M. on Monday, January 8, 1973, with the following present: William R. Vance, County Judge, presiding; Bill J. Cooley, Commissioner of Precinct # 1; Walter Wilcox, Commissioner of Precinct # 2; Randy Sims, Commissioner of Precinct # 3; W. A. Stasny, Commissioner of Precinct # 4; Frank Boriskie, County Clerk. The minutes of the December 11, 1972 meeting were read and approved without change. The Court received, approved and ordered filed as submitted the following reports for December, 1972: B. V. Elkins, Welfare Officer; William T. Sistrunk, County Agricultural Agent; Daniel P. Kubecka, County Agricultural Agent; Curtis Taylor, Jr., County Agricultural Agent; Mrs. Pricilla Jones, County Home Demonstration Agent; Mable Ferguson, County Home Demonstration Agent. The Court received a letter from District Judge W. C. Davis setting the salaries of the Probation Department and the County Auditor as follows: Probation Officer $10,500.00 Assistant Probation Officer 8,400.00 Assistant Probation Officer 7,800.00 Secretary for Probat ion Department 3,744.00 Automobile Allowance for Probation Officer 1,200.00 Automobile Allowance for Assistant Probation Officer 960.00 Automobile Allowance for Assistant Probation Officer 960.00 County Auditor 12,000.00 On motion by Commissioner Stasny, seconded by Commissioner Sims, the Court unanimously voted to set all salaries at the amount set in the Budget for 1973, with the exception of the employees whose salaries are set by law by the District Judge as above. Commissioner Stasny moved that the Budget for 1973 be adopted in final form as previously adopted with the inclusion of the above salaries for the Probation Department and the salary of the County A uditor as stated above. The motion was seconded by Commissioner Wilcox, and carried unanimously. The Court next autorized advertisement for the bids for the County Depository for the 1973-74 biennium by the publication of the following notice: NOTICE TO BIDDERS FOR COUNTY DEPOSITORY Notice is hereby given that the Brazos County Commissioners Court wil-1 receive bids up to ten o'clock A. M. on Monday, February 12, 1973, rfor,a depository for the biennium of 1973-74 for official County funds, ,including those of the common school districts. All funds must be protected by bonds and pledges of cash or sec- urities, as well as by provisions of the Federal Deposit Insurance Corp. All bids must be accompanied by certified check payable to the Commissioners' Court of Brazos County, Texas, for not less than one-half of the one percent of the County revenue for the year 1972, which shall be forfeited if the successful bidder does not enter into the necessary bonds and pledges of cash or securites. Bids will be publicly opened and considered at the time sepcified, and Brazos County reserves the right to reject any or all bids. Vance, County Judge Brazos County, Texas On motion by Commissioner Stasny, seconded by Commissioner Wilcox, the Official Bond for each County Official sworn into office on January 1, 1973, was approved and ordered filed in the office of the County Clerk. The Court received notice from the District Judge of the re-appointment of Mary Nichols as County Auditor, a copy of which is attached to these minutes. On motion by Commissioner Sims, seconded by Commissioner Stasny, the Court unanimously voted to appoint Dr. Raymond F. Buck, Jr. as County Health Officer and Jake Cangelose as Deputy Civil Defense Coordinator for the 1973-74 biennium. On motion by Commissioner Wilcox, seconded by Commissioner Cooley, the Court unanimously voted to enter into a contractural agreement with the City of College Station respecting fire protection outside the limits of that City, a copy of which is attached to these minutes. VOLAI PAGE W . ~I 1 The Court next considered the bids for the replacement of an air conditioning unit and compressor and heating strips for the third floor area occupied by the Welfare Department. Bids were by Mullinex Company in the amount of $965.00 for replacement and 1OKW heat strips and from Baggerly Service in the amount of $1120.00 for replacement and 15KW heat strips. On motion by Commissioner Sims, seconded by Commissioner Stasny, the Court unanimously voted to accept the bid of Mullinex Company for the work specified, to be paid out of the permanent improvements fund. The Court next considered bids for new office equipment. Bids were received from Otis McDonald's, Cates Typewriter Company and Macy's Business Machines. On motion by Commissioner Wilcox, seconded by Commissioner Stasny, the Court unanimously voted to accept the low bid of -Cates Typewriter Companty for two typewriters for the Tax Assessor-Collectors Office, to accept the bill of News Office Supply for an Otis storage cabinet for the Probation Department and to accept the low bid of Steck-Warlick Company for a five drawer file cabinet for the District Clerk's Office. The Court next heard from James Siegert concerning the abandonment of a portion of the original right-of-way of FM 974, adjacent to the Eastern By-pass. Commissioner Wilcox stated that the right-of-way in question belonged to the State of Texas and that it was his desire to seek it for the County when and if abandoned ' by the State. No further action was taken. On motion by Commissioner Stasny, seconded by Commissioner Wilcox, the Court unanimously voted to pay $300.00 to Dr. Donald Shepherd, MD for an autopsy requested by the District Attorney's Office. On motion by Commissioner Stasny, seconded by Commissioner Wilcox, the Court voted to pay $11,417.40 to George L. Webb Agency for the 1973 annual premium for liability insurance. On motion by Commissioner Wilcox, seconded by Commissioner Stasny, the Court voted.unanimously to pay $438.00 to the City of Bryan for fire calls for the month of December, 1972. On motion by Commissioner Wilcox, seonded by Commissioner Stasny, the Court unanimously voted to pay $905.84 as expenses of foster care for the month of December, 1972. The Court next received from the District Clerk the names of all persons serving on the Grand Jury during the past twelve months and proceeded to draw names for the Salary Grievance Committee as follows: J. 0. Alexander Carlos Nava George Blevins Phillip Steen, Sr. - Alternate Mrs. John Hutchinson - Alternate. The Court then set the following holidays for Brazos County employees for the coming year: Memorial Day Monday, July 4th, Labor Day, Thanksgiving, December 24th and 25th, December 31st and January 1, 1974. Commissioner Stasny moved to allocate the Road and Bride Budget to the precincts on the basis of equal shares of 25% to each precinct. The motion was seconded by Commissioner Sims. Commissioners Wilcox, sims, Stasny and the County Judge voted AYE. Commissioner Cooley voted NO, wehreupon the motion was declared carried and it is so ordered. On motion duly made, seconded and carried unanimously carried the Court voted to pay all bills which have been properly filed and approved. There being no further business the Court adjourned. MARY NICHOLS County Auditor to hold office for a term of two years, from November 15, i 1972, to November 15, 1974, and the Court hereby sets her compensa- tion for her services an annual salary from the County General Fund in the sum of Twelve Thousand ($12,000.00) Dollars, the identical salary paid the Brazos County Assessor-Collector of Taxes, said salary to be paid monthly in equal installments to said County Auditor. IT IS FURTHER ORDERED that this Order shall be recorded in the Minutes of the District Court, and that the Clerk of the i District Court shall certify the same for observance to the (Commissioners' Court, which shall cause same to be recorded in its Minutes. That the City of College Station agrees to furnish fire fighting equipment, supplies and personnel outside the city limits of the City of College Station for the benefit of the County of Brazos until this agreement is terminated by proper notice. 2. That the County of Brazos will reimburse the City of College Station for all expenses incurred by the City in the furnishing of these services. The amount of the reimbursement to the City will 1;t; oased upon a sum of money per man hours of duty by City Fire Department personnel, a sum of money per engine mile of operation by City Fire Department mobile equipment, a sum of money for City Fire Department personnel fringe benefits pro -rated on the amount of time spent in service to the County in relation to total employment time by the City, and a sum of money for the cost to the City of all supplies, chemicals and products used in fighting fires or 9 ,guarding persons or property from catastrophies or calamities. The City of College Station -~vill submit an itemized bill to the County of Brazos each month setting forth the amounts owed to the City by the County, and the County of Brazos shall pay each monthly bill within fifteen (15) days of the date on which the bill is submitted. 3. The County of Brazos agrees that :..iy disadvantages that may accrue to the City of College Station and affecting adversely the insurance experience ratings and/or premiums, resulting from the acts of any person or persons while fighting fires, traveling to or from fires or in any manner furnishing fire protection to the citizens of this County outside the city limits of the City of College Station shall be accepted as additional cost to the County of Brazos. 4. The County of Brazos agrees to indemnify and hold harmless the City of College Station for any damages or injures to employees, agents, workmen, or firemen of the City of College Station, or to any person or person's property as a result of answering or performing fire calls outside the city limits of the City of College Station. Should any person assert a claim, cause of action, or file a suit for damages to his person, or his property then the County of Brazos agrees to defend all such claims, causes of action, or suit-is. 5. The County of Brazos agrees to indemnify and hold harmless the City of College Station for any damages or injuries to its fire fighting equipment while answering or traveling to or from, or engaged in, fire calls outside the city limits of the City of College Station. ;f i VOLA-PAGE 6 c/ i VOLAI-PAGEL i Pago 2 An Agreement 6.
