ORDER DECLARING RESULT OF
LOCAL OPTION ELECTION
THE STATE OF TEXAS X
COUNTY OF BRAZOS X
On this the 13th day of November, 1972, the Commissioners'
Court of Brazos County, Texas, convened in Regular Session open to
the public, at the regular meeting place thereof at the Courthouse
in Bryan, Texas, with the following members of the Court present, to-wit:
William R. Vance, County Judge
Raymond Nolan, Commissioner Precinct No. 1
Walter Wilcox, Commissioner Precinct No. 2
Clyde J. Porterfield, Commissioner Precinct No. 3
W. A. (Bill) Stasny, Commissioner Precinct No. 4
Frank Boriskie, County Clerk
and the following absent:
None
constituting a quorum, and among other proceedings, passed the follow-
ing Order:
There came on to be considered the returns of an election held
on the 7th day of November, 1972, in Brazos County, Texas, to deter-
mine whether or not the sale of alcoholic beverages of the type speci-
fied in the Order calling said election shall be prohibited or legalized.
It appearing to the satisfaction of the Court that said election
was in all respects legally held, and that said returns were duly and
legally made, and that there were cast at said election 20,494 valid
and legal votes, of which number there were cast
FOR THE LEGAL SALE OF ALL ALCOHOLIC BEVERAGES,
INCLUDING MIXED BEVERAGES 10,319 votes.
AGAINST THE LEGAL SALE OF ALL ALCOHOLIC BEV-
ERAGES, INCLUDING MIXED BEVERAGES 8,365 votes
IT IS, THEREFORE, FOUND AND DECLARED AND SO ORDERED by the Com-
missioners' Court of Brazos County, Texas:
That a majority of the qualified voters in said above named area
voting at said election voted to legalize the sale of alcoholic bever-
ages of the type specified'in the order calling said election.

That upon the determination of the vote as aforesaid, the
County Attorney advised the Court that certain questions existed
concerning whether or not the election had legalized the sale of
all alcoholic beverages, including mixed beverages, throughout the
entire County, whereupon, the Court agreed to postpone further action
until an appropriate opinion could be obtained from the County
Attorney, or Attorney General, concerning the legal aspects of the
question.
And on the 17th day of November, 1972, the Court reconvened
in a continuation of the Regular Session theretofore convened on
the 13th day of November, at the regular meeting place•thereof at
the Courthouse in Bryan, Texas, with the following members of the
Court present, to-wit:
William R. Vance, County Judge
Walter Wilcox, Commissioner Precinct 2
W. A. (Bill) Stasny, Commissioner Precinct 4
Frank Boriskie, County Clerk
and the following absent:
Raymond Nolan, Commissioner Precinct 1
Clyde J. Porterfield, Commissioner Precinct 3
And the Court having heard from the County Attorney that it was
his opinion upon examination of appropriate opinions of the Attorney
General and several decisions upon like questions, that the election
held on the 7th day of November; 1972, was effective throughout the
area of Brazos County.
IT IS,THEREFORE, FOUND AND DECLARED AND SO ORDERED by the
Commissioners' Court of Brazos County, Texas:
That this Order shall be entered of record in the office of
the Clerk of this Court, whereupon it shall be lawful in Brazos
County, Texas, to manufacture, sell or otherwise distribute alcoholic
beverages of the type specified in the Order calling said election
in accordance with the terms of the Texas Liquor Control Act, until
such time as the qualified voters of said area may thereafter, at a
legal election held for that purpose by a majority vote decide otherwise.

The Clerk of this Court shall, within three days, from the date of
this Order, certify the results of the above mentioned election
to the Secretary of State at Austin, Texas.
It is further found and determined that notice of the date,
place and subject of this meeting was posted on the bulletin board
in the office of the County Clerk, Brazos County Courthouse, Bryan,
Texas, at least three days preceding the date of this meeting, and
that all terms and provisions of Article 6252-17 have been complied
with.
The above Order being read, it was moved and seconded that
same

the question being called for, the following mem-
bers

and the following members voted "no":
None
PASSED, APPROVED AND ADOPTED this the 17th day-of November, 1972.
