On motion by Commissioner Wilcox, seconded by Commissioner'Sims, the Court unanimously voted to certify the results to the election by'formal resolution, same being attached to these minutes, and to declare that the Community.College District was not created.. On motion by Commissioner Sims; seconded by Commissioner Wilcox, the Court unanimously voted-to pay Custom-Printed Products the sum of $2,800.00 for election supplie's,and services for the June 9th election. The Court next considered bids";for replacement of the cooling tower for the Courthouse. On motion by Commissioner Wilcox, seconded by Commissioner Stasny; the Court unanimously voted to accept the low bid of'Baggerly Service Company in the amount of $3,200.00 for replacement with ,a Prichard Dura Flo Model 16. The only other bid submitted was that of Kutzschback and Company in the amount of $5,068.00. On motion by Commissioner Stasny, seconded by Commissioner Wilcox, the Court unanimous) voted to ' Y pay expenses of Foster Care for the month of May, 1973, in the amount of $896.00. On motion by Commissioner Wilcox, seonded'by Commissioner Stasny, `'the Court unanimously authorized the County Judge to execute on behalf",--"-", -of Brazos County, the continuing Urban Transportation Study Contract, a copy of which is attached to these minutes. On motion by Commissioner Wilcox, seconded by Commissioner Stasny the Court unanimously voted to adopt a resolution authorizing the Big 8 Resource Conservation Development to accept the application of membership submitted by the Washington County Soil And Water Conservation District. ; i The Court received a letter signed by residents of Rockwood Park opposing the relocation of the railroad tracks to the right- of-way of the Western By-Pass., i On motion by Commissioner Stasny, seconded by Commissioner Wilcox, the Court unanimously voted to hire Raymond Bowser as a janitor at a salary of $50.00 per month. Constable Sayers appeared to request that radios be purchased IS _ - for the Constables of Precinct 4 and 7 at the time others are purchased I' through the Brazos Valley Development Council. Commission er Cooley i moved that such purchase authority be extended to cover twb'additional radios. The motion was seconded by Commissioner Sims and carried unanimously. ; . ' ' , i~, ~ ; r , • The Probation Officer appeared to request that the out of county - ' { automobile allowance be increased from .07 per mile to .10 per mile.~',.•, On motion by Commissioner Sims, seconded by Commissioner Cooley, the Court unanimously voted to increase the automobile allowance ' , to .10 per mile for all out of county traval in private vehicles. The Probation Officer furthzr requested that an additional ~ ' radio be purchased through the Brazos Valley Development 'Council for. ~ - his vehicle. The request was deferred until the July meeting. ' The Court then recessed until 7:00 o'clock P. Reverend Hugh Eiland and ,Robert Bossler requested the use of a portion of funds for the Brazos County Community Council. • - 2. Bob'"Cornish of the Environmental Action Council requested - ' , use for Solid Waste~Disposal and Wildlife Refuge and ~ ' Recreational Areas. - ~ ; • 3. Nell Young of the EAC'requested use for Sanitary Land Fills. 4. Mrs. Shirley Plapp of the League of. Women Voters requested use for Sanitary Land Fill`s. ' ' 5. The MPO agrees to assume responsibility for the planning work authorized by the Steering Committee and financed by the Section 112 planning funds allocated for the'Bryan-College Station Urban Transportation Study as stated hereinafter and in pursuit of the planning functions outlined in the Continuing Phase Agreement dated September 13, 1973 for the Bryan-College Station Urban Transportation Study, a copy of which marked Exhibit "C" is attached hereto and made a part hereof, or as may be subsequently amended and such amendments made a part hereof. II. The State will reimburse the MPO for the authorized cost incurred for the work described herein in accordance with Federal Procurement Regulations Part 1-15. Costs incurred subsequent to receipt of a written work order and properly supported will be reim- bursable. The total reimbursement by the State is not to exceed the total funds authorized by Texas Highway Commission Minute Order Number 69036 in the amount of $16,005 and Minute Order Number 69255 in the amount of $16,925. Specific work performed by the MPO or its agents shall be reimbursed by the State on the basis of actual costs incurred in accordance with current Federal Highway Administration regulations. The State will make payments to the MPO as partial payments based upon properly prepared and executed Form 132 and a,billing summarizing all authorized costs by, classification of costs showing description, quantities,'price, extension, and total. Such payments shall be,made no more frequently than on a monthly basis. All fiscal records relating to work for which reimbursement is made shall be maintained by the MPO for three (3) years after final payment from , the State and after Federal reimbursement has been received by the State. III. The MPO shall furnish to the State quarterly progress reports covering the work performed and the expenditure of the Section 112 .,funds. The dates such report shall cover will be as requested by the State and directed-by the Steering Committee. IV. Specific planning functions involved, including agency responsibility and the costs therefor, shall be approved by the Steering Committee and are generally identified as shown in Exhibit "D" which is the applicable portion of the Unified Work Program attached hereto and made a part hereof. The explicit scope and determinations to be accomplished under each element shall be identified in writing by t he ~ Steering Committee V. When specific planning work is to be accomplished by the use of consultants, or local government agencies, an agreement between the MPO and the consultant or local agency shall be submitted to the State for approval by the State and Federal Highway-Administration prior to execution: The use of qualified minority'eonsultan'ts by the MPO is encouraged. The State, Federal Highway Administration, and other appro- vriate governmental agencies shall be accorded proper facilities for review and inspection of the work provided for herein and shall at all = i reasonable times have access to the premises, to all books, records,. correspondence, instructions, receipts, vouchers, and memoranda of every deacription pertaining to the work. An item of work Any presented for reimbursement by the MPO which , is not included in approved work programs must have ~ - prior approval of:' j the-parties hereto, the Federal Highway Administration and other Agencies as may be appropriate. The MPO and/or its agents will comply with. all Federal,' State, and local laws, statutes, ordinances, rules, and regulations, and the. orders and decrees of any court or administrative bodies or tribunals, ' in any matter affecting the performances of this Agreement, including without limitation workman's compensation laws, minimum and maximum ` salary and wage statutes and regulations. When required, the'MPO shall furnish the State with satisfactory proof of its compliance therewith. X. It is mutually agreed that all parties hereto shall-be,bound by the provisibns of•Title 49, Code of Federal-Regulations, Part',21111, which was promulgated to effectuate Title VI of the Civil Rights" Act of`' 1964. In the event the terms of this Contract are in conflict with ,the provisions of any other existing agreements arid/or contracts betweenr''. the State and the MPO, this Contract shall take precedence over the existing agreements and/or contracts. XII• Any alterations, extensions, supplement, or modification of i the terms of this Contract as-detailed herein shall be agreed to in advance and in writing by the parties hereto. XIII. This Contract shall terminate upon completion of a final audit and receipt of a final payment for the work performed under-the terms of this Contract. In the event the work.to be per-formed under this Contract has not been satisfactorily concluded by August 31, 1975, this Contract shall terminate and any funds remaining shall be carried over into a contract to be executed between the sane parties on or about September 1, 1975. Also, in the event the designation covered by Exhibit "B" should be revoked or modified, this Contract shall auto- matically terminate as of the date of such revocation or modification. Further, either Party may terminate,,its interests and obligation under this Contract by giving thirty (30) days notice in writing to-the other Party. Provide general policy guidance for the trans- portation planning process. 2. Review annually the transportation plan (revised as necessary) and recommend its adoption and implementation by local governments and agencies.. 3. Takb appropriate action•on the recommendations of the Steering Committee including those relative to certification and re.certi£ication action for the study. 4. Meet at intervals as necessary to perform its functions. 5. Hold a public meeting to discuss the status of S r planning at least once a year. B. A. Steering Committee composed principally of elected city and county officials or their designated repre- sentatives shall be formed. The voting members of this Committee shall'be representatives of the cities and county which are parties to this agreement, elected State officials as 6ppropriate and represen- tatives of the Texas Highway Department-including the District Engineer from District 17 and the Chief Engineer of,Highway Design. Review the operation plan annually and recommend revisions if necessary. 7. Designate such technical committees or task forces as found necessary to carry out the planning process. II. The study elements involved in the initial phases of the Bryan-College Station Transportation Study'shall continue to provide the basic data for the continuing planning process and shall be maintained current or updated as necessary. Forecasts shall be reevaluated as necessary and at approximately five year intervals with new forecasts made for the succeeding five and twenty year periods. III. The primary responsibility for maintaining current or updating the basic study elements shall be vested in the agency whose routine operations normally involve mainte- nance of records relative to the study elements and as • indicated below, except as responsibilities may be modified by agreement of the parties: A.
