REGULAR MEETING - OCTOBER 9, 1972
A regular meeting of the Commissioners Court of Brazos
County, Texas, was held in the Commissioners Courtroom in the
Commissioners Courtroom in the Courthouse in Bryan, Texas, be-
ginning at 10:00 A. M. on Monday October 9, 1972, withthe following
present:
William R. Vance, County Judge, presiding;
Raymond A. Nolan, Commissioner of Precinct # 1;
Walter Wilcox, Commissioner of Precinct # 2;
Clyde J. Porterfield, Commissioner of Precinct # 3;
W. A. Stasny, Commissioner of Precinct 4;
Frank Boriskie, County Clerk.

-The Court received, approved, and ordered filed as submitted
the following reports for September:

The Court received, considered and approved the following

The Court next held a public hearing pursuant to notice
given under the terms of Article 135 (b) 4, Revised Civil Statutes
of Texas, to determine whether there is any crop or vegetalbe
of value susceptible to damage by the use of herbicides as de-
fined in such article, and whether Brazos County should be exempted
from the provisions of said Article 135 (b) 4, as it pertains to
appliers and custom appliers of herbicides.
After hearing from those persons interested, Commissioner
Stasny moved that the Court,make a determination that there is no
crop'or vegetable of value susceptible to damage by use of usch
herbicides as are defined therein and that Brazos County be exempt
from the provisions of Article 135 ('b) 4. The motion was seconded
by Commissioner Wilcox. Commissioners Nolan, Wilcox, Porterfield,
and Stasny voted Aye. The County Judge voted no. Whereupon the
motion was declared carried, and Brazos County shall be exempted
from said Article, effective January 1, 1973.
On recommendation by the County Judge, and on motion by
Commissioner Nolan, seconded by Commissioner Stasny, the Court
unanimously voted to appoint Freddie Wolters, Walter Britten and
Milton Holland as members of the Veterans Land Committee for the "
purpose of approving applications submitted under the Veterans
Land Program of the General Land Office of the State of Texas.
On motion by Commissioner Wilcox, seconded by Commissioner

Nolan, the Court unanimously voted to approve the Brazos Valley
Development Council projuects submitted by the City of Bryan
concerning improvements to Travis Park and the Castle Heights
Sewer and Water Systems.
The Court next heard the request of Constable E. W. Sayers
that he be authorized to appoint a unit of twenty Reserve Con-
stables. After considerable discussion, Commissioner Porterfield
moved that such request be granted. The motion was seconded by
Commissioner Nolan, Commissioners Nolan, and Porterfield voted
aye. Commissiomrs Stasny, Wilcox, and the County Judge voted no..,
Whereupon the motion was declared defeated. The Court agreed to
refer:the matter tothe County Attorney for legal consideration of
the question of carrying firearms.

The Court next_considered the request of the Brazos Valley
Community Action Program that the two-county organization be
designated as the delegate agency for Brazos County for all
programs under the Economic Opportunity Act, the purpose of this
redesignation being that the organization is submitting an applica-
tion for recognition as full service Community Action Agency.
Commissioner Stasny moved that the Brazos Valley Community Action
Program be so designated. The motion was seconded by Commissioner
Nolan and carried unanimously.
The Court next heard from A. H. Winder, City Engineer for the
City of Bryan, and Hubert Nelson, City Planner, and Dr. R. H.
Harrison, III, concerning a proposed crossing of the Old Reliance
Road by a sanitary sewer line and other utility installations.
After a discussion no action was taken by the Court but it was
noted that the concept of a single crossing of Old Reliance Road
by utility and drainage easements would be considered at such time
as Brazos County maked improvements to Old Reliance Road.
On motion by Commissioner Wilcox, seconded by Commissioner
Stasny, the Court unanimously voted to pay the expenses of foster
care in the amount of $247.60 for the month of September, 1972.
At ther request of the County Judge, the Court set Wednesday
November 1, 1972, at 2:00 o'clock P. M. as the date and hour for
the public hearing on the Budget for Brazos County for 1973, and
ordered that the follwoing notice be published in the manner required
by law:
NOTICE OF HEARING ON BRAZOS COUNTY BUDGET FOR 1973
Public notice is hereby given that pursuant to action of the
` Commissioners' Court of Brazos County, Texas, taken on October 9, 19729
open public hearing will be held in the Commissioners' Courtroom in
the Courthouse in Bryan, Texas, at 2:00 P. M. on Wednesday, November
21 1972, for consideration of the 1973 Budget for Brazos County, Texas,
? filed with the County Clerk on October 20, 1972, and now remaining on
file in the.off ice of the County Clerk of said County, all in accordance
with law.
Taxpayers and others interested are invited and urged to acquaint
themselves with said Budget during the time it remains on file with
the Clerk before the hearing.
At the conclusion of the hearing, final action will be taken by
the Commissioners Court of Brazos County, Texas, for the adoption of
the Budget for 1973, as finally agreed upon.

'i The Court next received a certification by the County Clerk
of Brazos County pertaining to a Petition for Local Option Election
r? under the Texas Liquor Control Act, a copy of which certfication
is attached to theres minutes. On motion by Commissioner Stasn

seconded by Commissioner Wilcox, the Court unanimously voted to call
such election for Tuesday, November 7, 1972, to be bald in all

jf precincts at the same time and with the same election personnel as

the General Election for Brazos County, Texas, and it is so ordered.
On motion by Commissioner Stasny, seconded by Commissioner

f; Nolan the Court unanimously voted to pay the final balance to
i R & R Marble Company of Houston in the amount of $4,723.26 for
repairs•to the exterior marble of the Courthouse, and to E. Earl
Merrill, Jr., Architect, in-the amount of $175.90 for supervision
of the work.
..On motion by Commissioner Stasny, seconded by Commissioner
Wilcox, the Court ovtecl unanimously to pay Kustom Signals,Inc. the
sum of $1,785.00 for the purchase of a radar unit for the Highway
Patrol, such payment to be made from the Road and Bridge Fund.
On motion by Commissioner Nolan, Seconded by Commissioner
Stasny the.Court unanimously voted to approve a Publc Weithers Bond
by John Rankin Mahan, with American Employers Insurance Company,-
as surety.
On motion'by Commissioner Wilcox, seconded by Commissioner
Stasny, the Court unanimously voted to approve for filing a re-
plat of a portion of Lone Oak Acres, submitted by Fort McDonald.
On motion duly made, seconded and carried, the Court ovted
to pay all bills which have been properly filed and approved.
There being no further business the Court adjourned.
SPECIAL MEETING - OCTOBER 23, 1972
A special meeting of the Commissioners Court of Brazos County,
Texas, was held in the Commissioners Courtroom in the Brazos County
Courthouse, Bryan, Texas, on Monday October 83, 1972, at 2:00
o'clock P. M. with all members present .
