A regular meeting of the Commissioners Court of Brazos
County, Texas, was held in the Commissioners Courtroom in the
Courthouse in Bryan, Texas beginning at 10:00 A. M. on Monday, " s
,October 11, 1971, with the following present:
William R. Vance, County Judge, presiding;
Raymond A. Nolan, Commissioner of Precinct # 1;
Walter Wilcox, Commissioner of Precinct # 2;
Clyde J.-Porterfield, Commissioner of Precinct # 3; ;
W. A. Stasny, Commissioner,of Precinct # 4;
Frank Boriskie, County Clerk.
The Court received, approved and ordered filed as submitted
the following reports for September, 1971:

The Court received, considered and approved the following

a The minutes of the regular meeting held September 13, 1971
'and the special meeting held September 20,11971 were read and
a approved without change.
The Court considered several requests from General Telephone,-,
i Company concerning the laying of telephone cable in the right-
'of-way of county reads. The County Judge recommended that a
;general resolution be adopted establishing requirements through
J .
which General Telephone could lay such cable. Commissioner Nolan
made a motion that General Telephone Company be authorized to lay
} 'its cable in all County roads, providing that it shall comply
with the following conditions:
1. That General Telephone Company secure'the approval
of the Commissioner in whose precinct the work is
to be done as to location of the actual work, such
approval be obtained prior to the beginning of
actual construction.
2. That General Telephone Company repair all damage done
to any road by reason of such construction and restore
' the,road and right-of-way to its condition prior to
construction, and cause any contractor employed by it
to do likewise.
3. That Brazos County,reserve the right to require General
Telephone Company to relocate any such cable at no cost
'to Brazos County, should same become necessary due to
the widening, lowering, or other alteration of the road
or right-of-way.
The motion was seconded by Commissioner Wilcox, and carried
unanimously.

On motion by Commissioner Stasny, seconded by Commissioner
Nolan, the Court unanimously voted to approve the public weighers
bond of Melvin Lipsitz, Jr., with The Hanover Insurance Company
as surety.
The Court next considered a request submitted by the Elks
Lodge No. 2096 for tax exemption of its real property, under the
provisions of Article-7150, section 22, Revised Civil Statutes'

of Texas. After discussion, Commissioner Porterfield moved that
such request be granted and that the Elks Lodge be so exempt.' The_'
motion was seconded by Commissioner Stasny, and carried, with
'Commissioner Nolan, Porterfield and Stasny voting aye, and,
`Commissioner. Wilcox voting no.'

The Court proceeded to canvass the results of the local
option election held in College Station, Texas, on Saturday, - a,~,=-.'
October 1971, and duly adopted an order delcaring the results
of such election, which is annexed to these minutes and declared.
a part thereof.
The Court considered the a
pproval of statements submitted by the City of Bryan for utility relocations on-the East By-Pass,
including $8,522.66 for relocation along Wilkes Road, $109705.74 "
for relocation at Briarcrest Drive, and $10,638.73 for relocatims
at other crossings, for a total of $299867.13. Commissioner Stasny
moved that such statement be paid and reimbursement of _,5n% be
requested from the State of Texas. The motion was seconded by
Commissioner Nolan and carried unanimously.
On motion by Commissioner Stasny, seconded by Commissioner-
Nolan, the Court unanimously approved the payment of $611.00 in
f
foster care expenses for the month of September, 1971.
On motion by Commissioner Stasny, seconded by Commissioner
Nolan'. the Court' unanimously voted to•accept the bid of Bryan
Sheet Metal for repairs to the Courthouse roof in the sume of
$975.
On motion duly made and seconded the Court unanimously voted
to pay all bills which have been properly filed and approve all
reports.
The foregoing minutes beginning on page,~WVand concluded on

On this the 14th day of October 19 71_, the Commissioners' Court
of Brazos County, Texas, convened in - Special
session open to the public, at the regular meeting place thereof at the Courthouse in Bryan
Texas, with the following members of the Court present, to-wit:
William R. Vance , County Judge, "

constituting a quorum, and among other proceedings, passed the following order:
There came on to be considered the returns of an election held on the 9th day of
October 19 71 in College Station, Texas - -
(County, Justice Precinct, Incorporated City or,Town)
Texas, to determine whether or not the sale of alcoholic beverages of the type specified in the Order
calling said election shall be, prohibited or legalized.
It appearing to the satisfaction of the Court that said election was in all respects legally held, and
that said returns were duly and legally made, and that there were cast at said election 2 , 013
valid and legal votes, of which number there were cast
FOR*' THE,LEGAL SALE OF ALL ALCOHOLIC BEVERAGES, 1080 Votes
INCLUDING MIXED BEVERAGES
AGAINST* THE LEGAL SALE OF ALL ALCOHOLIC BEVER- 927 Votes
AGES, INCLUDING MIXED BEVERAGES
IT IS, THEREFORE, FOUND AND DECLARED AND SO ORDERED by the Commissioners'
Court of Brazos County, Texas: t'
That a majority of the qualified voters in said above named area voting at said election voted to
legalize the sale of alcoholic beverages of the type specified in the
(prohibit or legalise)

This order shall be entered_ of record in the office of the Clerk of this Court, whereupon it shall be

lawful in said above mentioned area to manufacture, sell or distribute alcoholic beverages of the type
specified in the order calling said election in accordance with the terms of the Texas'Liqubr Control Act
until such time as the qualified voters of said area may thereafter,. ate a legal election held for that pur-
pose by a majority vote decide otherwise. The Clerk of this Court shall, within three days from date
of this order, certify the results of the above mentioned election to the Secretary of State at Austin,
Texas."
It is further found and determined that notice of the date, place, and subject of this, meeting was
posted on the bulletin, board located at a place convenient to the public in the County Courthouse,
Brun ; Texas, at least three days preceding the date of this meeting and that all of the terms
and provisions of Article, 6252-17 have been complied with and a copy of said notice together with the
return of posting shall be attached to this order and become a part thereof.
The above order being read, it was moved and seconded that same do pass. Thereupon, the question
being called for, the following members of the Court voted AYE: Raymond Nolan, Clyde
