REGULAR MEETING - FEBRUARY 12, 1973
A regular meeting of the Commissioners Court of Brazos County,.Texas,
was held in the Commissioners Courtroom in the Courthouse in Bryan, Texas,
beginning at 10:00 A. M. on Monday, February 12, 1973, with the following
present:
William R. Vance, County Judge, presiding;
Bill J. Cooley, Commissioner of Precinct # 1;
Walter Wilcox, Commissioner of Precinct # 2;
Randy Sims, Commissioner of Precinct # 3;
W. A. Stasny, Commissioner of Precinct # 4;
Frank Boriskie, County Clerk.
The Court received, approved and ordered filed as submitted the
following reports for January, 1973:

The Court received bids from The First. National Bank of Bryan, First
Bank and Trust of Bryan, City National Bank of Bryan, University National
Bank of College Station, and Bank of A & M, College Station, to act as
Depository for Brazos County for the 1973-74 Biennium. After opening all
bids, the Court unanimously agreed to defer further consideration of such
bids until Wednesday, February 14, 1973 at 1:30 o'clock P. M.
The County Judge next presented a resolution adopting an order granting
the constitutional ad valorem tax exemption to persons 65 years of age and
over. On motion by Commissioner Stasny, seconded by Commissioner Sims,
the Court unanimously voted to adopt such order and to grant such exemption,
a copy of the order being attached to these minutes and incorporated herein.
The Court next considered a proposed order abandoning a portion of
the Bryan-Mumford Road lying within the property owned by the City of
Bryan and to be covered by the Bryan Utility cooling lake. On motion
by Commissioner Wilcox, seconded by Commissioner Sims, the Court voted
unanimously to adopt such order, a copy of which is attached to these
minutes and incorporated herein.
On motion by Commissioner Stasny, seconded by Commissioner Wilcox,
the Court unanimously voted to approve a change order submitted by the
City of Bryan for change in the utility adjustment work on the West
By-Pass, providing for an increase of $3,572.80, a copy of which is attached
hereto.
The call of an election authorizing establishment of a community.
college was passed at the request of the steering committee.
On motion by Commissioner Wilcox, seconded by Commissioner Stasny,
the Court unanimously voted to reappoint Mrs. Betty Taylor and Mr. Milton
Turner, as members of the Brazos County Child Welfare Board.
On motion by Commissioner Wilcox, seconded by Commissioner Stasny, the
Court unanimously voted to appoint Commissioner Cooley to serve on the
Brazos County Citizens Advisory Committee to the Central Brazos Valley
Mental Health Center, Inc., at the request of the Citizens Advisory
Cor.nittee.
The Court next considered bids for the purchase of two new automobiles
for the Sheriff's Department. On motion by Commissioner Stasny, seconded
by Commissioner Wilcox, the Court voted unanimsouly to accept the low
bid of Schwartzkopf, Pontiac-Buick, Inc. at $3,900.00 per automobile,
less $750.00 for the trade allowance of a 1970 Pontiac. Other bids were
from Allen Oldsmobile-Cadillac at $3,936.14 per automobile and Schwartzkopf
Pontiac-Buick, Inc, at $4,035.00 per automobile.

On motion by Commissioner Stasny, seconded by Commissioner Sims,
the Court unanimously voted to pay the premium of $792.00 for the Money
and Securities insurance policy maintained by the County, with the
understanding that the special. conditions and stipulations of the policy
would be followed by those having custody of money and securities.
The Court next considered the request of Commissioner Cooley for
the purchase of a 10 acre tract of land for a sanitary land fill in
Precinct 1. The League of Women Voters submitted a statment in support
of a solid waste program. On motion by the County Judge, seconded by
Commissioner Wilcox, the Court voted unanimously to authorize Commissioner
Cooley to negotiate with the land owner for the purchase of 10 acres at
a price not to exceet $7,500.00
The Court next considered bids for the purchase of an additional
file for the District Clerk's office, the only bid received being that
of Clark and Courts in the amount of $79.80. On motion by Commissioner
Stasny, seconded by Commissioner Wilcox, the Court unanimously voted to
accept such bid and to purchase the necessary file.
On motion by Commissioner Stasny, seconded by Commissioner Sims, the
Court unanimously voted to increase the rate of pay for part time extra
workers to $1.90-$2.10 per hour, at the discretion of the elected official
hiring such person, consideration to be given to experience, prior employ-
ment by Brazos County, qualifications, and nature of the part time employ-
ment.
On motion by Commissioner Sims, seconded by Commissioner Wilcox, the
Court unanimously voted to contribute $325.00 per month toward the salary
of an additional worker with the Community Outreach Center, to work with
the juvenile program now being conducted by the Center, such support to
be effective February through August, 1973, or until such time as the
Federal Emergency Employment Program is terminated.
O•n motion by Commissioner Wilcox, seconded by Commissioner Sims, the
5Court•u6animously voted to increase the salary of one Deputy County Clerk
to $5,200.00 per annum.
On motion by Commissioner Wilcox, seconded by Commissioner Sims, the
Court unanimously voted to pay the expenses of Foster Care for the month
of January, 1973, at $1,001.86.
On motion by Commissioner Stasny, seconded by Commissioner Wilcox,
the Court unanimously voted to authorize negotiations with land owners for
the purchase of necessary right-of-way for improvements to OSR.

On motion by Commissioner Stasny, seconded by Commissioner Wilcox,
the Court unanimously voted to approve the Public Weighers Bond of
J. D. Conlee with United States Fidelity and Guaranty Company as surety.
On motion by Commissioner Stasny, seconded by Commissioner Wilcox,
the Court unanimously voted to accept the low bid of International
Harvester Company in the amount of $5,300.00 for a 2k ton dump truck
for Precinct 3. The other bid being by Cade Motor Company in the amount
of $7,500.00,
The Court further authorized Commissioner Sims to accept bids for
the purchase of a Motor Grader for Precinct 3.
On motion duly made, seconded and carried unanimously, the Court
voted to approve the payment of all bills which have been properly
submitted and approved.
There being no further business, the Court recessed until 1:30 P. M.
on Wednesday, February 14, 1973.
SPECIAL MEETING - FEBRUARY 14, 1973
The Court met in special session on Wednesday, February 14, 1973,
to consider the bids for County Depository received on Monday, February
12, 1973, at its regular session.
After Consideration of the bid proposals and after hearing from
persons present interested in the bids submitted, Commissioner Stasny
moved that the Depository Contract be awarded tcx the First National Bank
of Bryan. The motion was seconded by Commissioner Wilcox. Commissioners
Wilcox, Sims and Stasny vote AYE. Commissioner Cooley voted NO. The
County Judge did not vote by reason of his ownership of stock of the
First National Bank of Bryan. The motion was declared carried and the
depository contract is hereby awarded to the First National Bank of Bryan,

and it is so ordered.
There being no further business to come before the Court the meeting
was adjourned.

ORDER PROVIDING FOR EXEMPTION FROM ALL AD VALOREM
TAXES LEVIED LY BRAZOS COUNTY, TEXAS, IN THE A,tiIOUNT
OF THREE THOUSAND DOLLARS ($3,000) OF ASSESSED VALUE ;
ON RESIDENTIAL HOMESTEADS FOR PERSONS AGE SIXTY-FIVE
OR OLDER, PROVIDING FOR PROCEDURES FOR CLAIMING
SUCH EXEMPTION.
WHEREAS Senate Joint Resolution No. 7, Acts of the
62nd Legislature, 1971, provided for submission of a proposed
Constitutional Amendment at the General Election on November 7,
1972; and
WHEREAS at such General Election an Amendment to the
Constitution providing for exemption from ad valorem taxation
in an amount not to exceed Three Thousand Dollars was adopted,
same being Article VIII, Section 1-b of the Constitution of the
State of Texas; and I
WE'EREAS the voters of Brazos County, Texas, approved
such amendment by an overwhelming majority, and have thereby
expressed their approval of the exemption for persons sixty-
five years of age and older; Now, Therefore
BE IT ORDERED BY T11E COMMISSIONERS COURT OF BRAZOS
COUNTY, TEXAS, as follows:
1. There is hereby granted to persons of the age of
sixty-five years or older an exemption from all advalorem taxes
levied by Brazos County, Texas, in the amount of Three Thousand
Dollars ($3,000.00) assessed value on residential homesteads.
2. Each person so claiming the exemption set out in
paragraph 1 above shall validate his or her age by presenting
to the Tax Assessor-Collector the following:
a) a certified copy of his or her birth certificate;
or, in lieu thereof
b) a copy of the persons' Social Security Administration
records; a valid Texas Drivers License; valid
discharge records of the Armed Forces of the United
States; affidavits of two credible persons at least
five years older than the applicant and not related
by blood or marriage, stating that they have personal
knowledge of the applicant's age, provided, that the
Tax Assessor-Collector may, at his discretion, require
additional supporting data in support thereof.
3. In order to claim the exemption, the applicant must
have attained the age of sixty-five years on or before January 1
of the year for which the exemption is claimed.
d. Each person so claiming said exemption shall make
application therefor on forms provided by the Tax Assessor-Collector
during each tax year between January 1 and April 1; or the exemption
shall be lost for that year.
5. If the granting of such exemptions as set out in
Paragraph 1 above would impair ary obligation of any contract by
which any debt of Brazos County, Texas, was created, the Tax
Assessor-Collector shall have the authority to continue to levy
and collect the tax against the homestead property at the same
rate as against other property until the impaired debt is discharged.

ORDER
WHEREAS, in accordance with the plans and specifications for the
Bryan Utilities Lake prepared by Spencer J. Buchanan and Associates, Inc.,
Consulting Engineers for the City of Bryan on the Utilities Lake project, it
has been deemed necessary that a portion of Mumford Road situated in
Brazos County, Texas be abandoned; and
WHEREAS, the Commissioners Court of Brazos County, Texas, is
in agreement with the Consulting Engineers' plans and specifications which
has been heretofore submitted on said project.
NOW, THEREFORE, BE IT ORDERED BY THE COMMISSIONERS
COURT OF BRAZOS COUNTY, TEXAS:
SECTION 1. That a portion of 'VMumford Road beginning at a point
approximately 0.6 mile east of the Old San Antonio Road (OSR) and ending
approximately 1,15 miles east thereof be the same which is hereby abandoned
to become a part of the Bryan Utilities Lake area subject to the following
provisions: M
(a) The proposed Mumford Road reroute which connects the ends
of the abandoned portions and traverses to the North of the proposed
Power Plant site becomes a part of the Public County Road System
and shall be completed and opened for traffic prior to the closing
of the abandoned portion.
(b) That the County of Brazos shall be permitted to remove
existing bridges and culverts within the section of Mumford Road
which is hereby abandoned at sometime prior to the City of Bryan
initiating filling of the Utilities Lake.
(c) That the County of Brazos shall be permitted to remove the
gravel base course on the existing portion of Mumford Road which
is hereby abandoned, or shall be permitted to remove from the
City of Bryan's borrow areas a comparable quantity of base course
gravel, so that the remaining portion of the existing Mumford Road
maybe improved by the use of this gravel.
SECTION 2, That the abandonment of the portion of Mumford Road
heretofore set out and construction of the new Mumford Road reroute shall
be done at no expense to County of Brazos, provided that the removal of
bridges and culverts and removal of gravel (or its equivalent) from the
abandoned portion of Mumford Road shall be at the expense of the County of
Brazos.
