REGULAR MEETING - NOVEMBER 13, 1972
A regular meeting of the Commissioners Court of Brazos County
Texas, was held in the Commissioners Courtroom in the Courthouse in
Bryan, Texas, beginning at 10:00 A. M. on Monday, November 13, 1972,
with the following present:
William R. Vance, County Judge, presiding;
Raymond A. Nolan, Commissioner of Precinct # 1;
Walter Wilcox, Commissioner of Precinct # 2;
Clyde J. Porterfield, Commissioner of Precinct # 3;
W. A. Stasny, Commissioner of Precinct # 4;
Frank Boriskie, County Clerk.
The minutes of the October 9th and 23rd, and November 1st meetings
were read and approved without change.
The Court received, approved and ordered filed as submitted
the following reports for October:

Daniel P. Kubecka, Assistant County Agricultural Agent;
Curtis Taylor, Jr., Associate County Agricultural Agent;

The Court received, considered and approved the following reports
from County and Precinct Officers showing official fees of Office
collected and remitted to the County Treasurer according to duplicate
copies of the Treasurer's Official receipts attached thereto:

The Court proceeded to canvass the results of the General Election
and Constitutional Amendments Election held November 7, 1972, and
accepted as true the cumulative county-wide totals prepared by the
Central Counting Station, together with the write-in votes'tabulated
therewith, and ordered the results certified to the Secretary of
State of the State of Texas and recorded in the Official Election {
Records of Brazos County, Texas.
V-' The Court further canvassed the results of the Local Option Election
Cs
held November 7, 1972, the results of which are set forth in an
independent order of the Court, which is included in these minutes.
The Court next considered the provisions of the Minute Order No.
66681, adopted by the State Highway Commission. Motion was made by
Commissioner Wilcox, seconded by Commissioner Nolan that the Comm-
issioners Court of Brazos County accept the provisions contained in
Minute Order No. 66681 passed by the State Highway Commission on
October 5, 1972, for the improvement by the Texas Highway Department
on the roads described as State Highway 6 in Brazos County, extending
from Robertson County Line, south a distance of approximately 3.0
miles. The vote carried unanimously and was declared carried.
The Court next considered the request of Lone Star Gas Company
for the installation of a two-inch natural gas main in the right-of-
way of Green Prairie Road from their pumping station to Wellborn
Oaks. Commissioner Nolan moved that such permission be granted on the
following provisions: !

1. That Lone Star Gas Company or its contractor must
notify the Commissioner of Precinct 1 at least 48
hours prior to the beginning of construction, in
order that the Commissioner might be on hand to de-
signate the actual location of the installation. f
2. Lone Star Gas Company or its contractor will repair
all damage to the roadway and right-of-way and re-
store the roadway and right=of-way to their original
condition to the satisfaction of the Commissioner of
Precinct 1. if
3. -Brazos County will not be responsible for any future
lowering or relocation of this line which may become
necessary as a result of improvements to Green Prairie
Road.

The motion was seconded by Commissioner Wilcox, and carried
unanimously.
The Court next considered the request of the local office of
the Texas Parks and Wildlife Department that one mobil radio be
purchased with other equipment to be purchased for the Sheriff's
Department for use by the Game Management Officer in cooperation
with the Sheriff's Department. Commissioner Porterfield moved that
such purchase be made, if the purchase can be included in the radio
equipment to be funded by the Criminal Justice Council. The motion
was seconded by Commissioner Stasny and carried unanimously.
The Court next considered the renewal of the Honewell, Inc.
maintenance agreement for maintenance of the heating and air
conditioning controls in the Courthouse, for the sum of $1,444.00 '
per year. Commissioner Nolan moved that such contract be renewed, ii

the motion was seconded by Commissioner Stasny and carried unanimously.

The County Judge presented a request from the City of Bryan for
conveyance of a portion of county property included in Sadie Thomas
Park. The Court delayed consideration pending further information.
The County Judge presented a request of the Bryan-College Station
Chanber of Commerce that the Court request designation of Brazos
County as a "rural area" as defined by the Texas Rural Industrial
Development Commission. Commissioner Nolan moved that such desig-
nation be requested. The motion was seconded by Commissioner Wilcox
and carried unanimously.
The Court next considered relocation of the Food Stamp Office to

408 West 28th St., a building owned by Dr! 0. C. Cooper, for $290.00
per month, until acceptance by the State. On motion by Commissioner
Nolan, the Court unanimously voted to make such relocation.
On motion by Commissioner Stasny, seconded by Commissioner Nolan, '
the Court unanimously voted to approve for filing the plat of ROYAL
'OAKS ESTATES, submitted by Glynn A. Williams, Jr., and Ronnie Peret,
with the stipulation that the County would in no way build, construct,
or maintain the roads in said subdivision.

On motion by Commissioner Wilcox, seconded by Commissioner Stasny,
the Court unanimously voted to approve for filing the plat of FOREST
CREEK ESTATES, submitted by R. E. Frieda, with the stipulation that
the County would in no way build, construct, or maintain the road in
1 said subdivision.
On motion by Commissioner Nolan, seconded by Commissioner Wilcox,
the Court unanimously voted to approve for filing the plat of
WELLBORN OAKS, subject to the addition of a 60 foot easement in a
location now shown as a 30 foot easement with the stipulation that
the County would in no way build, construct, or maintain the roads
of said subdivision.
The Court next heard from a group of interested citizens concern-
ing the action of the Court in exempting Brazos County from the
• provision of Article 135b-4 (Herbicide Regulation). After a dis-
cussion, Commissioner Porterfield moved that the action taken by
the Court in October, 1972, exempting Brazos County, be recinded.
The motion was seconded by Commissioner Nolan. Commissioners,
Porterfield, Nolan and the County Judge voted AYE. Commissioners
Stasny and Wilcox voted NO. The County Judge declared the motion
carried and the former order is hereby recinded and set aside as
though never entered.
On motion duly made and seconded the Court unanimously voted to
pay all bills which have been properly filed and approved.
There being no further business the Court adjourned.
SPECIAL MEETING - DECEMBER 1, 1972
A special meeting of the Commissioners Court of Brazos County,
Texas, was held in the Commissioners Courtroom, Brazos County Court-
house, at 10:00 A. M. on Friday, December 1,1972, with all members
present.'
The first item considered was the proposal by Lone Star Gds'
Company for the relocation of a 4-inch and a 6-inch pipeline at

their crossing of the north extension of FM 2818, at an estimated \
cost of $21,272.84. On motion by Commissioner Nolan, seconded by
Commissioner Stasny, the Court unanimously voted to approve such
proposal and authorize Lone Star Gas Company to proceed with the
work.
Bryan City Manager Fred Sandlin and Parks and Recreation Director,
Jay Williams appeared to request that Brazos County convey a tract
of 12.53 acres which is currently being used by the City of Bryan for
Sadie Thomas Park, to the City of Bryan in order that
the City may apply for a state grant for improvements to the park.
On motion by Commissioner Stasny, seconded by Commissioner Nolan, the
Court unanimously voted to authorize the County Judge to execute a
deed of conveyance to the City of Bryan with a clause whereby the
property will revert to Brazos County if the City ceased to use it
for park purposes.
The question of office space after January 1, 1973, was discussed,
and on motion by Commissioner Stasny, seconded by Commissioner Wilcox,
the Court unanimously voted to authorize the District Attorney to
occupy the 2nd floor space now occupied by the County Attorney, to
authorize the County Attorney to occupy the 3rd floor space now
occupied by the Probation Department, and to authorize the Probation
Department to occupy space on 3rd floor now occupied by the State
Department of Public Welfare, all effective January 1, 1973, or as
soon thereafter as the Department of Public Welfare vacates the 3rd
floor.
There being no further business the Court adjourned.
