The minutes of the meeting held September 10, 1973, were read
and approved without change.
The Court received, approved and ordered filed as submitted
the following reports for September.

ry Pursuant to a Proclamation issued by the Governor'of the State

of Texas, the Court, on motion by Commissioner Wilcox, seconded by
Commissioner Stasny; unanimously voted to cause an election to be Y
t held,in all voting precincts in Brazos County, Texas, on Tuesday,
i
November 6, 1973, for the purpose of voting on nine proposed
amend- ments to the Constitution of'the State of Texas, to direct the
issuance of all notices of such election'as required by law.
The Court next considered a proposal by California Liquid Gas
Corporation for the exchange of a 0.0738 acre tract for a tract of~"
Y -
0.3119 acres out of the property known as the Saddle Club Property,'
the terms of which exchange would be that California Liquid Gas
Corporation would pay to Brazos County the sum of $4,000.00, convey
title to the 0,0738 acre tract to Brazos Count
y, relocate the road
entering the Saddle Club property to a new location acceptable to '
the County, and refence the new property line with a fence comparable-
to their existing fence. After a discussion, Commissioner Wilcox
moved that such proposal be accepted and that the County Judge,be .
authorized to execute the necessary instruments to accomplish such
exchange, including a deed to the tract of 0.3119 acres. The motion,
was seconded by Commissioner Sims and carried unanimously.
On motion by Commissioner Wilcox, seconded by Commissioner Sims,,
the Court unanimously voted to approve the payment of $560.00 in
'Foster Care expenses for the month of September, 1973.
On motion by Commissioner Wilcox, seconded by Commissioner Sims,,
the Court voted unanimously to approve the payment of $244.00 to
the C'ity'of.Bryan for fire calls for the month of September, 1973.
On motion by Commissioner Sims, seconded by Commissioner Wilcox,
,
the Court voted unanimously-to pay Honeywell, Inc. the sum of $722.00
for maintenance of temperature controls in the Brazos County Courthouse
for the period of July 1, 1973 through December 31; 1973.
On motion by Commissioner Sims, seconded by Commissioner StasnY,
the Court unanimously voted to pay the statement of Cox Paving Company
in the amount of $47,197.00 for work in the respective
precincts,

per precinct from the State Lateral Road Fund, with the balance for
each precinct's work to be paid from that precincts budget out of
the Road and Bridge Fund, except that an additional $754.00 shall
be paid out of the State Lateral Road Fund for Precinct 2.
The Court next considered the filing of a plat of PARKWAY
ESTATES, 2nd Installment, submitted by Vance Investment Co.and i
voted to approve same for filing, subject to prior approval by the
City Planning Commission and with the understanding that the County
would be under no obligation to build, construct or maintain any
of the streets or roads in said Subdivision.
There being no further business, the Court adjourned.
SPECIAL MEETING - OCTOBER 22, 1973
A special called meeting of the Commissioner's Court of
Brazos County, Texas, was held on Monday, October 22, 1973, at
10:00 A. M. in the Commissioners Courtroom, Brazos County
Courthouse, Bryan, Texas, pursuant to notice duly given by posting
and pbulication with the following present:
William R. Vance, County Judge, presiding;
Bill J. Cooley, Commissioner Precinct 1;
Walter Wilcox, Commissioner Precinct 2;
Randy Sims, Commissioner Precinct 3;
W. A. Stasny, Commissioner Precinct 4;
Frank Boriskie, County Clerk.
The County Judge opened the Public Hearing on the Budget for
Brazos County for the year 1974, such Budget having been duly
filed with the County Clerk on the 1st day of October, 1973, and
having remained on file for the period of time required by law.
The County Judge stated that the salary shown for the Probation
} Officer was incorrectly stated and should be $10,500.00, the actual
salary currently being paid such officer, and that such correction
should be made.
No other person appeared in connection with the Budget, and
the County Judge,announced that the Public Hearing thereon was
closed.
On motion by Commissioner Sims, seconded by Commissioner Wilcox,
the Court unanimously voted to adopt such Budget, with one correction
noted, as the Budget for Brazos County for the year 1974, and ordered
same filed in the manner prescribed by law. A copy of such Budget

On motion by Commissioner Wilcox, seconded by Commissioner Sims,,
the Court unanimously voted to authorize the County Judge to execute'
t a renewal contract with Austin State Hospital for operation of the
Community Outreach Center for the period of September 1,'1973,
through August 31,
1974 , at a cost to Brazos County of $2,487.00.
On motion by Commissioner Cooley, seconded by Commissioner `
Stasny,•the Court unanimously voted to authorize
• payment of the sum '
of $142.50 to the City of College Station for fire calls for the month
of September, 1973.
The Court next received bids for the -ptirchase of binders for
the property owners maps being acquired from the City of Bryan, and
after discussion and on motion by Commissioner Wilcox, seconded by
Commissioner Stasny, voted-to accept the low bid of Stafford-Lowdon '
in the amount of $136.54 for such binders.
The Court next considered the necessity of appointing replace
ment election judges and alternates,for certain precincts for the
November 6th election, On motion by Commissioner Stasny, seconded
by Commissioner Wilcox, the Court unanimously voted to appoint,'the
following persons as replacements for those persons appointed
heretofore:

Mrs. Marshall Crenshaw - Presiding Judge.
Precinct 13 - Henderson School - Mrs. Violet Allen
Presiding Judge
Precinct'20 - The University Center - Jenni Guido -

The Court next authorized the issuance of proper notices of
a Public Hearing on the Exemption of Brazos County, or•a portion
thereof', from operation of the laws respecting the use of Herbicides
(H. B. 402, Acts of the 53rd Legislature, 1933.) to be held on.

'Y• NOTICE OF HEARING
The Brazos County Commissioners Court at its regular
monthly meeting on November 12, 1973, will consider
whether or riot there is any crop or vegetable of value
being grown in Brazos County•or portion of said County
that is susceptible to damage by„the use of herbicides
as defined by Article 135b-4,(as amended), Texas Vernon's
Annotated Civil Statutes. Any Citizen or landowner of
Brazos County is cordially invited to attend the meeting
' and voice any opinion he might have'regarding the use of
herbicides.
Article 135-b-4, Sec. 2(a)"defines herbicides as follows:,
"2, 4-Dichlorophenoxyacetic,Acid (2,4-D), 2,4,5-Tri-
chlorophenozyacetic Acid (2, 4, 5-T;) 2 Methyl-4-chlor-
ophenox-Acid (MCP) 2,4,5-Trichlorophenoxypropionic Acid

On motion by-Commissioner Sims, seconded by Commissioner
Cooley, the Court voted to request that all offices of Brazos County

Gentlemen:
' As your Budget Officer, and in accordance with the law', there is submitted
herewith the proposed Budget of Brazos~`Count Texas
Y~ for the fiscal
st, ,(calendar) year of 1974, including all•anticipated revenue and the proposed
disbursements. -This budget contains the necessary schedules'and tabulations
in proper detail.
The Texas Statutes require that the County Budget be prepared and submitted,
and that a public hearing be held thereon, after which it shall be approved
and adopted by the-Commissioners Court, and followed throughout the budget
year.
The within budget calls for a total operating expenditure during,the year
1974 of $1,546,530.00, and an additional $125,980.00 for retirement of road
bonds.
This budget.makes provision for Federal Revenue Sharing, both as to the
anticipated share to-be allocated to Brazos County and as to limitations
placed by the Congress upon the expenditure of such funds. As further inform-'
ation is made available, revisions or amendments concerning Federal Revenue
Sharing'may be necessary.

In 1956 the people of Texas voted to amend Article 8, Paragraph 9, Section 8,
of the Texas Constitution so as to allow the Commissioners' Court of Texas to
exercise judgment and discretion in levying taxes for the several different
funds so long as the total operating levy does not exceed 95 cents per hundred
of assessed valuations. Based on actual need, the within budget, supported
by the detailed estimates of anticipated revenue and the proposed expenditures,
calls for a levy for 1974 of .51 cents for the General Fund, .05 cents for the
Jury Fund, .16 cents for the Permanent Improvements Fund and .23 cents for the
Road and Bridge Funds, for the total-of :95 cents. In accition on the 26th
day of June, 1965, the people of Brazos County, Texas authorized the issuance

of $400,000.00 in Road Bonds and further authorized the le of an annual
:ad valorem tax on all taxable property within the county,for the
payment,- thereof.. Based upon the total assessed valuation a levy of .05 cents is,
sufficient to retire this issue. Additionally, on the 11th day of March,
'1967, the people of Brazos County authorized the issuance-of $800,000.00 in
Road Bonds and further authorized the'le
vy of an annual ad valorem tax on.
all taxable property except the first $39000900 valuation of residential
homesteads, not to exceed..30 cents per one hundred,dollars of valuation, for

the ,payment thereof. On the 24th day of February, 1968, a'bond issue in the
} amount of $350,000!00 was authorized, payable from the proceeds of the-Farm
' to Market and Lateral Road Fund Tax, of which $250,000.00 of the bonds were
issued in 1968 and $1001000.Q4 in 1969. Based upon the total assessed valu-
ation excluding the first $39000.00 valuation of residential homesteads, a
levy of .08 cents is sufficient to retire the 1967 series, a,levy of .05 cents;
is sufficient to retire the 1968 series and a levy of .02 cents to retire the,,
1969 series. ,
CONCLUSION "
The within budget'should be accepted by the Commissioners' Court, filed with
the County Clerk and a-public hearing set thereon. I recommend that this
' budget be finally approved,and ado ted in its
p present form at the conclusion
of these statutory hearings.
