Commissioner Stasny moved that such permission be granted 'subject to the following terms and conditions: 1. That detailed plans for each crossing be submitted to the Commissioner of that precinct in which such crossing lies for approval prior to the beginning of construction. 2. That all restoration work be accomplished in a manor satis- factory to the Commissioner of that precinct. 3. That allfuture relocations or changes made necessary by the widening, lowering or other improvements of any county road or state highway be accomplished at no expense to Brazos County. Motion was seconded by Commissioner Dunn and unanimously passed. The Court next considered the suggestion of the Brazos Valley Development Council that an order be passed providing for interlocal i assistance of law enforcement officers during emergencies. On motion by Commissioner Dunn, seconded by Commissioner Nolan the Court Pursuant to the provisions of Article 999b, Vernon's Texas Civil Statutes, Senate Bill 233, Acts of the 61st Texas Legislature, Regular Session, 1969, the Sheriff of this County is authorized to assign the regulary employed law enforcement personnel of his department to assist any other county or municipality in this State, when a state of civil emergency in such other county or municipality has been declared by proper authority, upon request by such proper authority, and when, in the opinion of such proper authority, a need exists in such other county or municipality for the services of additional law enforcement officers to protect the health, life and property of such other county or municipality, its inhabitants, and the visitors thereto, by reason of riot, unlawful assembly characterized by the use of force and violence, or threat thereof by three or more persons acting together or without lawful authority, or during time of natural disaster or man-made calamity. It is further ordered that whenever any law enforcement officer of any other county or municipality is assigned to this County, under authority of an order adopted by the governing body of such other county or municipality, to assist under circumstances as described above which may exist in this County, that such officer shall be a peace officer of this County and shall be under the command of the Sheriff of this Count while so assigned, and he shall have all the powers of a regular law enforcement officer of this County as fully as though he were within the county or municipality where regularly employed and his qualifications, respectively, for office where regularly employed shall constitute his qualification for office in this County, and no other oath, bond, or compensation shall be made. It is further ordered that when any law enforcement officer of this County is ordered by proper authority to perform peace officer duties outside the territorial limits of this County, he shall be entitled to the same wage, salary, pension, and all other compensation and all other rights for such service, including injury or death benefits, the same as though the service had been rendered within the limits of this County; and he shall also be paid for any reasonable expenses of travel, food, or lodging, as well as for damage to equipment and clothing, and medical ex- penses, which he may incur while on duty outside such limits, or while traveling to or from such assignment. It is further ordered that when any law enforcement officer is assigned to this County from another county or city under the circum- stances described above, and upon request of the proper authority of this County that this County will, upon proper request, reimburse the county or city furnishing the services of such law enforcement officer for his actual expenses of travel, food, lodging, and for such cost of damage to .equipment and clothing resulting from the services of such law enforcement officer in this County and for which the county or city where he is regularly, employed has paid. a Y• ,r. ~ } ~ _ .1 ~;1 'r• ••L t.y a+~ ~1"~~'; ~ JY; A' .v • T i '.i°- .r. f. 1. +J' ..yi _ •i.-r,l. ~:A a`y ,i- n9 fir', , 1. The County Judge next,presented the need for repairs to the existing boiler for the Brazos County Courthouse. After a' discussion. the Court agreed to accept the recommendation of J. W. Hall concerning the replacement -of such boiler and to accept bids for the actual re- placement thereof. On motion by Commissioner Stasny and seconded by Commissioner Nolan the Court voted to accept the low bid of Otis Mc•'Donald Company in the amount of $169.00 for the purchase of two adding machines for the-Food Stamp Office. The other bid being in the amount of X174.00 from 1'acy's Business AJachine Company, On motion by Commissioner Nolan and seconded by Commissioner Porterfield the Court agreed to pay the amount of x985.00 to Souther Steel Company for the final estimate for jail i.mprovoments. The Court next heard a request from Charles Spinn concerning the foster care of handicaped children. On motion by Commissioner Nolan and seconded by Commissioner Dunn the roust unanimously agreed to increase the monthly fee' 'for foster care of handicaped children to `>60.00 per month upon certification by, the Child 1Vel fare Unit. The Court next considered the salary of the maintainence personnel. for the Courthouse and after a discussion agreed to increase the budgeted salary of the janitor superintendent from 'S5.292.00 to yi)5, 520.00 per annum, 1 janitor from $3.175.00 to $3,420.00 per annum and the ~,ourtho'iise maid from ',;2,410.00 to ,$2,640.00 per annu,r. all effective June 1, 1970 and to amond the 1070 budget accordingly. The lourt next considered the 'following proposed projects to the Commissioners Courtapproval by the Brazos Talley ?)ovelopment Council for review only,: 1. Improvements of State Highway 21 from the r{issour-i Pacific Pail-raod underpass to the Brazos Piver. 2. Construction of the north segment of the west by-pass (FM 2318) . 3. Improvements of State Highway 21 from the Missouri Pacific Pailroad underpass to the Bryan city-limits. 4. Tmprovements of State Highway 6 from its intersection with the East by-pass to the Navasota River.
