REGULAR MEETING - OCTOBER 129 1970
A regular meeting of the Commissioners' Court of Brazos
'County, Texas, was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Texas, beginning at 10:00 A. M. on Monday
October 12, 1970 with the following present:

The first item of business considered.was the request of
General Telephone Company for approval to lay telephone cable
-in the right-of-way of county roads. On Motion of Commissioner
Nolan, second by Commissioner Dunn such request was unamiously
approved, subject.to the right of Brazos County, Texas, to
require General Telephone Company to relocate such underground
cables under governing provisions of law, at no cost-to Brazos
County.
The County Judge next presented for consideration a
contract between Brazos County, Texas, and the Texas Dept. oft
Mental Health and Mental Retardation concerning the operation
of the Outreach Center for the period Sept. 1, 1970, to
August 31, 1971. On Motion by Commissioner Stasny, seconded
by Commissioner Nolan, the Court unamiously authorized the
County Judge to execute such contract, a copy of which is
attached"to these minutes.
The County Judge next presented for consideration a

contract between Brazos County, Texas, and the Brazos County
Counseling Service, a non-profit corporation, concerning the
furnishing of services to Brazos County by said organization,
including counseling, testing and treatment of persons with
' emotional, personality and behavior disorders. On Motion.by
Commissioner Nolan, seconded by Commissioner Dunn, the Court
unamiously authorized the County Judge to execute such contract,
contract being attached to these minutes.
On Motion by Commissioner Stasny, seconded by Commissioner
Nolan, the Court unamtously'voted to plky the expenses of foster
care for the month of September,,19709 in the total amount of
$893.17.

The Court next heard a.presentation on questions of voting
procedures in Brazos County by Mrs. D. J. Leabo, president of
the League of Women Voters of Brazos County, a-copy of which
presentation is attached to these minutes.
On Motion by Commissioner Dunn, seconded by Commissioner
Nolan C. R. Watson was unamiously appointed alternate Election
Judge for Precinct 11 to replace W. D. Scoates, who is ineligible
to serve at this time. On Motion by Commissioner Nolan and
seconded by Commissioner Stasny, the Court unamiously voted to
appoint J. B. Hervey as Election Judge and David Frinch as
alternate of Precinct and Arthur Vinzant Judge and "
K. A. Manning alternate Judge replacing George Draper in Precinct.

10. On Motion duly made and seconded, t~e Court unamiously
voted to accept the low bid of Corbusier for a Chevrolet Truck
for the trade difference price of $4262.00. The other bid was
k that•of Cade Motor Company in the amount of X5434.50•
z;. The Court received and accepted the resignation of
B. V. Elkins as Veterans Service Officer, effective January
1971 with the thanks of the entire Court for the valuable
service rendered by Mr. Elkins to the Veterans of Brazos County.
There being no further business, the Court adjourned.

A G R E E M E N T
Pursuant to authority contained in Section 2.13 and 2,17, Article 5547-202,
Vernon's Texas Civil Statutes, as amended, the Austin State Hospital of the
Texas Department of Mental Health and Mental Retardation, hereinafter called
"Hospital", acting by and thi:ough its Superinten6Qnt, and Brazos County, Texas,
hereinafter called "Brazos County", acting by and through its Commissioners
' Court, jointly agree to provide mental health services to residents of Brazos
County, Texas, in conformity with the following terms and conditions, to-wit:

"Brazos County" does hereby agree to make available to "Hospital" the
following described property located in Bryan, Brazos County, Texas, to-wit:
Suite of offices designated as 406 Varisco
'r7 Building on Main Street.
To be used as a mental health services outreach center by "Hospital" from and
<i after September 1, 1970 to and including August 31, 1971.

"Brazos County" agrees to provide utilities, including electricity, gas,
water and telephone service. "Brazos County" agrees to provide necessa rJ
office furniture and equipment for such building as requested by the "hospital".-, ;
r "Brazos County" further agrees to provide maintenance,and upkeep of the
building, all furniture and equipment therein and to adequately insure all of
such facilities for "Brazos County's" benefit.
In further consideration of the "Hospital's" agreement to provide mental
health services to the People of Brazos County of the State of Texas, "Brazos
County" covenants and agrees to reimburse the outreach center staff for ex-
penses incurred in travel which was necessary in the performance of their duties.
Allowable travel expense will be computed at the rate of 10(,- per mile and shall

"Hospital" agrees to employ a full-time registered nurse or caseworker,
a full-time clerk and a physician for one-half (1/2) day each week to staff
the aforesaid facility.
IV.
"Hospital" covenants and agrees to make no alterations, improvements
or additions to said premises nor to sublet or assign the whole or part thereof,
.without first obtaining "Brazos County's" written consent.

COUNTY OF BRAZOS X
WHEREAS, Brazos County, Texas, hereafter referred to as "COUNTY"
and the Brazos County Counseling Service, hereafter referred to as
"SERVICE" both being fully agreed that the SERVICE performs'a use-
ful and important function for the public'health of the citizens of
Brazos County; and
" WHEREAS, the COUNTY deems the role performed by the SERVICE to
be a public necessity and a promotion of health, safety, morals, and
general welfare of the citizens of Brazos County; and
WHEREAS, the functions, services and general operations of the,
SERVICE constitute areas which could be part of the governmental
operations of the COUNTY, but that establishment of the SERVICE'
more succinctly serves this end;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that Brazos
County, Texas, acting by and through its governing body, and the
~-,,"'-.Brazos County Counseling Service, acting through its duly author-
ized representative, do mutually covenant, contract and agree as
as follows
1. That for and in consideration of the sum of Ten Dollars
($10.00) and other good and valuable consideration as budgeted,
the SERVICE agrees to perform the following:
a. Provide for-the study and treatment•of indi-
viduals of all colors, creeds and nationali-
ties with emotional, personality and behavior
disorders.
b. Perform the following services:
(1) Diagnostic;
(2) Evaluative;
(3) Treatment;
(4) Consultation;
(5) Educations
(6) In-service training.
c. Provide for consultation to all agencies and
other professionals in the community.
2. That the total sum provided for by each annual Budget
shall be payable in one lump sum annually upon application by
the SERVICE and approval by the County Judge.
3. That nominees to the Board of Directors of the SERVICE
shall be selected by the SERVICE with the advise and consent of "
the COUNTY. The COUNTY reserves the privilege to reject any
nominee to the Board of Directors of the SERVICE.
4. The COUNTY reserves the right to withhold any disburse-
ment of funds to the SERVICE if compliance with the provisions
of § 3 should cease to exist.
5. That this contract may be terminated by either the
COUNTY or SERVICE by giving the other party fifteen (15) days
written notice. The SERVICE also recognizes that its servic s
and functions for the citizens of the COUNTY as outlined in 1
may be performed directly by the COUNTY, and that if the COUNTY
ever desires to engage in said services and functions directly,
that this agreement shall terminate immediately upon notice
from the COUNTY that it will henceforth engage in said services
and functions directly.

6. That the term for this agreement shall be until December
31, 1971, but shall be automatically renewed and extended for sub-
sequent terms of one year unless terminated by either party pur-
suant to § 5.
7. Venue for this contract shall be in Brazos County, Texas.

REQUESTING VOTING BOOTHS
TO REPLACE TABLES

Lam Mrs. C.J. Leabo, president of the League of Women Voters
of Brazos County. I represent more,than 90 women who are
working to encourage informed and active participation-of all
citizens in government.
r: As you may know, the League does not su
pport'or oppose any
political party or any candidate,-but'it does take-action on
governmental issues which it has studied and on which its
members have reached agreement.
'For the past year, our members have studied the Texas election
' laws and the voting procedures here in Brazos County, Bryan,
` and College Station, and have recently reached agreement on
four areas where we feel improvements can and should•be made.
r I believe you all have copies of our statement on this matter.
I am here today to ask
your special consideration of our first ,
support position regarding the use of voting booths. As .
stated in Art. 7.01 of the Texas Election Laws, "Voting booths
shall be furnished and used at elections at each voting precinct.'
in towns or cities of ten thousand (10,000) inhabitants or
more." (underlining mine)
We maintain this means that tables should not be used at
voting'precincts in Bryan and College Station.
Time is admittedly growing short, but we still,feel it is
possible for you to provide sufficient voting booths to replace
all tables at all election precincts in Bryan and College
Station for the Nov. 3 general election. In the interest of
guaranteeing each citizen a secret ballot, we ask you to do so.
While I am here,`I would like-to ask if you plan to hold a
school of instruction for all election officials before the
Nov. 3 election. If not, we ask that you do so, since officials
who are familiar with current election laws are a good protection
against election errors. When you hold an instruction school,
please call on the League for any assistance you might need. We
have several members who are well versed in the 1970 laws and
would be happy to help.
