shown with accurate dimensions in feet and decimals
of feet. Length of radii and arcs of all curves, with bearings of
all tangents, must be shown, also distances from all angle points and
points of curve to lot lines.
h. A certificate of dedication, duly acknowledged, of all
streets, parks, playgrounds and other land intended for public use
forever, shall be apart of the plat. The dedication must be absolute.
i. The-plat shall show all natural drains and water courses
as they exist on the,ground. If deemed necessary by the Commissioners'
Court, the plat shall show the contour lines correcting points of equal
elevation at specified intervals.
J. Drainage courses in subdivisions containing small lots
and blocks shall be dedicated. In subdivisions entirely containing
"acreage tracts" of five (S) or more acres in,size, an easement will
be accepted. A minimum width of 20 feet will be required.
k. Dedication of utility easements not less•than 16 feet
wide must be provided for public on each side of all streets. No

1. Adequate off-street parking space must be provided in

m. Streets shall have a minimum width of right-of-way of
sixty (60) feet, and must provide unhampered circulation through the
subdivision. Where a dead-end street is designed to be so permanently,
a turn-around shall be provided at 'the closed end having an outside

q. No street shall have an abrupt offset, or "jog" in it.
r. Where streets in an adjoining subdivision dead-end at
the property line dU the new subdivision, the said streets shall be
continued through the new subdivision, either on a straight line, or
a curve as provided elsewhere herein. Where no adjacent connections
are platted, the streets in the new subdivision must in general be
the•reasonable projections of streets in the adjacent subdivided tracts.
All streets in new subdivisions shall be platted so that a continuation
of said streets may be made in other subdivisions in the future.
s. Where part of a street has been dedicated in pnd adjoining
subdivision adjacent to and along the common property line of the two
subdivisions, enough width of right-of-way must be dedicated in the new
subdivision to provide the minimum width specified herein.
t. No squares, "islands"., or other obstructions to traffic
shall be reserved within the right-of-way; this shall not exclude small
parts where the streets are properly curved, or esplanades.
u. A blank space measuring 3 inches by S inches for the certi-
ficate of approval to be filled out by the County Clerk, with the approv-
al of the•CommissioAers' Court, shall be provided on the plat.
v. Where there is an existing subdivision and two (2) or more
lots are to berre-subdivided in same, a vacating plat approved by the
County Commissioners' Court and the Commissioner concerned shall be
presented to the Commissioners' Court for approval prior to filing with
the County Clerk. The same specifications shall apply that govern filing

possible and that drainage water from streets and alleys be taken to
streets, alleys, or drainage courses as quickly as possible and that

3. Minimum grades of streets and alleys normally shall be three-
tenths (0.30%) of one per cent (1%) and shall not be so steep that
destructive velocities may occur, unless provision is made to prevent
erosion of earthen ditches, or damage to pavements.
When requested by the County Commissioners' Court, profiles
of streets shall be furnished, showing existing centerline elevations,
both right-of-way line elevations and proposed centerline grade. At
creek or other drainage crossings where consideration must be given
to the proper handling of storm water, a profile of the flow line of
such creek oic other drain extending sufficient distance both upstream
and downstream to determine proper street grade and size of drainage
structure at such crossing will be required.
4. Drainage structures-of permanent type shall be provided at
crossings of drainage courses with streets where prescribed by the
County Commissioners' Court or the Dommissioner concerned in order
that a minimum of inconvenience and hazard to the traveling public will
occur, and in order to minimize damage to, and excessive maintenance of,
public property. Such drainage structures shall have a minimum of 36'
clear roadway.'

6. Where a street section (without curbs) is-constructed, the
4 flexible base shall have a minimum thickness of 6" after compaction,
and a minimum of 24 feet wide and feather edges as shown on Brazos
County Road Street Section. If paved, the base shall be of minimum

thickness of six inches after compaction, and a minimum width of 24
feet, and feather edged as mentioned above. All road building materials
shall be approved by the Commissioner concerned.

r 7. In order to insure that the streets in accepted and approved
subdivisions are constructed in accordance with the above specifications,,
and to guarantee that they are maintained to the satisfaction of the
Commissioners' Court and the Commissioner concerned in a good state of
repair, for the period of one year after the approval and acceptance
of each street, or portion thereof, shown on said subdivision Plat,
the Owner shall file a Construction Bond, and a Maintenance Bond, each

The above distances determining the linear feet involved are
to be measured along the center line of said street or alley between
the intersection of said center line.
The condition of said Construction Bond shall be that the owner of
said approved and accepted subdivision shall begin construction of such
streets as are shown-on the subdivision plat within a period of ninety
(90) days from the date of the approval of the plat of said subdivision
by the Commissioners' Court of Brazos County, Texas, and prosecute and
complete such construction in accordance with the specificationg herein
provided within a reasonable number of working days to be determined and
agreed upon by the owner and the Commissioners' Court, and said Con-
struction Bond shall remain in full force and effect until all of the
streets in'said approved and accepted subdivision have been completed ,
to the satisfaction of the Commissioners'-Court and the Commissioner
concerned.
In the event any of all of the streets as constructed by the
owner fail to meet the requirements of the specifications herein pro-
•vided and are not accepted and approved by the Commissioners' Court
and the Commissioner concerned, and said owner fails or refuses to
correct the defects called to his attention in writing by said Com-
missioners' Court, the unfinished improvements shall be completed at
the cost and expense of obligee8 as in said orders provided.

8. The condition of said Maintenance Bond

owner shall guarantee to maintain, to the satisfaction of the Com-
missioners'Couri and the Commissioner concerned, all of the streets '
shown on,an accepted-and approved subdivision plat; in a good'state 'r
of -repair for the period of one year from the date of such acceptance
and approval.

Periodical inspections of all of the streets that have been
approved and accepted in an accepted and approved subdivision will be

event any or all of said streets'are not being maintained in a good
state of repair, the owner will be so advised in writing and if after
a reasonable time he fails or refuses to properly maintain said streets,'

D - GUARANTEE OF PERFORMANCE
1. If the subdivider elects to construct the required improve-
ments prior to recording of the plat, after such plat has been approved,
all such construction shall be inspected while in progress, by the
Commissioner, and must be approved upon completion by the Commissioners'
Court. A Certificate by the County Commissioner that the construction
conforms to the plans and specifications and the standards contained
in or referred to herein must be presented to the Commissioners' Court
prior to approval of the Final Plat.
2. If the subdivider decides or elects to file security in lieu
of completing construction prior to Final Plat approval, he may utilize '
one of the following methods of posting security. If the subdivider
elects to file security, the plat shall not be approved unless the
subdivider has done one of the following:
a. Performance Bond: Has filed with the Commissioners' Court
a bond executed by a surety company holding a license to do business in
the State of Texas, and acceptable to the Commissioners; Court on a
form approved by said Commissioners' Court, in an amount of the improve-
ments required by this ordinance and the time of completion of the
improvements as estimated by the Commissioners' Court. The Performance
Bond shall be approved as to form and legality by the County Attorney; or
b. Trust Agreement: Has placed on deposit in a bank or trust
company in the name of Brazos County, and approved by the Commissioners'
Court, in a trust account, a sum of money equal to the estimated cost
of all improvements required by this ordinance, the cost and the time
of completion as estimated by the Commissioners' Court; selection of
the Trustee shall be subject to approval-by the Commi,ssioneri' Court

struction only if it fails to comply with the standards and specifi-
cations contained or referred to herein. If he rejects such con-
struction, the County Attorney shall, on direction of the Commissioners'
Court-, proceed to enforce the guarantees provided in this ordinance.
4. When good cause exists, the Commissioner concerned may extend
the period of time for completion under Paragraph D-2 of this Section.
Such extension of time shall be reported to the Commissioners' Court
and recorded in the Minutes. No such extension shall be granted unless
security as provided in said paragraph D-2 has been provided by the
subdivider covering the extended period of time.
5. Neither the Subdivider nor the contractor nor sub-contractor
shall make a connection to or tap into the County and/or City water
distribution system, electric system, or sanitary sewer system. The
subdivider shall furnish all necessary materials to make the final tap
or connection.
6. Guarantee of Workmanship.and Materials: The subdivider shall
require his construction contracts, with whom he contracts for furnish-
ing materials and for installation of the improvements required under
this ordinance, and shall himself be required to furnish to the
Commissioners' Court a written guarantee that all workmanship and mater-
ials shall be free of defects for a period of one year from the date of
acceptance by the Commissioners' Court.
