M. on ~'Ionday, August 13, 1973 with the following present: William R. Vance, County Judge, presiding; Bill J. Cooley, Commissioner of Precinct 1; Walter Wilcox, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; W. A. The Court further heard from County Clerk, Frank Bori'skie and County Tax Assessor-Collector, Raymond B. Buchanan concerning the : r s , effects of realignment of voting precincts on the elections during the year 1974. After a discussion, no further a ction was taken. ' The Court next considered the request of the Ferguson Crossing i Pipeline Corporation for a permit to use certain County right-of-way for the laying of a'natural gas pipeline to exclusively serve the City of Bryan. Commissioner Wilcox moved the-adoption of a resolution,' granting such permission, subject to several stipulations, a copy : r of such resolution being attached hereto. The motion was seconded by Commissioner Cooley and carried unanimously. 'I Commissioner Cooley requested that permission be granted to advertise for bids for sealcoat work on several miles of County roads and invited-other precincts to join in the bid process. After a discussion, the Court unanimously voted to authorize the advertisement .of such bids.. The County Judge presented a resolution establishing a Brazos Valley Development Council Region Board of Trustees under the Texas.'. Mental Health and Mental Retardation Act, and moved the adoption of I the resolution a copy of which is attached to these minutes. Commissioner Sims, seconded the motion, was carried unanimously and the resolution duly adopted. All members being present, the Court proceeded to levy taxes for the year 1973, Commissioner Sims moving that ad valorem-taxes be levies against all property in Brazos County, Texas, according to the following schedule: ; General Fund $0.481 Permanent Improvements Fund 0.19' Jury Fund 0.05• Road and Bridge Regular 0.15 Road and`Bridge Special 0.08'. 1966 Road Bonds (I&S) 0.06 1967 Road Bonds 0.11 1968 Road Bonds 0.06 1969 Road Bonds 0.02, ~q Total Tax Rate for 1973 The motion was seconded by Commissioner Stasny, and carried-'unanimousl O GE VOLi'PA • r , , c , ••~•.mi •11 r-.b r- r f1 {.•C Il ,F y ,*F _ _ - _ - • L PAIGE-7a . i whereupon the County Judge announced that the motion had carried and such taxes are levied against all taxable property in Brazos County, Texas. The Court next considered the need for additional voting machines and after a discussion, unanimously voted to authorize the receipt-of-bids for another 50 voting units. The Court next considered a,request of the County Clerk to purchase maps from the City of Bryan, showing property owners in the City of Bryan Independent School District. Commissioner Stasny moved that the Clerk be authorized to pruchase such maps. The motion was seconded by Commissioner Cooley and carried unanimously. A request of the Bryan Public Library Board of Trustees for an appropriation of $10,000.00 toward the cost of a new bookmobile, estimated to be $25,000.00. Commissioner Wilcox moved that such sum ,be authorized, subject to its actual expenditure for a bookmobile. The motion was seconded by Commissioner Stasny and carried unanimously. The next item was final approval of the joint purchase agreement through the Brazos Valley Development Council for purchase of radio equipment for the Sheriff's Department at a total cost to Brazos County. of $5,696.00. Commissioner Stasny moved that such equipment be purchased. The motion was seconded by Commissioner Wilcox and carried unanimously. On motion by Commissioner Wilcox, seconded by Commissioner Stasny the Court voted to pay its annual stipulated sum of $2,487.00 to Austin State Hospital for the County's share of expenses of operation of the Community Outreach Center. On motion by Commissioner Wilcox, seconded by the County Judge, the Court unanimously voted to pay $369.30 to the Central Brazos Valley Mental Health Center for expenses of remodeling certain offices for the Community Outreach Center. On motion by Commisssioner Stasny, seconded by Commissioner Wilcox, the Court voted unanimously to pay the sum of $596.58 as expenses of Foster Care for the month of July, 1973. Commissioner Wilcox moved that Brazos County request V that such sum be transferred to Brazos Count for the construction,"'. Y maintnenance and improvement of the County's-lateral roads.' The motion was seconded by Commissioner Stasny and carried unanimously, - The Court next considered the availability of funds through the Brazos Valley Development Council for hiring an additional employee during August or September. The Court unanimously agreed' ' to.authorize the Tax Assessor-Collector to employ an additional ' employee for the sole purpose of assessing properties in Brazos ' County, at a salary to be determined. The Court next received two bids of $5.00 each for the dis- position of two used desks formerly used by the Food Stamp Program and now surplus property. On motion by Commissioner Stasny, seconded by Commissioner Cooley, the Court authorized the sale of such property. On motion by Commissioner Stasny, seconded by Commissioner Cooley, the Court unanimously voted to accept for filing the plat'of HOLLEY PARK ESTATES, submitted by Robert C. Hooks and'Samuel D. Nigh with the stipulation that the County would in no way construct or maintain the roads in said subdivision. The Court then heard from the Watchdog Council concerning the { use of County equipment for work on private property. The Court next accepted for filing the following plats:' COUNTRY PLACE, submitted by Charles Arnold.and Robert Baker;' LAKEWOOD ESTATES, submitted by Paul L. Pi0l~P~~GE~ On motion duly made and seconded the Court voted unanimously to approve the foregoing plats with the stipulation that the County would in no way construct or maintain the roads in said subdivisions. The Court next considered a request from Commissioner Sims to initiate a determination of whether certain property lying on the West side of the present Brazos River, but on the East side of the old river channel, is in Brazos or Burleson County, so that the Tax Assessor Collector can determine to assess the property. The Court ' unanimously agreed to request an opinion from the Attorney General of Texas, if necessary or advisable. On motion duly made and seconded the Court voted unanimously to approve for payment all bills which have been properly approved and filed. ' tit R E S O L U T I O N WHEREAS the Ferguson Crossing Pipeline Corporation has rY made a written request for a permit from Brazos County, Texas, to lay a 4" pipeline in certain rights-of-way of county roads for the purpose of effecting an exclusive delivery to the,City of Bryan of natural gas for the operation of its electrical generators; and WHEREAS the Commissioners' Court of Brazos County, Texas, • has considered such request, together with the supporting request of the City,of Bryan, and has found ihat'the issuance of such a permit is of special interest to the City of Bryan, and thereby to Brazos County; NOW THEREFORE, BE IT RESOLVED By the Commissioners` Court of Brazos County, Texas, that a permit be issued to Ferguson Crossing•Pipeline Corporation, for the use of county owned or controlled right of way along Rock Prarie Road and Graham Road in Precinct One, as shown by a detailed drawing of the route of such pipeline prepared by Spencer Buchanan and Associates, dated May, 1973, for the purpose of laying a single 4" natural gas pipe-.,' line to interconnect with a line owned by the City of Bryan, upon - the following terms and condition: I 1. That such'installation will be made along the designated route, the actual location to be designated by the Commissioner of Precinct One. 2. That the right of way and all fences,will be restored to their condition prior to the beginning•of such installation, to the satisfaction of Ithe Commissioner . of Precinct One. Any necessary repairs by Brazos County will be billed to and paid for by the permit holder. VOL _PAGE. ; i 4 v_r 'x'r 1 . COL PAGE 3. Any damage to existing-utilities will be the responsibility of the permit holder or its contractor. Any other damages resulting from the installation of the pipeline, whether caused by the negligence, of the permit holder, its contractor, or otherwise, shall be the responsibility of the permit holder-or contractor, respectively. 4. This permit may not be assigned,or sublet in any manner. 5. Any future relocation of the pipeline necessitated by the widening, lowering, or other improvement or change in the roadways affected by this permit shall be done by the permit holder at no cost to Brazos County. 6. The installation shall be made not less than 48" below the surface of the ground. 7. The permit holder, upon request, shall pay to Brazos County, Texas, the actual cost of improving a portion of Graham Road extending from the present Graham Road to FM 2154, not to exceed $5,000.00. 8. This permit shall become effective only upon acceptance hereof by the permit holder, as evidenced by its execution hereunder. WHEREAS, the Texas Department of Mental Health and Mental Retard-'' at•ion has received annually appropriations for the development of ' Community Mental Health & Mental'Retardation•Services in local communities, which funds are allocated on a population formula basis;, and ; WHEREAS, the Counties of Brazos, Burleson,'.Grimes, Leon, Madison, 1 Robertson and Washington compose all of the counties within State Plan- t ping Region known as Brazos Valley Development Council; and WHEREAS, such counties are desirous of establishing'a regional' ` Board of Trustees for the purpose of developing a plan for the provision, of Community Mental Health and Mental,Retardation Services-in conjunct ion with Texas Department of Mental Health & Mental Retardation, and for the,further purpose of carrying out the provisions of such ,plan when finally adopted and approved by all interested parties.
